MINUTES OF THE MEETING HELD MAY 14, 1996
The meeting was called to order at 10:06 P.M. by Mayor De Angelis.
Also present were Aldermen D'Acquisto, Patterson, Pionek, Rasmussen,
Salentine, Suhr, Clerk-Treasurer Marenda, City Attorney Molter, and
Deputy Clerk Blenski. Alderman Sanders was not present.
Open Meetings Law on 5/10/96.
The Clerk reported that the meeting was noticed in accordance with the
D'Acquisto moved for approval of minutes of the 4/23/96 Common Council
meeting. Suhr seconded, carried.
The Clerk read the Notice of Closed Session.
COMMUNICATIONS FROM THE MAYOR'S OFFICE
Mayor read Proclamation declaring May 17 and 18 as American Legion
Poppy Days. Mayor stated that he appointed Terry O'Neil as Chairman
position of Finance Director will be presented to the Council at the
to the Board of Appeals. It is anticipated that a candidate for the
5/28 meeting. Mayor should receive the final details regarding the
sale of Parkland Mall in the near future.
Reso. #105-96 - Approval of City of Muskego/Fountainwood Pool Facility
Agreement. Patterson moved for adoption. Suhr seconded. D'Acquisto
moved to amend the Agreement to add language to Paragraph D. Insurance
to include that each party name the other as an insured on the
respective policies and that minimum amounts of insurance be stated.
Patterson seconded, carried. Reso. #105-96, as amended, carried 6-0.
Reso. #111-96 - Appointment of Citizen Members to Library Board.

(Stewart, Schwalbach, Miller). Suhr moved for adoption. Rasmussen
Ord. #E93 - An Ordinance to Amend Chapter 18 of the Municipal Code
of the City of Muskego to Create Section 18.27 (Wetlands). First
Reading. Several Council members requested Mr. Sadowski research this
wetland impact fees, payments made for wetlands, etc. D'Acquisto
subject and provide information from other communities that have
requested possible alternatives be explored as well; he would like to
see situations handled on a case by case basis. Suhr requested DNR
input on what the additional 40' would accomplish.

Muskego (Woods Road). Introduced 3/26/96. Salentine moved for
adoption. Rasmussen seconded. Carried 6-0.

Reso. #104-96 - Resolution Establishing Salary for Parks Ranger.

Reso. #106-96 - Approval of Certified Survey Map - Dukleth, Town of
Norway. Salentine moved for adoption. D'Acquisto seconded. Carried

Reso. #107-96 - Approval of Certified Survey Map - Switalski, Town
of Norway. Salentine moved for adoption. Rasmussen seconded.
Carried 6-0.
Reso. #108-96 - Approval of Certified Survey Map - Summit Healthcare
Group, LLC. Removed from the agenda.
Reso. #109-96 - Approval of Agreement between the City o,f Muskego
and Ralph E. Evans, P.E. dba Evans Associates (Consulting Services -
Cellular Facilities). Salentine moved for adoption. D'Acquisto
seconded. Suhr moved to amend the last sentence of the fourth
execution of this letter agreement, Sprint Spectrum L.P. and PCS paragraph of Letter of Intent (dated May 6, 1996) to read "Upon
PrimeCo have the right to conduct suitability tests upon twenty four
(24) hours notice to Municipality at any proposed municipal site for
placement of communication equipment." Pionek seconded, carried.
Reso. #log-96, as amended, carried 6-0.
Reso. #110-96 - Amended Preliminary Resolution Declaring Intent to
Exercise Special Assessment Police Powers Under 566.60 WI Statutes
as to Sanitary Sewer Assessment Area for Hillendale/Mill Valley/Tans
moved for adoption. Salentine seconded. Carried 6-0.

LICENSES
D'Acquisto moved for approval of Operators' Licenses for Jim Bucholtz,
Christine Satterstrom, Patricia Maier, Leah Cirillo and Trina Spence.
Suhr seconded, carried.
D'Acquisto moved for denial of Class "A" Dance Hall License for
Donna Morris (Changes Pub & Grill). Patterson seconded. Carried 6-0.
Reasons stated for denial were safety, noise, parking, and capacity
concerns. It was further stated that the applicant may apply on single
event basis with Finance Committee review.
VOUCHER APPROVAL
D'Acquisto moved for Approval of General Vouchers in the amount of
$947,787.88. Suhr seconded. Carried 6-0.
D'Acquisto moved for Approval of Tax Checks in the amount of
$1,404,756.56. Suhr seconded. Carried 6-0.
D'Acquisto moved for Approval of Utility Vouchers in the amount of
$2,381,859.88. Rasmussen seconded. Carried 6-0.

Clerk stated the next Committee of the Whole meetinq would be held on

Discussion took place regarding maintenance of the City's playing
fields. Patterson initiated discussion reqardinq havinq a cable
operator present to broadcast Council and Plan meetings-in their
entirety.
CLOSED SESSION
D'Acquisto moved to convene into Closed Session, pursuant to
-§19.85(1)(c) Considering employment, promotion, compensation or
performance evaluation data of any public employe over which the
governmental body has jurisdiction or exercises responsibility, more
specifically 1996 labor negotiation strategies, and
