ccm19960409COMMON COUNCIL - CITY OF MUSKEGO MINUTES OF THE MEETING HELD APRIL 9, 1996 The meeting was called to order at 8:05 P.M. by Mayor De Angelis. Also present were Aldermen D'Acquisto, Misko, Patterson, Rasmussen, Salentine, Sanders, Suhr, City Clerk Marenda, City Attorney Molter, and @ Deputy Clerk Blenski. The Clerk reported that the meeting was noticed in accordance with the Open Meetings Law on 4/5/96. D'Acquisto moved for approval of minutes of the 3/26/96 Common Council meeting. Patterson seconded, carried. The Clerk read the Notice of Closed Session. COMMUNICATIONS FROM THE MAYOR'S OFFICE Mayor stated that the sale of the Parkland Mall property should be finalized within 30 to 60 days. Mayor announced he has appointed Ald. D'Acquisto, Ald. Suhr, Don Vilione, Dave Anderson, and Gary Schmidt (Finance Director for the City of West Allis) to serve on the Selection Committee for the hiring of a Finance Director. Reso. #80-96 - Acceptance of Organizational Assessment of Financial Service Operations. Salentine moved for adoption. Suhr seconded. Dennis Malinowski of David M. Griffith and Associates, Ltd. presented the final report regarding the reorganization. Mayor stated that by accepting this final report, the Council acknowledges that the report has been completed and it contains the general framework under which will take separate Council action. Motion carried 7-0. 0 the reorganization will take place. Suhr moved for acceptance of minutes of the 4/4/96 Public Welfare Committee Meeting. Patterson seconded, carried. Suhr moved for acceptance of minutes of the 3/28/96 Public Works Committee Meeting. D'Acquisto seconded, carried. Minutes of the 4/2/96 Plan Commission Meeting were received and placed on file. Ord. #E83 - An Ordinance to Amend Chapter 14, to Add Section 1.5 (2)(1) Ordinance: Official Map (Candlewood Creek). On the floor, deferred of the Municipal Code of the City of Muskego Floodplain Zoning 3/26/96. Suhr moved to defer. D'Acquisto seconded, carried. Reso. #78-96 - Acceptance of Proposal for Scope of Services for Stormwater Management Plans, Guide and Ordinance. On the floor, deferred 3/26/96. D'Acquisto moved to defer. Salentine seconded, carried. Common Council Minutes April 9, 1996 Page 2 Ord. #E89 - An Ordinance to Amend Chapter 21, Section 21.06(5) Sewer Utility (Metering). Second Reading. Sanders moved to adopt. Salentine seconded. D'Acquisto moved to amend (5) to make the sentence and replace with a comma and change the word "ad" following corrections: replace the period after "BOD" in the fifth to "as" in adopted 7-0. the last sentence. Sanders seconded, carried. Ord. #889, as amended, Reso. #79-96 - Approval of Certified Survey Map - Lange, Town of Norway. Misko moved for adoption. Salentine seconded. Carried 7-0. Reso. #81-96 - Authorization to Execute First Amendment to Intergovernmental Cooperative Agreement and Addendum to Milwaukee Metropolitan Sewerage District. D'Acquisto moved for Intergovernmental Cooperative Agreement between the City of Muskego and adoption. Sanders seconded. Misko expressed concerns. Motion carried 7-0. Reso. #82-96 - Award of Bid - Lannon Drive Turn Lane at Carried 7-0. Janesville Road. Misko moved for adoption. Salentine seconded. Withdrawal of City of Muskego Monies. Sanders moved for adoption. Reso. #83-96 - Designating Public Depositories and Authorizing Suhr seconded. Motion carried 6 in favor and D'Acquisto abstaining as his spouse is employed by one of the banking institutions. There were no objections to the abstention. Reso. #84-96 - Determination of Substantial Change to Original Meadow moved to amend to add, "if they wish to proceed with this request" at Green OPD. Misko moved for adoption. Patterson seconded. Sanders acknowledged that property owners have the right to petition for the end of the last paragraph. D'Acquisto seconded, carried. Misko changes. He expressed concern about the City approving changes to an OPD. D'Acquisto stated that by adoption of this resolution the Council can determine that the petition is a substantial change. Molter stated that the ordinance gives the Council the opportunity to review the matter. Reso. #84-96, as amended, adopted 7-0. Ord. #890 - An Ordinance to Amend Chapter 7, Section 7.01 of the Municipal Code of the City of Muskego (Traffic). First Reading. Ord. #E91 - An Ordinance to Amend Chapter 20, Section 20.10 (3) of the Municipal Code of the City of Muskego (Display of Waterway Markers). First Reading. LICENSES D'Acquisto moved for approval of Operators' Licenses for Richard Andrews, Sylvia Andrews, Christopher Engel, Andrea Korth, and Timothy Korth. Sanders seconded, carried. D'Acquisto moved for approval of change of agent for Class "B" Beer License for Dairyland Pizza Hut, Inc. to Catherine Thomka-Jasinski. Salentine seconded, carried. D'Acquisto moved to approve Amendment to Premise Description for "Class B" Alcohol Retailer's License of Patricia Gies-Kleinekordt (Kelsey Pub) as outlined in the 4/3/96 Finance Committee minutes.
