ccm19960723COMMON COUNCIL - CITY OF MUSKEGO MINUTES OF MEETING HELD JULY 23, 1996 The meeting was called to order at 7:30 P.M. by Mayor De Angelis. Also present were Aldermen D'Acquisto, Patterson, Pionek, Rasmussen, Salentine, Sanders and Suhr, City Atty. Molter and Clerk-Treasurer Marenda. Marenda reported meeting was noticed in accordance with Open Meeting Law. D'Acquisto moved for approval of minutes of meetings held 7/9/96 and 7/11/96. Suhr seconded, carried. Mayor announced Closed Session No. 1 relating to Grievances would not be held upon request of union to hold in abeyance to attempt agreement through mediation. Marenda read the Notices of Closed Sessions No. 2, 3 and 4. D'Acquisto moved to convene in Closed Session No. 2 pursuant governmental body who is rendering oral or written advice to §19.85(1)(9) Conferring with legal counsel for the concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to become involved, more specifically as to Candlewood Creek Development. Salentine seconded, carried 7-0. Council reconvened in Open Session. Reso. #152-96 Amended - Approval of Preliminary Plat - Candlewood Creek. Defeated 7/9/96. D'AcauiStO moved for reconsideration. Pionek seconded, carried 7-0. Upon roll call vote, Resolution #152-96 Amended was adopted 7-0. PERSONAL APPEARANCE Citv Auditor Don Vilione of Conlev McDonald Dresented the 1995 " Audit Reports and summary graphs advising a clean opinion had been issued, the accounting policies of the City are standard for the industry and the City is in strong financial condition. D'Acquisto moved to convene in Closed Session No. 3 pursuant to §19.85(l)(e) Deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or acquisition of Industrial Park Property. Sanders seconded, bargaining reasons require a closed session, more specifically carried 7-0. Council reconvened in Open Session. Reso. #163-96 - Approval of Certified Survey Map - Habermeyer. Salentine moved for adoption. D'Acquisto seconded, carried 7-0. Muskego from RS-1 and EA to RS-1 and EA to EA. D'Acquisto moved for adoption. Sanders seconded, carried 7-0. OLD BUSINESS Code of the City of Muskeqo to Create Section 18.27 (Wetlands), Ord. #093 An Ordinance to Amend Chapter 18 of the Municipal deferred 7/9/96-AND Ord. #873 - An Ordinance to Amend Chapter 17, Section 17:3.04(4)C of the Zoning Ordinance of the City of Muskego 7/9/96. D'Acquisto moved to defer until Planning Director has (Determination of Boundaries/OLS Lakeshore District), deferred completed review. Suhr seconded, carried. Muskego from EA to A (Campbell). Second Reading. Suhr moved Ord. #895 - An Ordinance to Amend the Zoning Map of the City of for adoption. Salentine seconded, carried 7-0. Ord. #097 - An Ordinance to Amend the Zoning Map of the City of Muskego (Loomis Road, Loomis Drive, North Cape Road and Hwy. 45). Second Reading. Salentine moved for adoption. Rasmussen Am. B and C. Exhibit C is the result of the public hearing seconded. Planning Director Sadowski reviewed Exhibits A, 8, comments and the request of the Council. Changing the proposed E-4 to RSE takes care of the concern for non-conforming uses. Molter expressed concern about change from public hearing notice. Patterson moved for acceptance of minutes of 7/11/96 Public NEW BUSINESS (cont'd) Reso. #159-96 - Establishing Traffic Regulations (No Parking and No Parkina With Trailer Sians - Lake Accesses). Salentine moved for adoption. D' Acquisto seconded. D' Acquisto advised he is working with City Atty. on alternative. Salentine requested temporary signs meanwhile. Pionek felt launch fee close the sites. Mayor stated he will review with DNR before should be established at the same time the signs are posted, or cardboard-type and less expensive. Patterson moved to amend to next Park Board meeting. Temporary signs would be add "Temporary" before "No Parking" and "No Parking with Trailers". D'Acquisto seconded, carried. Reso. #167-96 - Final Resolution Authorizing Installation of Sewer Improvements and Levying of Special Assessments Against Benefited Property (Loomis Road/Drive Sewer Project MSS 1A-96; reflected as 1997 since sewer will not be operational in 1996. seconded. CITY OFFICIALS' REPORTS Marenda announced petition received from Superior Emerald Park Landfill to rezone-portion of their property from A to 1-2, with public hearing scheduled for Aug. 13th at 7:25 P.M. Marenda asked for date to hold hearing to amend WCA District. August 27th preferred by Council. Marenda requested 1996 Budget Binders be returned for submittal of 1997 Budgets; and requested Aug. and Sept. calendar drafts be reviewed. COMMUNICATIONS AND MISCELLANEOUS BUSINESS Committee of the Whole meetinq date of Auqust 19th set to meet ~ - with CDBG representative only. Cellular Antenna Information Hearing to be held August 13th at 7:15 E".
