The meeting was called to order at 7:30 P.M. by Mayor De a Marenda, City Attorney Molter, and Deputy Clerk Blenski.

The Clerk reported that the meeting was noticed in accordance
with the Open Meetings Law.
D'Acquisto moved for approval of minutes of the 9/26/95 Common
Council meeting. Salentine seconded, carried.
The Clerk read the Notice of Closed Session
COMMUNICATIONS FROM THE MAYOR'S OFFICE
Mayor read the Proclamation declaring October 21 SHARE Day.
Mayor stated that a Public Hearing will be held on Thursday,
10/12 at New Berlin City Hall from 4 to 7 PM regarding the
status of Moorland Road Extension.
Reso. #195-95 - Honoring Muskego AFS Student Tanja Rinne.
D'Acquisto moved for adoption. Sanders seconded. Carried 7-0.
Reso. #196-95 - Honoring Muskego AFS Student Fernanda Gomes de
Oliveira. Sanders moved for adoption. Suhr seconded. Carried
Mayor welcomed Tanja and Fernanda to Muskego and presented the

COMMITTEE REPORTS
D'Acauisto Presented minutes of the 9/27/95. 10/4/95, and
10/16/95 Finance Committee Meetings and moved for acceptance.
Sanders seconded. Rasmussen requested clarification at next
Finance meeting of paragraph 2, page 3 of 10/4/95 minutes
regarding funding for dredging project. Motion carried.

D'Acquisto moved to send paragraph 5, page 3 back to committee
carried. Motion to accept minutes without said paragraph
for clarification regarding City liability. Misko seconded,
carried.
Minutes of the 10/3/95 Plan Commission Meeting were received and
placed on file.
OLD BUSINESS
Ord.#074 - An Ordinance to Amend the Zoning Map of the City of
Muskego in Connection with Boxhorn/Groveway/Ryan Sewer Project
(Possible Reconsideration). Matt Sadowski stated his department

made various attempts to contact all affected property owners
for their input. Four properties owners indicated their desire
This is in conflict with the recommendation of the Plan
for RS-2 zoning as initially noted on the public hearing notice.
Commission. Other property owners stated their acceptance of
the RSE zoning. The Plan Dept. did not receive any response
from approximately five property owners. There was concern
about spot zoning and the properties where no response was
received being in the middle of other parcels. It was
determined that another public hearing should be held for all
properties that were part of the original petition and not
rezoned through Ord. #E74 indicating that the original petition
is still pending and the recommendation of the Plan Commission.
A motion to reconsider was not made. Mayor stated legal and
engineering costs for this project will probably exceed the
amount anticipated.
Ord. #876 - An Ordinance to Amend Chapter 30, Section 30.00
and to Create Section 30.14 (3.5) of the Municipal Code of the
City of Muskego (Building Code). Second Reading. Misko moved
for adoption. Sanders seconded. Carried 7-0.
Reso. #197-95 - Rejection of Bid - Meadow Green West Subdivision
Curb and Gutter Replacement. D'Acquisto moved for adoption.
Suhr seconded. Carried 7-0.
Reso. #198-95 - Support of and Authorization to Apply for
1995-1996 Wisconsin Waterways Funding Grant for Little Muskego
Lake Jewel Crest Dredging Project. D'Acquisto moved for
adoption. Misko seconded. Rasmussen stated this was contingent
on cost savings realized due to City participation being
returned to the City. Carried 7-0.
Reso. #199-95 - Approval of Certified Survey Map - Manske.
Misko moved for adoption. D'Acquisto seconded. Carried 7-0.
Reso. #ZOO-95 - Resolution as to Offer to Purchase (Bellview
Detention Pond/Satorius). Suhr moved for adoption. Salentine
seconded. Carried 7-0.
Reso. #201-95 - Resolution as to Offer to Purchase (Bellview
Detention Pond/Bauer). Suhr moved for adoption. Patterson
seconded. Carried 7-0.
Waukesha County (MSI General Development).
Reso. #202-95 - Relocation Order of the City of Muskego,
D'Acquisto moved for adoption. Sanders seconded. Carried 7-0.
Reso. #203-95 - Resolution of Necessity (Park Acquisition).
Suhr moved for adoption. Misko seconded. Carried 7-0.
Reso. #204-95 - Set Public Hearing Date (11/13/95 at 7:OO PM)
seconded. Carried 7-0.

Wollemann and Johanna Ackmann. Patterson seconded, carried.
VOUCHER APPROVAL
D'Acquisto moved for approval of General Vouchers in the amount
of $473,995.11. Salentine seconded. Carried 7-0.
Sanders moved for approval of Utility Vouchers in the amount of
$946,499.17. Rasmussen seconded. Carried 7-0.
The Clerk stated that the '96 Capital Budget and Special Revenue
Budgets will be reviewed at 10/11 Finance Committee meeting and
Committee of the Whole will meet on 10/16.
D'Acquisto moved to convene into Closed Session pursuant
