ccm19960910COMMON COUNCIL - CITY OF MUSKEGO MINUTES OF MEETING HELD SEPTEMBER 10, 1996 The meeting was called to order at 7:45 P.M. by Mayor De Angelis. Also present were Aldermen D'Acquisto, Patterson, Pionek, Rasmussen, Salentine, Sanders and Suhr, City Atty. Molter, Plan Director Sadowski and Secretary Cathie Anderson. The Secretary reported that the meeting was noticed in accordance with the Open Meeting Law on 9/6/96. D'Acquisto moved for approval of minutes of 8/27/96 and 9/4/96 meetings. Suhr seconded, carried. The Secretary read the Notice of Closed Session. COM"1CATIONS FROM THE MAYOR'S OFFICE - Nothing to report. Reso. #208-96 - Resolution as to Protest Petitions. D'Acquisto moved to table. Salentine seconded. Carried 7-0. Ord. #904 - An Ordinance to Amend the Zoning Map of the City of Muskego from RSE and RS-1 to I-l/OA (Muskego Business Park). Deferred 8/27/96. Suhr moved to withdraw. D'Acquisto seconded, carried 7-0. PERSONAL APPEARANCE - Mr. Jeff Christensen, Mid-America Investments, of Parkland Mall and would appreciate any feedback from the Council appeared to advise that his company has started to secure ownership and/or citizens. Mr. Christensen would not reveal financial or ownership information. COMMITTEE REPORTS - D'Acquisto moved for acceptance of minutes of the 9/4/96 and 9/10/96 Finance Committee meetings. Suhr seconded, carried. D'Acquisto moved for acceptance of minutes of the 8/22/96, as corrected, Public Works Committee meeting. Pionek seconded, carried was held on proposed Committee Request Action Form. 5-2 with Patterson and Sanders casting dissenting votes. Discussion Patterson moved for acceptance of minutes of the 8/29/96, as corrected, Public Services Committee meeting. Suhr seconded, carried. Minutes of the 9/3/96 Plan Commission meeting and 8/12/96 Parks & Recreation Board meeting, and 8/25/96 Library Board meeting were received and placed on file. Ord. #902 - An Ordinance to Amend the Zoning Map of the City of Muskego from A to 1-2 (Superior Emerald Park Landfills, Inc.). Deferred 8/27/96. D'Acquisto moved to table, at the request of the petitioner. Rasmussen seconded, carried 7-0. Ord. #903 - An Ordinance to Amend Chapter 28, Section 28.04 (l)(d) of the Municipal Code of the City of Muskego (Multi-Unit Metering). Second Reading. Sanders moved for adoption. Salentine seconded. D'Acquisto moved for adoption. Pionek seconded. D'Acquisto moved to amend to add "subject to approval of contract containing terms and conditions acceptable to both parties". Pionek seconded, carried. Reso. #198-96, as amended, adopted 7-0. Reso. #199-96 - Approval of Temporary Habitation of Trailer (Knudsen). Patterson moved for adoption. Rasmussen seconded. Carried 7-0. Reso. #200-96 - Approval of Certified Survey Map - Malchine, Town of Norway. Salentine moved for adoption. Suhr seconded. Carried 7-0. Meadow Green OPD (Lot 1 - Boehm). Salentine moved for adoption. Reso. #201-96 - Determination of Nonsubstantial Change to Original Pionek seconded. Salentine requested privilege of the floor for Pam Boehm. No objection with a five minute limit. D'Acquisto moved to THEREFORE, BE IT RESOLVED, to read"....and a duplex lot does amend to delete "non" from title of resolution and to amend the NOW, constitute a substantial alteration of the original plan, and a public hearing is necessary, and it is the petitioner's responsibility to petition this change". Pionek seconded. Carried 6-1 with Ald. Salentine casting the dissenting vote. Reso. #201-96, as amended, adopted 6-1, with Ald. Salentine casting the dissenting vote. Meadow Green West OPD (Wetland Delineation). Salentine moved for Reso. #202-96 - Determination of Substantial Change to Original adoption. D'Acquisto seconded. Salentine requested privilege of the floor for Pam Boehm. Patterson objected. Salentine requested privilege of the floor for Mr. Campbell. No objection. Mr. Campbell showed communication received from his engineer and the Army Corps of THEREFORE, BE IT RESOLVED, "subject to receipt Of approval from Engineers. Rasmussen moved to amend to add to the end of the NOW, SEWRPC and the DNR". D'Acquisto seconded, carried 5-1 with Salentine casting dissenting vote. Pionek requested to abstain due to conflict of interest; there was no objection. Reso. #202-96, as amended, adopted with 6 in favor and one abstention. Reso. #203-96 - Resolution to Place Advisory Referendum on November Ballot. Suhr moved for adoption. Pionek seconded. Council discussed various options. Pionek moved to adopt the following question, "Should the City of Muskego consider relocating and expanding the Public Library at Parkland Mall". D'Acquisto called defeated 4-3 with D'Acquisto, Pionek, Salentine and Sanders voting for the question on the motion. Two-thirds vote required. Motion change his amendment to read, "Should the City of Muskego consider "yes" and Patterson, Rasmussen and Suhr voting "no". Pionek moved to relocating and expanding the City's Public Library at a renovated amended, Carried 7-0. Parkland Mall?" Salentine seconded, Carried 7-0. Reso. #205-96 - Authorization to Execute Professional Services Pionek seconded. D'Acquisto moved to amend to add to end of NOW, THEREFORE BE IT RESOLVED, "and the approval of contract language by amended, Carried 7-0. the City Attorney". Pionek seconded, carried. Reso. #205-96, as Withdrawal of Money. Salentine moved for adoption. Rasmussen Reso. #206-96 - Designating Public Depository and Authorizing seconded. Carried 7-0. Reso. #207-96 - Offer to Purchase (Ritzman) - North Cape Sewer Carried 7-0. Project Easement. Rasmussen moved for adoption. Sanders seconded. Ord. #905 - An Ordinance to Amend Chapter 12, Section 12.04 (4) (d), of the Municipal Code of the City of Muskego (Dance Halls - Classification of Licenses). First Reading. Rasmussen requested report from Chief Johnson as to how log has been revised to pickup all violation notifications. LICENSES D'Acauisto moved for a~proval of Operator's License for Donna L. Ball;. D'Acquisto moved for approval of Tax Checks in the amount of Sanders moved for approval of Utility Vouchers in the amount of $1,132.00. Suhr seconded. Carried 7-0. $590,512.34. Rasmussen seconded. Carried 7-0. COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW Mayor reminded Council that he needs auestions for D. M. Griffith & Associates prior to the scheduled Closed Session at the Committee Of The Whole Meeting on 9/30/96. As there was nothing new to discuss on the The Villages of Muskego Lakes Partnership sewer assessment appeal, the Council did not go into Closed Session No. 1. D'Acquisto moved to convene into Closed Session No. 2 pursuant to §19.85(l)(c) Considering employment, promotion, compensation or performance evaluation data of any public employe over which the governmental body has jurisdiction or exercises responsibility, more specifically 1996 labor negotiation strategies.
