MINUTES OF THE MEETING HELD FEBRUARY 27, 1996
The meeting was called to ordcr at 8:19 P.M. by Mayor De
Angelis. Also present were Aldermen D'Acquisto, Misko,
Patterson, Rasmussen, Salentine, Sanders, Suhr, City Clerk
Marenda, City Attorney Molter, and Deputy Clerk Blenski.
The Clerk reported that the meeting was noticed in accordance
with the Open Meetings Law on 2/23/96.
Sanders moved for approval of minutes of the 2/13/96 Common
Council meeting. Suhr seconded, carried.
The Clerk read the Notice of Closed Session.
COMMUNICATIONS FROM THE MAYOR'S OFFICE
Mayor gave an update on AB111 Charter Townships issue. It has
municipalities and towns. Another new bill is being proposed
been sent to subcommittee to work out compromise between
giving townships the ability to do their own planning and
exclude municipalities' review rights for extraterritorial plats.
Mayor is participating in the Waukesha Cooperation Council to
explore shared services.
COMMITTEE REPORTS
D'Acquisto requested waiving reading of minutes. No objection
was voiced.
Suhr moved for acceptance of minutes of the 2/19/96 Committee
of the Whole Meeting. Salentine seconded, carried.
D'Acquisto moved for acceptance of minutes of the 2/21/96 and
paragraph 3, page 2 of 2/21 minutes regarding computer purchase
2/27/96 Finance Committee Meetings. It was requested that
be sent back to the committee for clarification of dollar
amounts and account numbers. Sanders seconded, carried.
Utilities Committee Meeting. Paragraph 3, page 3 was sent back
Sanders moved for acceptance of minutes of the 2/15/96 Public
to committee for clarification regarding total gallon discharge.
Salentine seconded, carried.
D'Acquisto moved for acceptance of minutes of the 2/22/96 Public
Works Committee Meeting. Suhr seconded, carried.
Minutes of the 2/20/96 Plan Commission Meeting, 2/6/96 Library
Board Meeting and 2/12/96 Parks & Rec Board Meeting were
received and placed on file. Misko discussed petitions to the
Misko and Sanders supported the present ordinance and requested
Plan Commission for outbuildings exceeding the 1% rule in size.
Matt Sadowski contact City Attorney for legal opinion regarding
petition to Board of Appeals for such cases. D'Acquisto asked
that the matter be placed on the Rules, Laws & Ordinance agenda
for review.
OLD BUSINESS
Ord. #883 - An Ordinance to Amend Chapter 14, to Add Section 1.5
(2)(1) of the Municipal Code of the City of Muskego Floodplain
Zoning Ordinance: Official Map (Candlewood Creek). Deferred

Ord. #E86 - An Ordinance to Amend Chapter 9, Section 9.14(2)
of the Municipal Code of the City of Muskego (Open Fires
Restricted). Second Reading. D'Acquisto moved for adoption.
Sanders seconded. Rasmussen voiced concern about health factors
and the City's control. Carried 7-0.
Reso. #44-96 - Preliminary Resolution Declaring Intent to
Exercise Special Assessment Police Powers Under S66.60 WI
Water Project (MW-21-95). Deferred 2/13/96. Salentine moved
Statutes as to Water Improvement Assessment Area for Woods Road
to amend the resolution to clarify the name of the project to
"Woods Road/Racine Avenue" and to attach revised legal
description. D'Acquisto seconded, carried. Reso. #44-96, as
amended, adopted 7-0.
PERSONAL APPEARANCES
Donald Vilione, C.P.A. presented Summary of TIF financial - - reports.
NEW BUSINESS
Dave Anderson of Ehlers & Associates appeared for Resolutions
#57-96 and #58-96.
Reso. #57-96 - A Resolution Authorizing the City of Muskego
to Borrow the Sum of $1,200,000 by Issuing General Obligation
Promissory Notes Pursuant to Section 67.12 (12) of the
Wisconsin Statutes and Authorizing the Sale of the Notes.
D'Acquisto moved for adoption. Sanders seconded. Carried 7-0.
Reso. #58-96 - A Resolution Authorizing the Issuance and Sale of
$5,900,000 Sewer System Revenue Bonds of the City of Muskego,
Waukesha County, Wisconsin, and Providing for the Payment of
the Bonds and Other Details with Respect to the Bonds. Sanders
moved for adoption. Rasmussen seconded. Carried 7-0.
Reso. #59-96 - Reduction of Reserve Capacity Special
Assessments by Reduction of Interest Rate. Sanders moved for
adoption. Salentine seconded. Suhr moved to amend to add
"subject to passage of Ord. #887." Salentine seconded, carried.
Reso. #59-96, as amended, adopted 7-0.
Misko moved for adoption. Rasmussen seconded. Carried 7-0.
Reso. #60-96 - Approval of Certified Survey Map - Buechel.
Reso. #61-96 - Rejection of Bid - Freedom Square Drainage
Project. D'Acquisto moved for adoption. Suhr seconded.
Carried 7-0.
Ord. #E87 - An Ordinance to Amend Chapter 21, Section 21.06(7)
c. 1. of the Municipal Code of the City of Muskego (Reserve
Capactiy Assessments -Installment Payments). First Reading.
D'Acquisto moved to suspend rules. Sanders seconded. Misko
Council. Reso. #59-96 was amended so rules would not have to be objected to suspending rules; it has not been practice of this
suspended. Carried 5-2 with Misko and Patterson voting "no."
Second Reading. D'Acquisto moved for adoption. Salentine
seconded. Carried 7-0.

Ord. #888 - An Ordinance to Amend Chapter 17, Sections
17.6.09(3) and 17.6.09(15) of the Zoning Ordinance of the City
of Muskego (Signs - Definitions). First Reading.
LICENSES
D'Acquisto moved for approval of Operators' Licenses for
Terrence O'Neil, Jill O'Neil, and Christopher Elsner, as well
as approval of license for Cynthia Mathison subject to 3, 6, and
9 & 12 month review. Suhr seconded, carried.
D'Acquisto moved for approval of "Class B" Alcohol Beverage
License for Chris Champagne, Inc. (C.C. and Company Sports Bar
and Grill) subject to terms and conditions outlined in 2/27
Class B Dance Hall license, deferral of action on the Class A
Finance Committee minutes, more specifically, the granting of a
Dance Hall license until license holder provides agreement
regarding parking and then will be determined on a case-by-case
basis, and periodic status review regarding the license.
Patterson seconded. Carried 7-0.
VOUCHER APPROVAL
D'Acquisto moved for approval of General Vouchers in the amount
of $525,438.11. Misko seconded. Carried 7-0.
D'Acquisto moved for approval of Tax Checks in the amount of
Sanders moved for approval of Utility Vouchers in the amount of
$5,115,442.56. Sanders seconded. Carried 7-0.
$172,934.53. Rasmussen seconded. Carried 7-0.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW
D'Acquisto stated he received correspondece from Waukesha County
indicating that the City is permitted to install additional
lighting at Racine/Janesville intersection if necessary at its
expense. Rasmussen requested clarification regarding
enforcement of Weights & Measures violations. Molter gave brief
update on Krause appeal.
D'Acquisto moved to convene into Closed Session, pursuant to
§19.85(l)(c) Considering employment, promotion, compensation or
performance evaluation data of any public employe over which the
governmental body has jurisdiction or exercises responsibility,
more specifically 1996 labor negotiation strategies, and
§19.85(l)(e) Deliberating or negotiating the purchasing of
public properties, the investing of public funds, or conducting
other specified public business, whenever competitive or
bargaining reasons require a closed session, more specifically
negotiations with MMSD for additional capacity in the system,
and §19.85(1)(e) Deliberating or negotiating the purchasing of
public properties, the investing of public funds, or conducting
other specified public business, whenever competitive or
bargaining reasons require a closed session, more specifically
Closed Session. The Common Council will then reconvene into
acquisition of Industrial Park Property. Action may be taken in
Open Session for the purpose of adjournment. Salentine
seconded. Carried 7-0.
