COMMON COUNCIL Minutes 11-11-1997 COMMON COUNCIL - CITY OF MUSKEGO (Approved 11/25/97) MINUTES OF MEETING HELD NOVEMBER 11, 1997 The meeting was called to order at 8:45 P.M. by Mayor De Angelis. Also present were Aldermen D’Acquisto, Patterson, Salentine, Sanders, Slocomb and Woodard, City Attorney Molter, Clerk-Treasurer Marenda, and Deputy Clerk Blenski. Alderman Pionek was not present. Finance Director Gunderson and Plan Director Sadowski were in attendance until dismissed. The Clerk-Treasurer noted the meeting was noticed in accordance with the Open Meeting Law on 11/7/97. Salentine moved for approval of minutes of 10/28/97. Woodard seconded, carried. Clerk-Treasurer read the Notice of Closed Sessions. COMMUNICATIONS FROM THE MAYOR’S OFFICE In honor of Veterans’ Day, Mayor requested a moment of silence be observed in memory of those who have served our country. The parties involved have agreed to postpone the suspension/revocation hearing scheduled for 11/13/97 to a later date. Mr. Sadowski was dismissed at 8:50 p.m. Reso. #255-97 - Resolution Authorizing Ehlers and Associates, Inc. to Solicit Competitive Proposals for Not to Exceed $2,775,000 General Obligations Promissory Notes of the City of Muskego, Wisconsin. Salentine moved for adoption. Slocomb seconded. Mr. Dave Anderson was present; he stated the notes would be used for the proposed community center and 1998 capital and water projects. Carried 6-0. Reso. #256-97 - A Resolution Authorizing the Establishment of an Escrow Account with Respect to the General Obligation Refunding Bonds, Dated May 5, 1994 of the City of Muskego. D’Acquisto moved for adoption. Sanders seconded. Mr. Anderson stated this resolution authorized the repayment of outstanding debt. Carried 6-0. Reso. #267-97 - Approval of Certified Survey Map - Pellman. Salentine moved for adoption. Slocomb seconded. Carried 6-0. COMMITTEE REPORTS The 11/10/97 Committee of the Whole minutes were received. Patterson moved for acceptance of minutes of the 11/3/97 Public Services Committee meeting. Slocomb seconded, carried. D’Acquisto moved for acceptance of minutes of the 11/5/97 and 11/11/97 Finance Committee meetings. Sanders seconded. D’Acquisto requested 11/5 minutes be corrected to reflect that he did not participate in discussion or vote regarding fire department contracts. Motion to accept minutes as corrected carried. Minutes of the 11/4/97 Plan Commission and 10/22/97 Library Board meetings were received and placed on file. Salentine stated Committee of the Whole reviewed establishing resident vs. nonresident charges. Salentine moved to defer to allow Finance Director an opportunity to obtain and review additional 1997 information. Patterson seconded; motion carried. Issue to be placed on 11/19 Finance Committee agenda. Ald. D’Acquisto received an emergency call and left the meeting. Reso. #250-97 - Approval of Certified Survey Map - Graves and Reso. #251-97 - Approval of Certified Survey Map - Graves, on the floor, deferred 10/28/97. Slocomb moved to defer. Salentine seconded, carried. Ord. #952 - An Ordinance to Amend Chapter 13, Section 13.01(16) of the Municipal Code of the City of Muskego (Number of Dogs Limited). Second Reading. Salentine moved for adoption. Slocomb seconded. Salentine stated Committee of the Whole determined to table and so moved. Slocomb seconded; motion carried 5-0. Mayor noted there was no reason to convene into Closed Session No. 1. as the Committee of the Whole did at their 11/10/97 meeting. Reso. #257-97 - Appropriating the Necessary Funds for the Operation of the Government and Administration of the City of Muskego for the Year 1998. Slocomb moved for adoption. Sanders seconded. Ms. Gunderson explained the proposed amendment to reflect an increase in revenue for state transportation aids in the amount of $66,444 and a decrease in I.S. expenses in the amount of $9,874. Slocomb moved to amend. Salentine seconded, carried. Reso. #257-97, as amended, adopted 4 to 1 with Patterson voting “no.” The 1998 budget levies a tax of $5.29 per $1,000. Reso. #258-97 - Approval of 1998 Water Utility Budget. Sanders moved for adoption. Woodard seconded. Carried 5-0. Reso. #259-97 - Approval of 1998 Sewer Utility Budget. Sanders moved for adoption. Woodard seconded. Carried 5-0. Reso. #260-97 - Approval of 1998 Capital Budget. Salentine moved for adoption. Sanders seconded. Carried 4 to 1 with Patterson voting “no.” Reso. #262-97 - Authorize Execution of Health Insurance Contract for 1998. Sanders moved for adoption. Salentine seconded. Ms. Gunderson noted that the 1998 contract reflected a 4% increase over last year. Motion carried 5-0. Reso. #263-97 - Authorize Execution of Dental Insurance Contracts for 1998. Salentine moved for adoption. Sanders seconded; carried 5-0. Mayor noted cost of insurance is totally carried by the participant. Motion carried 4 to 1 with Sanders voting “no.” Ms. Gunderson was dismissed at 9:28 p.m. Reso. #261-97 - Amendment to SEWRPC 208 Plan. Salentine moved for adoption. Sanders seconded. Discussion took place regarding the area south of Woods Road. Slocomb asked the rationale for removing the area. Sanders stated there is plenty of open space available; no one is petitioning for this area to be included. He would like Public Utilities Committee to review again prior to Council action. Slocomb moved to defer to Public Utilities Committee. Sanders seconded, carried. Reso. #265-97 - Approval of Certified Survey Map - Norway Business Park, LLC, Town of Norway. Salentine moved for adoption. Patterson seconded; carried 5-0. Reso. #266-97 - Approval of Certified Survey Map - Baranowski. Salentine moved for adoption. Slocomb seconded; carried 5-0. Reso. #268-97 - Approval of Certified Survey Map - Markgraf. Salentine moved for adoption. Slocomb seconded; carried 5-0. Reso. #269-97 - Approval of Certified Survey Map - Knutilla. Salentine moved for adoption. Woodard seconded; carried 5-0. Reso. #270-97 - Approval of Creation of Easement as to Larkspur Road Vacation. Patterson moved for adoption. Salentine seconded. Atty. Molter stated title report must be received. Salentine moved to defer. Slocomb seconded, carried. Reso. #271-97 - Proceedings by the Common Council of the City of Muskego to Discontinue and Vacate a Road Right-of-Way in the City of Muskego, Wisconsin (Larkspur Road). Patterson moved for adoption. Salentine seconded. Salentine moved to defer. Slocomb seconded, carried. LICENSES Salentine moved for approval of Operator’s License for Christopher Elsner, Nancy Ambrowiak, Ernest Sobczak, Holly Taylor-Feuling, Gary Habetler, and Cheryl Chaney. Patterson seconded, carried. VOUCHER APPROVAL Sanders moved for approval of General Vouchers in the amount of $423,946.50. Salentine seconded, carried 5-0. Sanders moved for approval of Utility Vouchers in amount of $165,974.17. Woodard seconded, carried 5-0. COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW Mayor requested review of the Notice of Advisory Referendum and map at the next Council meeting as two of the aldermen were not present. Common Council Minutes Page 4 November 11, 1997 Slocomb moved to convene into closed session pursuant to §19.85 (1)(g) Conferring with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to become involved, more specifically contract dispute with Gustafson regarding Boxhorn, Ryan, Groveway Sewer Project. Salentine seconded. Carried 5-0. Sanders moved to convene into closed session pursuant to §19.85(1)(g) Conferring with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to become involved, more specifically dispute over sewer connections with Town of Norway Sanitary District. Salentine seconded. Carried 5-0. The clerk and deputy were dismissed at 9:55 p.m.. The Council reconvened into open session. Salentine moved to adjourn at 10:10 p.m. Sanders seconded, carried.
