ccm19951114COMMON COUNCIL - CITY OF USKEGO MINUTES OF MEETING HELD NOVEMBER 14, 1995 The meeting was called to order at 7:56 P.M. by Mayor De Angelis. Also present were Aldermen D'Acquisto, Misko, Patterson, Rasmussen, Salentine, Sanders, Suhr, City Clerk Marenda, City Attorney Molter, and Deputy Clerk Blenski. The Clerk reported that the meeting was noticed in accordance with the Open Meetings Law on 11/10. D'Acquisto moved for approval of minutes of the 10/24/95 Common Council meeting. Salentine seconded, carried. The Clerk read the Notice of Closed Session. COMMUNICATIONS FROM THE MAYOR'S OFFICE Mavor stated he attended CAMY awards where he presented Bay Lane School with their award. Mayor also reported he attended a Veterans' Day celebration on Sunday. Mayor spoke about correspondence received from Kelly Door Systems which indicates the Door Division is closing and 37 employees will be laid off. COMMITTEE REPORTS Clerk presented minutes of 11/1/95 Committee of the Whole Meeting. Salentine moved for acceptance. Misko seconded, carried. Meeting and moved for acceptance. Rasmussen seconded. Sanders presented minutes of the 11/8/95 Finance Committee regarding procedure for interviewing applicants for Operator's Patterson moved for individual consideration of paragraph Licenses (Pages 2 L 3). The committee will review further to determine the procedure to be used. Sanders seconded; motion carried. Motion to accept minutes without paragraph carried. D'Acquisto presented minutes of the 11/14/95 Finance Committee Meeting and moved for acceptance. Sanders seconded, carried. Rasmussen presented minutes of the 10/25/95 Rules, Laws L Ordinance Committee Meeting and moved for acceptance. Sanders seconded, carried. Meeting and moved for acceptance. D'Acquisto seconded, carried. Suhr presented minutes of the 10/26/95 Public Works Committee Meeting and moved for acceptance. D'Acquisto seconded, carried. Suhr presented minutes of the 11/1/95 Public Works Committee Committee Meeting and moved for acceptance. Misko seconded, Salentine presented minutes of the 11/9/95 Public Safety carried. Suhr presented minutes of the 11/9/95 Public Welfare Committee Meeting and moved for acceptance. Patterson seconded, committee could meet to clarify minutes and discuss camera carried. Salentine requested a special meeting be held so purchase. Minutes of 11/7/95 Plan Commission Meeting were received and placed on file. Reso. #213-95 - Relocation Order of the City of Muskego, Waukesha County, Wisconsin (Hillendale Drive North of Tans Project). Sanders moved for adoption. Rasmussen seconded. Carried 7-0. Reso. #214-95 - Rejection of Bid - Freedom Square Storm Carried 7-0. Sewer. D'Acquisto moved for adoption. Sanders seconded. Reso. #215-95 - Resolution as to Offers to Purchase (MSI Development). Suhr moved for adoption. Misko seconded. Carried 7-0. Mayor relinquished Chair to Council President D'Acquisto. Construction between the City of Muskego and Cole-Layer-Trumble Reso. #216-95 - Approval of Articles of Agreement for New Company, a Day & Zimmerman Company. Sanders moved for adoption. Suhr seconded. Carried 7-0. Mayor resumed Chair. Reso. #217-95 - Appropriating the Necessary Funds for the Operation of the Government and Administration of the City of Muskego for the Year 1996. Suhr moved for adoption. Salentine was included in proposed amendment to the budget, but requested seconded. Mayor noted increase in elected officials salaries Contingency not be amended, so fund would be available for the upgrade to the AS/400 if so determined by the I.S. Committee. Sanders moved to amend to include the adopted salary increases for elected officials, the reinstatement of the Parks Maintenance I position and elimination of the Parks Maintenance I11 position, the additional 2% increase in health care premiums levying a city tax rate of $4.54, and to amend Sewer Utility Special Debt Service Budget to increase the capital contribution to sewer by $1,230,000. D'Acquisto seconded. Discussion took place. D'Acquisto opposes transfering monies from landfill fund and recommends at least reducing the amount being transferred. Rasmussen supports budget as originally proposed. Mayor stated landfill fund will not be a permanent source of income. Using the funds now could create problems in the future and cause the tax rate to greatly increase. Suhr stated he voted for the transfer from the landfill fund to provide a tax break knowing it would only be for one year. Mayor stated we are still a growing community with increased demands for City services. It is unreasonable to say the tax rate can remain the same or be lowered. D'Acquisto stated that the City's tax rate is very low in comparison to other cities throughout the state. He believes City is doing the best job it can to give taxpayers the most for bond rating? Mayor stated it could have an adverse effect if their money. He asked what effect this would have on City's the City would continue to'use these funds to operate. Patterson agrees that the City cannot continue to Rasmussen stated he had no intent to decrease the tax rate again use the landfill funds continually year after year. Salentine stated you are "borrowing from Peter to pay Paul" to artificially reduce the tax rate. Sanders agrees. It is unrealistic to reduce the tax rate with a growing community. He believes if the rate were kept the same as last year, taxpayers would be satisified. D'Acquisto stated even though this was a one-time thing, he didn't like to borrow from the future to pay Rasmussen voting "no." Sanders moved to keep tax rate same as for the present. Motion to amend passed 5-2 with Misko and Fund. D'Acquisto seconded. Motion failed 4-3 with Misko, last year ($4.65) and reduce transfer of $100,000 from Landfill Patterson, Rasmussen, and Suhr voting "no" and D'Acquisto, Salentine, and Sanders voting "yes." Motion to adopt Reso. casting the "no" #217-95, as amended, passed 5-2 with D'Acquisto and Salentine votes. Reso. #218-95 - Approval of 1996 Capital Budget. Misko moved for adoption. Rasmussen seconded. Carried 6-1 with D'Acquisto voting "no. " D'Acquisto moved for adoption. Misko seconded. Carried 7-0. Reso. #219-95 - Acceptance of Quote for New Squad Cars. City of Muskego and Mediation Center of Waukesha County. Reso. #220-95 - Authorize Execution of Agreement between the aldermen expressed concern about entering into the Agreement due Sanders moved for adoption. Suhr seconded. Some of the to the number of cases (5) referred by the City to date. Mayor stated that if Agreement is not entered into, the City would be charged $50 for each case that is referred. Motion to adopt defeated 7-0. Ord. #E78 - An Ordinance to Amend Chapter 12 to Create Section lZ.Ol(5.5) of the Municipal Code of the City of Muskego (Provisional Retail License). First Reading Ord. #E79 - An Ordinance to Amend the Zoning Map of the City of Muskego in Connection with Boxhorn/Groveway/Ryan Sewer Project. First Reading Ord. #E80 - An Ordinance to Amend Chapter 10, Sections 10.06 (11) and 10.07(3) of the Municipal Code of the City of Muskego (Public Nuisances). First Reading. Ord. #E81 - An Ordinance to Repeal and Recreate Chapter 29 of the Municipal Code of the City of Muskego (Soil Erosion). First Reading LICENSE APPROVAL D'Acquisto moved to approve Operators' Licenses for the following: Jean Danko, Deanna Beck, Shannon Dunn, Sara Eerube, Christy Albert, Carrie Gaura, Lori Grabowski, Jennifer Geboy, Jodi Ristow, Pamela Pilarski, Steven Schuttel, Judith Semrad Jean Hillmer, Mary Jender, Debra Reimer, Jean Boettcher, Wendy Wirth, Dawn Hoye, Roy Mueller, and Cheryl Gerstmann. Misko seconded, carried. Common Council Minutes November 14, 1995 Page 4 D'Acquisto moved to approve a "Class B" Alcohol Retail License for Donna Morris (Changes Pub & Grill). Suhr seconded. Carried 7-0. VOUCHER APPROVAL D'Acauisto moved for approval of General Vouchers in the amount of $560,054.65. Sand& seconded. Carried 7-0. Sanders moved for approval of Utility Vouchers in the amount of $402,142. Rasmussen seconded. Carried 7-0. CITY OFFICIALS' REPORTS Clerk stated that a public hearing will be held on 12/12 at 7:25 P.M. to consider rezoning petition in Holz Drive/Hiview Drive area for a proposed sewer project. COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW The Council determined the next Committee of the Whole Meeting would be held on Monday, January 15. Alderman Rasmussen asked about the upcoming City newsletter. Mayor stated it would probably begin after the first quarter of 1996. CLOSED SESSION D'Acquisto moved to convene into Closed Session pursuant to §19.85( 1) (9) Conferring with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to specifically The Village of Muskego Lakes Partnership and litigation in which it is or is likely to become involved, more Muskego Lakes Corporation vs. City of Muskego, and §19.85(l)(e) Deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons MMSD for additional capacity in the system, and §19.85(l)(c) require a closed session, more specifically negotiations with Considering employment, promotion, compensation or performance evaluation data of any public employe over which the more specifically 1996 labor negotiation strategies, and governmental body has jurisdiction or exercises responsibility, public properties, the investing of public funds, or conducting §19.85(1)(e) Deliberating or negotiating the purchasing of bargaining reasons require a closed session, more specifically other specified public business, whenever competitive or acquisition of Industrial Park Property. Action may be taken in Closed Session. The Common Council will then reconvene into Open Session for the purpose of adjournment. Patterson seconded. Carried 7-0.
