COMMON COUNCIL - CITY OF MUSKEGO (Approved 11/11/97)
MINUTES OF MEETING HELD OCTOBER 28, 1997
The meeting was called to order at 8:06 P.M. by Mayor De Angelis. Also present were
Aldermen D’Acquisto, Patterson, Pionek, Salentine, Sanders, Slocomb and Woodard,
City Attorney Molter, Clerk-Treasurer Marenda, and Deputy Clerk Blenski.
The Clerk-Treasurer noted the meeting was noticed in accordance with the Open
Meeting Law.
D’Acquisto moved for approval of minutes of 10/14/97. Patterson seconded, carried.
Clerk-Treasurer read the Notice of Closed Sessions.
There was no communication from the Mayor’s office.
Reso. 243-97 - Honoring Muskego AFS-USA Student - Julien Lambilliotte. Salentine
moved for adoption. Patterson seconded. Carried 7-0. Resolution was presented to
Julien.
COMMITTEE REPORTS
Patterson moved for acceptance of minutes of the 10/15/97 Public Services Committee
meeting. Pionek seconded, carried.
D’Acquisto moved for acceptance of minutes of the 10/20/97, 10/27/97 and 10/28/97
Public Works Committee meetings. Pionek seconded. Pionek moved for individual
consideration of paragraph regarding “Urban/Rural Drainage” on page one and
paragraph regarding plans for the “Muskego Middle School” on page two of the 10/27
minutes with issues to be sent back to the committee. D’Acquisto seconded, carried.
Motion to adopt minutes without said paragraphs carried. Pionek requested correction
of typographical errors in paragraph eight of the 10/20 minutes (“be”).
Sanders moved for acceptance of minutes of the 10/20/97 Public Utilities Committee
meeting. Woodard seconded, carried.
D’Acquisto moved for acceptance of minutes of the 10/22/97 and 10/28/97 Finance
Committee meetings. Salentine seconded. D’Acquisto moved for individual
consideration of paragraph regarding 1998 health insurance on page two with issue to
be sent back to committee. Salentine seconded, carried. Slocomb requested technical
correction to paragraph (page two) regarding Freedom Acres to remove the word “stop-
gap.” Motion to adopt minutes without said paragraph and correction carried.
Meeting minutes of the 10/7/97 Plan Commission, 10/13/97 Parks & Recreation Board,
and 9/24/97 Library Board were received and placed on file.
Reso. #212-97 - Resolution to Establish Fees for Rescue Service, on the floor,
deferred 10/14/97. Salentine moved to defer as numbers have been received but not
yet reviewed. Woodard seconded; motion carried with D’Acquisto abstaining as he is a
member of the department.

Salentine moved to table Resolutions #226-97 through #232-97. D’Acquisto seconded.
Motion carried with Sanders voicing a “no” vote.
Ord. #949 - An Ordinance to Amend Chapter 1, to Rescind Sections 1.03 and 1.08 and
Amend Section 1.07 and Amend Sections 1.05(6)(b) and 1.05(6)(j) of the Municipal
Code of the City of Muskego - General Government (Elected Officials/Boards and
Commissions). Second Reading. Salentine moved for adoption. Sanders seconded.
Mayor noted there were no limitations imposed by state statute for Park & Rec Boards
as exist regarding Library Boards. Discussion took place about the sentence in Section
3, “The Mayor shall average forty hours per week.” D’Acquisto objected and moved to
delete. Salentine seconded. Patterson expressed concern about removing language.
Sanders stated language that the office was full time was sufficient. Motion to amend
carried with Patterson voicing the “no” vote. Ord. #929, as amended, adopted 7-0.
Ord. #950 - Establishing Salaries for Certain Elected Officials. Second Reading.
Slocomb moved for adoption. Salentine seconded. Carried 7-0.
Ord. #951 - An Ordinance to Amend the Zoning Map of the City of Muskego (RCE and
RS-1 to RCE/OPD - Graves). Second Reading. Salentine moved for adoption.
Sanders seconded. D’Acquisto moved to amend to add, “subject to approval of the
certified survey maps through Resolutions #250-97 and #251-97” at the end of Section
3. Sanders seconded, carried. Mayor noted those resolutions would be deferred this
evening as maps were not complete. Ord. #951, as amended, adopted 7-0.
Reso. #244-97 - Initial Resolution Authorizing $4,450,000 General Obligation bonds of
the City of Muskego for Library Projects. Salentine moved for adoption. Slocomb
seconded. Dave Anderson appeared to outline details of the borrowing. Motion
carried 7-0.
Reso. #245-97 - Resolution Directing Publication of Notice to Electors. Sanders moved
for adoption. Slocomb seconded. Carried 7-0.
Reso. #246-97 - Establishing Traffic Regulations. Patterson moved for adoption.
Sanders seconded. Carried 7-0./
Reso. #247-97 - Approval of Holding Tank Agreement - Favre & Associates, Inc. (Broke
Spoke). Patterson moved for adoption. Pionek seconded. Carried 7-0.

Reso. #248-97 - Award of Bid - Industrial Park Street Lighting (Outdoor Lighting
Constr./$271,075). Sanders moved for adoption. Salentine seconded. Carried 7-0.
Reso. #249-97 - Authorizing the Issuance of a Summons as to Complaint Regarding
the Liquor License of Alpine Lanes. D’Acquisto moved for adoption. Slocomb
seconded. Carried 7-0.
Reso. #250-97 - Approval of Certified Survey Map - Graves and Reso. #251-97 -
Approval of Certified Survey Map - Graves. Salentine moved for adoption. D’Acquisto
seconded. Salentine moved to defer. D’Acquisto seconded, carried.
Reso. #252-97 - Disapproval of Amended Street and Highway Width Map of Waukesha
County. Salentine moved for adoption. Sanders seconded. Carried 7-0.
Reso. #253-97 - Registering Opposition to Proposed Land Division and Development
Control Ordinance for Waukesha County. Salentine moved for adoption. D’Acquisto
seconded. Sanders asked that input from county be requested in response to City’s
concerns. Carried 7-0.
Ord. #952 - An Ordinance to Amend Chapter 13, Section 13.01(16) of the Municipal
Code of the City of Muskego (Number of Dogs Limited). First Reading. Discussion
took place regarding this issue. Mayor noted a public hearing was not required;
Sanders suggested one be held. Patterson asked why concerns of all sponsors were
not submitted to Public Services Committee. The current ordinance allows for two
dogs. The proposed ordinance was written using existing language and changing the
number of dogs to three. He requested the following: 1. what restrictions other
communities have; 2. an informational public hearing be held; 3. what should the
language of the ordinance be.
LICENSES
D’Acquisto moved for approval of Operator’s License for Dustine Flamini. Sanders
seconded, carried.
VOUCHER APPROVAL
D’Acquisto moved for approval of General Vouchers in the amount of $272,982.44.
Sanders seconded, carried 7-0.
Sanders moved for approval of Utility Vouchers in amount of $318,997.48. Woodard
seconded, carried 7-0.
CITY OFFICIALS’ REPORTS
Clerk-Treasurer announced that a public hearing would be held 11/11/97 at 7:25 p.m.
to consider an amendment to the sewer service area map of the City.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW
The Council determined that their 12/23/97 meeting would be canceled due to the
holiday. Slocomb requested that consideration to waive the Plan fee for the school

district be placed on the 11/5/97 Finance Committee agenda as well as the issue of a
Developer’s Agreement. D’Acquisto reiterated policy of Public Works Committee that
“Requested Action Form” must be submitted at the time an item is placed on the
committee’s agenda.
Mayor noted it was not necessary to go into Closed Session 1. regarding contract
dispute with Gustafson/Boxhorn, Ryan, Groveway Sewer Project.
D’Acquisto moved to convene into closed session pursuant to §19.85 (1)(c)
Considering employment, promotion, compensation, or performance evaluation data of
any public employe over which the governmental body has jurisdiction or exercises
responsibility, more specifically Compensation and Classification Study Preliminary
Final Report. Slocomb seconded. Carried 7-0.
The clerk and deputy were dismissed.
The Council reconvened into open session. D’Acquisto moved to adjourn at 9:50 p.m.
Pionek seconded, carried.
