ccm19960423COMMON COUNCIL - CITY OF MUSKEGO MINUTES OF THE MEETING HELD APRIL 23, 1996 The meeting was called to order at 8:lO P.M. by Mayor De Angelis. A150 present were Aldermen D'Acquisto, Patterson, Pionek, Rasmussen, Salentine, Sanders, Suhr, City Clerk Marenda, City Attorney Molter, and Deputy Clerk Blenski. The Clerk reported that the meeting was noticed in accordance with the Open Meetings Law on 4/19/96. D'Acquisto moved for approval of minutes of the 4/9/96 and 4/16/96 Common Council meetings. Suhr seconded, carried. The Clerk read the Notice of Closed Session. COElMUNICATIONS FROM THE MAYOR'S OFFICE Mavor read Proclamation declarina Mav as Green-UD Muskeao month. An-effort to clean up the bike &ails has been o;ganizei. Anyone interested should meet at 9:00 AM at City Hall on Sat., 4/27. MMSD will sign the addendum to the agreement this week. Mayor announced his Committee appointments. Reso. #90-96 - Approval of Certified Survey Map - Krzman. Salentine moved for adoption. Sanders seconded. Carried 7-0. Reso. #?E-96 - Acceptance of Proposal for Scope of Services for deferred 4/9/96. Motion to adopt carried 7-0. Stormwater Management Plans, Guide and Ordinance. On the floor, Credit for Muskego Regency. Sanders moved for adoption. Rasmussen Reso. #87-96 - Approval of Developer's Agreement and Letter of seconded. Patterson moved to amend the Developer's Agreement to add paragraph of Section I1 and to add "BE IT FURTHER RESOLVED that "if requested by the City" following the word "credit" to the second approval of this Resolution is subject to receipt by the City of a Quit Claim Deed as to the Woods Road project, On-Site Water and Storm Sewer Easements free of all superior encumbrances and title evidence as to same and Conditional Use documents and that all of said documentation is satisfactory to the Mayor" to the Resolution. Ord. #E92 - An Ordinance to Amend the Zoning Map of the City of Muskego RS-2 and RS-3 to RSM/OPD/OIP National Regency of New Berlin, Inc. Conditional Rezoning and Declaration of Restrictions. First drainage concerns. Sanders moved to suspend rules to allow second Reading. Discussion took place regarding soil erosion measures and Mayor responded that the developer has requested due to the project reading. Rasmussen seconded. Patterson asked what the urgency was. move the development forward. Motion carried 6-1 with Patterson being behind schedule. Sanders and Rasmussen expressed the need to voting "no." Second Reading. Sanders moved for adoption. Salentine seconded. D'Acquisto moved to amend Paragraph G to add the following "but in any event, prior to or simultaneously with the commencement of any land disturbing activities upon the land subject to this until it is verified by the City that substantial completion of all ordinance; however, no above grade construction Shall be permitted retention facilities and down stream off-site storm drainage the City's satisfaction." Sanders seconded, carried. Ord. #892, as facilities (excluding on-site conveyance facilities) is achieved to amended, adopted 7-0. Ordinance the Municipal Code of the City of Muskego Floodplain Zoning - An Ordinance to Amend Chapter 14, to Add Section 1.5 : Official Map (Candlewood Creek). On the floor, deferred 4/9/96. Salentine moved to defer until such time as the petitioner petitioner provide information timely so it can be reviewed prior to requests this item be placed on the agenda. CITY OFFICIALS' REPORTS Clerk announced that a Public Hearing will be held on May 14 at 7:20 P.M. to consider petition of the Common Council to amend Chapter 18 to create Section 18.27 regarding Wetlands. COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW Mayor stated that the Committee of the Whole will review future committee meeting dates at their May meeting. CLOSED SESSION D'Acauisto moved to convene into Closed Session, Dursuant to §19.85( 1) (c) Considering employment, promotion, compensation or performance evaluation data of any public employe over which the governmental body has jurisdiction or exercises responsibility, more specifically 1996 labor negotiation strategies, and §19.85(l)(e) Deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session, more specifically acquisition of Industrial .& Common Council Minutes April 23, 1996 Page 4 Park Property.
