COMMON COUNCIL - CITY OF MUSKEGO
MINUTES OF THE MEETING HELD JULY 8, 1997
The meeting was called to order at 7:41 P.M. by Mayor De Angelis. Also present were
Aldermen D’Acquisto, Patterson, Pionek, Salentine, Sanders, and Slocomb, City
Attorney Molter, Clerk-Treasurer Marenda, Finance Director Gunderson, Plan Director
Sadowski, and Deputy Clerk Blenski. Alderman Woodard was not present.
The Clerk-Treasurer noted that the meeting was noticed in accordance with the Open
Meeting Law on 7/3/97.
D’Acquisto moved for approval of the minutes of the 6/24/97 meeting. Pionek
seconded, carried.
COMMUNICATIONS FROM THE MAYOR’S OFFICE
The Mayor gave an update on the Linnie Lac dam situation and the state’s budget bill.
PERSONAL APPEARANCES
Mr. Don Vilione of Conley, McDonald presented the City’s 1996 financial information.
COMMITTEE REPORTS
D’Acquisto moved for acceptance of the 7/2/97 and 7/8/97 Finance Committee minutes.
Salentine seconded, carried.
Minutes of the 7/1/97 Plan Commission meeting and 6/9/97 Parks & Recreation Board
Meeting were received and placed on file.
Ord. #928 - An Ordinance to Amend Chapter 17 of the Municipal Code of the City of
Muskego to Create Section 9.10 (OH Height District), on the floor, deferred 6/24/97.
D’Acquisto moved to amend to include proposed language submitted by the Plan
Department. Sanders seconded, carried. Ord. #928, as amended, adopted 6-0.
Ord. #934 - An Ordinance to Amend Chapter 14 of the Municipal Code of the City of
Muskego to Add Section 1.5(2)(n), on the floor, deferred 6/24/97. Sanders moved to
defer. D’Acquisto seconded, carried.
Ord. #936 - An Ordinance to Amend Chapter 17 of the Municipal Code of the City of
Muskego to Create Section 8.145 (B-P Business Park District). Second Reading.
Salentine moved for adoption. Sanders seconded. Matt Sadowski presented proposed
changes in response to comments received by the Council. The Council discussed
those with Mr. Sadowski and requested the following issues be further reviewed: F. 7.
Noise - needs clarification to be more specific, if based on a fixed standard which can
be measured, it is then the same for all and enforcement is easier. Mr. Sadowski
stated the existing language is more qualitative. Mayor stated business owners need

to know specifically what is allowed. Mr. Sadowski was requested to check other
communities to obtain enforcement information. F. 2 . Lighting - Slocomb asked about
level of fixtures and D’Acquisto suggested Mr. Sadowski check with consultant from his
district. D. 1. Clarify exclusion of drive-in facilities under restaurants. B. 2. Suggestion
to add the word “facilities following “medical waste disposal;” concerns about uses such
as research laboratories with suggestion to allow certain uses, where there are
concerns, by conditional use grant. E. Building Design - add “or stained” following “. . .
material being utilized or painted . . . .” Pionek expressed concern about chemical
storage being addressed. He also wants to work on a formula regarding the floor area
ratio and submit for consideration. D’Acquisto believes no accessory structures should
be allowed with the Council concurring. Pionek suggested more specific language
regarding radio, television towers (as per Brookfield). D’Acquisto moved to defer.
Pionek seconded, carried.
Ord. #937 - An Ordinance to Amend the Zoning Map of the City of Muskego (RS-2 to
RS-2/OPD - Deer Creek Addition No. 1). Second Reading. Salentine moved for
adoption. D’Acquisto seconded. D’Acquisto moved to defer. Pionek seconded,
carried.
Reso. #157-97 - Amendment to 1997 Budget. D’Acquisto moved for adoption.
Salentine seconded. Ms. Gunderson presented explanation of budget transfers.
Carried 6-0.
M. Sadowski and D. Gunderson were excused.
D’Acquisto moved to convene into Closed Session pursuant to §19.85(1)(e)
Deliberating or negotiating the purchasing of public properties, the investing of public
funds, or conducting other specified public business, whenever competitive or
bargaining reasons required a closed session, more specifically acquisition of land for
the proposed library. Slocomb seconded. Carried 6-0.
The Council reconvened into Open Session.
Reso. #155-97 - Resolution of Necessity (Library). Patterson moved for adoption.
D’Acquisto seconded. Carried 6-0.
Reso. #156-97 - Authorizing the Hiring of an Appraiser and Relocation Expert to Carry
Out the Resolution of Necessity Known as Resolution #157-97. Patterson moved for
adoption. Salentine seconded. Carried 6-0.
Reso. #158 -97 - Approval of Certified Survey Map - Brodel. Salentine moved for
adoption. Sanders seconded. Carried 6-0.

Reso. #159-97 - Approval of Certified Survey Map - Baranowski. Salentine moved for
adoption. Slocomb seconded. Carried 6-0.
Reso. #160-97 - Resolution of Support - Domonic R. D’Acquisto. Salentine moved for
adoption. Pionek seconded. D’Acquisto stated he appreciates the gesture. However,
he requests Resolution be withdrawn. Salentine stated she respected D’Acquisto’s
feelings and withdrew her motion. She encouraged the Council members to write
personal letter of support if they choose. Pionek agreed to withdraw his second.
Ord. #938 - An Ordinance to Amend the Zoning Map of the City of Muskego from EA to
EA/OIP (Public Boat Ramp). First Reading.
Ord. #939 - An Ordinance to Amend the Zoning Map of the City of Muskego from RS-1
and RS-2 to RS-1/OPD and RS-2/OPD (Park Estates). First Reading. D’Acquisto
requested map of area.
City Charter Ordinance #16 - A Charter Ordinance Providing for the Appointment of
the Assessor for the City of Muskego. First Reading. Molter needs to review the latest
revision. Patterson expressed concern about the position being appointed.
City Charter Ordinance #17 - A Charter Ordinance Providing for the Appointment of
the Clerk-Treasurer for the City of Muskego. First Reading. Molter is also reviewing
the language of this ordinance as well.
LICENSES
D’Acquisto moved for approval of Operators’ Licenses for Robert Doyle and Karen
Long. Salentine seconded, carried.
D’Acquisto moved for approval of Outside Dance Permit for Aud Mar Supper Club for
7/20/97. Sanders seconded, carried.
D’Acquisto moved for approval of Outside Dance Permit for Favre & Associates (Broke
Spoke) for 8/2/97. Sanders seconded. Carried 6-0.
D’Acquisto moved for approval of Class “B”/”Class B” Retailer’s License for St. Paul’s
Church for 8/3/97. Salentine seconded, carried.
D’Acquisto moved for approval of Salvage & Recycling Permit for John Glockner.
Slocomb seconded, carried.
VOUCHERS
D’Acquisto moved for approval of General Vouchers in the amount of $360,733.23.
Salentine seconded. Carried 6-0.
Sanders moved for approval of Utility Vouchers in the amount of $111,502.37.
Slocomb seconded. Carried 6-0.
CITY OFFICIALS’ REPORTS

The Clerk-Treasurer noted that a Special Big Muskego Lake Board of Commissioners’
meeting was scheduled for 7/17/97 at 7:00 PM.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW
Patterson moved to reconsider previous decision to not send out a city-wide survey.
D’Acquisto seconded. Carried 5 to 1 with Sanders voting “no.” Further discussion took
place on the issue. Sanders moved to not do survey. Patterson seconded. Motion
failed 2-4 with D’Acquisto, Pionek, Salentine, and Slocomb voting “no” and Patterson
and Sanders voting “yes.” It was determined a Resolution would be placed on the next
Council agenda to outline the criteria for the survey. Mayor noted that someone will
need to write the Resolution and provide to the Clerk’s office in time to be placed in the
packets.
D’Acquisto moved to convene into Closed Session pursuant to §19.85(1)(g) Conferring
with legal counsel for the governmental body who is rendering oral or written advice
concerning strategy to be adopted by the body with respect to litigation in which it is or
is likely to become involved, more specifically contract dispute with Gustafson
regarding Boxhorn, Ryan, Groveway Sewer Project. Sanders seconded. Carried 6-0.
D’Acquisto moved to convene into Closed Session pursuant to §19.85(1)(c)
Considering employment, promotion, compensation, or performance evaluation data of
any public employe over which the governmental body has jurisdiction or exercises
responsibility, more specifically 1996 labor negotiation strategies (Police). Salentine
seconded. Carried 6-0. The Clerk and Deputy were dismissed.
Salentine moved to adjourn at 11:36 PM. Sanders seconded, carried.
