ccm19960924COMMON COUNCIL - CITY OF MUSKEGO MINUTES OF MEETING HELD SEPTEMBER 24, 1996 The meeting was called to order at 8:05 P.M. by Mayor De Angelis. Also present were Aldermen D'Acquisto, Patterson, Pionek, Rasmussen, Salentine, and Suhr, Clerk-Treasurer Marenda, City Atty. Molter, and 0 Deputy Clerk Blenski. Alderman Sanders was not present. The Clerk-Treasurer reported that the meeting was noticed in accordance with the Open Meeting Law on 9/20/96. D'Acquisto moved for approval of minutes of 9/10/96 meeting. Suhr seconded. D'Acquisto noted that the Library Board minutes were not received at the 9/10 Council meeting and should be removed from the minutes. Motion to approve as corrected carried. The Clerk-Treasurer read the Notice of Closed Session. COMMUNICATIONS FROM THE MAYOR'S OFFICE Mavor stated article in the Journal Sentinel reoardins the killins of fish in Little Muskego Lake was erroneous. The-School Board has requested a joint meeting to be held with the Council regarding the new school. Patterson requested that pool fees be included as an agenda item for that meeting. - COMMITTEE REPORTS D'Acquisto moved for acceptance of the minutes of the 9/18/96 and 9/24/96 Finance Committee Meetings. Suhr seconded, carried. Patterson moved for acceptance of the minutes of the 9/11/96 Public Services Committee Meeting with correction to Page 2, Paragraph 2 to add "and traffic counter" after . . . purchase of a radar camera" with these being Capital Budget items and correction to Page 3, Paragraph 4 "five day time limit" should be five "minute" time limit. Pionek seconded, carried. Meeting - 9/16/96. Salentine seconded, carried. Rasmussen moved for acceptance of the Public Utilities Committee Minutes of the 9/17/96 Plan Commission Meeting and 8/28/96 Library Board Meeting were received and placed on file. OLD BUSINESS Reso. #204-96 - Authorization to Execute Agreement for Construction deferred 9/10/96. Rasmussen moved to amend to include final draft of of a Rough Fish Barrier at the Big Muskego Lake Dam, on the floor, Agreement. Salentine seconded, carried. D'Acquisto is uncomfortable with the Agreement. The City is accepting more risks when the DNR wants to place the barrier. Mayor stated that the City will receive the benefit. Reso. #204-96, as amended, adopted 5-1 with D'Acquisto voting "no. 'I Ord. #905 - An Ordinance to Amend Chapter 12, Section 12.04 (4) (d), of the Municipal Code of the City of Muskego (Dance Halls - Classification of Licenses). Second Reading. D'Acquisto moved for adoption. Salentine seconded. Rasmussen asked about procedure for logging complaints. Mayor stated it is being reviewed. Carried 6-0. Common Council Minutes September 24, 1996 Page 2 Reso. #202-96 - Determination of Substantial Change to Original Meadow Green West OPD (Wetland Delineation). Ald. Salentine moved for 0 information to the Council. She stated that at the 9/10 meeting the reconsideration. D'Acquisto seconded. Salentine presented background Resolution was amended to include approval of SEWRPC regarding the alterations to the wetland delineation on Lots 98, 100 and 102. The DNR and Army Corps are approving agencies regarding wetlands and SEWRPC removed. D'Acquisto called for the question to reconsider. There was is a recommending agency. She is requesting the SEWRPC approval be no objection. Motion to reconsider adopted 5-1 with Patterson voting THEREFORE, BE IT RESOLVED paragraph. Suhr seconded. Carried 4 to 1 "no." Salentine moved to amend to remove SEWRPC approval in the NOW, Patterson voting "no" and Pionek abstaining. Reso. #202-96, as amended, adopted 4 to 1 Patterson voting "no" and Pionek abstaining. NEW BUSINESS Reso. #209-96 - Final Resolution Authorizing Special Charges for Proposed Assessor's Plat for Holz Subdivision Area to be Charged and Collected as Special Assessments Provided by WI Statutes §66.60 Suhr moved for adoption. Salentine seconded. Carried 6-0. Reso. #210-96 - Resolution Authorizing Increase in Special Charges for Services for Garbage and Refuse Disposal and Recycling Service Patterson moved for adoption. Pionek seconded. Rasmussen stated that because of the citizens' recycling efforts, that portion of the charge did not increase. Carried 6-0. Reso. #211-96 - Approval of Certified Survey Map - Schweitzer, Town of Norway. Salentine moved for approval. D'Acquisto seconded. Carried 6-0. Reso. #212-96 - Approval of Certified Survey Map - Malchine, Town of questioned configuration of lots being created. Carried 6-0. Norway. Salentine moved for adoption. D'Acquisto seconded. Rasmussen Reso. #213-96 - Award of Bid - Denoon Park Shelter. D'Acquisto moved for adoption. Patterson seconded. Carried 6-0. Reso. #214-96 - Award of Bid - Big Muskego Lake Hydraulic Dredging of Canal for Public Boat Access. Suhr moved for adoption. D'Acquisto seconded. Suhr moved to amend to delete the word "hydraulic" where it appears and to add "contingent upon approval of the City Engineers" at the end of the NOW, THEREFORE, BE IT RESOLVED and to add "and approval of City Engineers and City Attorney" following ". . . subject to review by the Finance Committee," in the last paragraph. D'Acquisto seconded, carried. Reso. #214-96, as amended, adopted 6-0. Reso. #215-96 - Acceptance of Quote for Cleaning Services for 1997. Suhr moved for adoption. D'Acquisto seconded. Carried 6-0. Reso. #216-96 - Rejection of Davis' Offer to Sell Property in Industrial Park Addition to the City of Muskego. Suhr moved for adoption. Rasmussen seconded. Carried 6-0. Reso. #217-96 - Resolution to Establish Regulatory Markers Requiring Slow, No-Wake Speed (Little Muskego Lake). Removed from agenda. Rasmussen seconded. Carried 6-0. Reso. #219-96 - Amended and Revised Final Resolution Authorizing Against Benefited Property (Woods Road Country Brook to Senior Center Installation of Sewer Improvements and Levying Special Assessments Sewer Project). Rasmussen moved for adoption. Salentine seconded. Carried 6-0. Reso. #220-96 - Amended and Revised Final Resolution Authorozing Installation of Water Improvements and Levying Special Assessments Against Benefited Property (Woods Road/Racine Avenue Water Project) Salentine moved for adoption. Reso. #224-96 - Authorization to Execute Contract between the City of Muskego and Triad Engineering for Muskego Creek and Muskego Canal Project. D'Acquisto moved for adoption. Suhr seconded. D'Acquisto moved to amend to include "and technical changes as requested by the Finance Committee and Mayor in consultation with the City Attorney" at the end of the NOW, THEREFORE, BE IT RESOLVED. Ord. #906 - An Ordinance to Amend Chapter 9, Section 9.001(1) of the Municipal Code of the City of Muskego (State Laws Prohibiting Certain Offenses Adopted). First Reading LICENSES D'Acquisto moved for approval of Operators' Licenses for Scott Belongia, Roulette Jaeger, Kathy Hermanson, and Charity Quast. Suhr seconded, carried. D'Acquisto moved for approval of Transfer of "Class B" Liquor/Beer License for LAAM, Inc. (Leah's Pizza) to different location in Lincoln Point Shopping Center. Suhr seconded. Carried 6-0. VOUCHER APPROVAL D'Acauisto moved for approval of General Vouchers in the amount of Checks. D'Acquisto moved for approval of Utility Vouchers in the $578,-949.28. Salentine-seconded. Carried 6-0. There were no Tax amount of $139,050.26. Rasmussen seconded. Carried 6-0. CITY OFFICIALS' REPORTS Clerk-Treasurer stated a public hearing will be held on 10/22 at 7:20 Common Council Minutes September 24, 1996 Page 4 to consider petition of Boehm Construction to amend the OPD of Meadow Green West No. 2 regarding wetland delineation and a public hearing will be held on 10/22 at 1:25 to consider petition of Gregory Boehm Estates to amend the OPD of Meadow Green to permit duplex and single family lots following a land division being done. COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW Mayor stated he needs input from aldermen re the Compensation and Classification Study if the COW is to meet on 9/30. -Mayor reminded the Council of the Special Council meeting on 9/26 at 6:50. Patterson read effect on service. letter from Warner Cable regarding sun outages and their possible Mayor stated it was not necessary to convene into Closed Session as there was nothing new to report.
