ccm19950926COMMON COUNCIL - CITY OF MUSKEGO MINUTES OF MEETING HELD SEPTEMBER 26, 1995 The meeting was called to order at 7:30 P.M. by Mayor De Angelis. Also present were Aldermen D'Acquisto, Misko, Patterson, Rasmussen, Salentine, Sanders, Suhr, City Clerk Marenda, City Attorney Molter, and Deputy Clerk Blenski. The Clerk reported that the meeting was noticed in accordance with the Open Meetings Law. D'Acquisto moved for approval of minutes of the 9/12/95 Common Council meeting. Suhr seconded, carried. The Clerk read the Notice of Closed Session COMMUNICATIONS FROM THE MAYOR'S OFFICE Mayor read the Proclamation declaring September 29 Family Peace Day. PERSONAL APPEARANCES County Supervisors Frank DeAnqelis, Donald DesMonie, and Ken Hahn presented an update on County~ issues. OLD BUSINESS Ord. #E73 - An Ordinance to Amend Chapter 17, Section 17: 3.04(4)C of the Zoning Ordinance of the City of Muskego Misko moved for adoption. D'Acquisto seconded. Mayor stated (Lakeshore District/Determination of Boundary). Second Reading. Section 17:3.04(4)B. is being reviewed in conjunction with Ordinance #873. Misko moved to defer to second reading of ordinance to amend that section as both ordinances would be tied together. Salentine seconded, carried. Ord. #E74 - An Ordinance to Amend the Zoning Map of the City of Muskego in Connection with Boxhorn/Ryan/Groveway Sewer Project. Second Reading. Misko moved for adoption. Rasmussen seconded. Matt Sadowski reviewed the present zoning and the rezoning being proposed in conjunction with the sewer project. Mr. Sadowski stated a petition was received by a property owner for RS-2 zoning. The City then proceeded to petition to rezone the entire area. The Plan Commission's recommendation was for certain parcels to be rezoned to RSE to better balance the goals of the Comprehensive Plan. The Plan Department mailed notices to those property owners who would be affected by the RSE response was not received from everyone. Rasmussen stated zoning. Nine were in favor of the change to RSE, however, a he received calls in favor of the original proposal. He would Attorney Molter recommended that the Council consider rezoning like an opportunity to further discuss with his constituents. the parcels that were not changed from the original proposal as identified in the public hearing notice. Misko does not support Commission. Mayor stated that several property owners want a split and stated his support for the recommendation of the Plan resolution to this matter. Their properties are for sale. Patterson moved to defer. Suhr seconded. Motion to defer failed 3-4 with Patterson, Rasmussen, and Suhr voting "yes" and D'Acquisto, Misko, Salentine, and Sanders voting "no." only those parcels west of Boxhorn, south of Ryan, and the 1 Sanders moved to amend Ord. #074 to amend Exhibit "A" to include acre Meinen parcel to RS-2 with the remainder of the Meinen Common Council Minutes September 26, 1995 Page 2 property to be rezoned to RSE. Salentine seconded. Motion to amend carried 5-2 with Misko and Patterson casting the "no" votes. Ord. #874, as amended, adopted 6-1 with Misko casting the "no" vote. Sanders moved to have minutes reflect that the parcels not rezoned through Ord. #E74 are deferred for a public hearing to be held in the future, or possible reconsideration of agreement. Salentine seconded. Motion carried 6-1 with Misko ordinance if remaining property owners would come to an voting "no. 'I Ord. #E75 - An Ordinance to Amend Chapter 2, Section 2.09 (1) of the Municipal Code of the City of Muskego (Committees). Second Reading. Suhr moved for adoption. Sanders seconded. D'Acquisto, Misko, and Patterson expressed concerns about combining Public Safety and Public Welfare committees due to diversity of subject matter, length of meeting, and participants waiting too long to speak. Sanders disagrees; he believes the subjects are tied together. Rasmussen stated this is an effort to reduce the number of meetings. He further stated that some items currently coming to committees could be handled by City Welfare committees on the same night. Salentine responded that staff. Patterson suggested holding Public Safety and Public was not the same as having one meeting. You have to finish one before you begin the next meeting. Misko moved to amend (l)(c) and delete police, fire, and building from that committee's to change Public Services Committee to Public Welfare Committee Ordinance Committees. Patterson seconded. Motion failed 3 to 4 subject matter and to combine Public Safety and Rules, Laws & with D'Acquisto, Misko and Patterson voting "yes" and Rasmussen, Salentine, Sanders, and Suhr voting "no." Ordinance #E75 adopted 4-3 with Rasmussen, Salentine, Sanders, and Suhr voting noted that the ordinance would not go into effect until April "yes" and D'Acquisto, Misko, and Patterson voting "no." It was 16, 1996. NEW BUSINESS Reso. #185-95 - Amended Final Assessment Resolution Authorizing Installation of Sanitary Sewer Improvements and Levying of Special Assessments Against Benefited Property (Boxhorn/Ryan/Groveway, Project MSS 1-93, Assessment District "SF"). Sanders moved for adoption. Rasmussen seconded. Carried 7-0. Reso. #186-95 - Approval of Certified Survey Map - Muskego seconded. Carried 7-0. Industrial Park. Misko moved for adoption. D'Acquisto Misko moved for adoption. D'Acquisto seconded. Carried 7-0. Reso. #187-95 - Disapproval of Certified Survey Map - Manske. Muskego and Muskego/Norway School District - Liaison Officer Reso. #188-95 - Approval of 66.30 Agreement between the City of 1995-1996. Sanders moved for adoption. Patterson seconded. D'Acquisto requested that dialogue with Norway to pay a portion for this officer should be contemplated. Mayor stated that he Carried 7-0. intends to contact the Norway Town Chair about this issue. Sanders seconded. Carried 7-0. adoption. Salentine seconded. Carried 7-0. Reso. #190-95 - Establish Traffic Regulations. Misko moved for Reso. #191-95 - Designating Halloween Trick or Treat Hours. Salentine seconded. Carried 7-0. (10/29 2:OO PM - 4:OO PM). Patterson moved for adoption. Main. Sanders moved for adoption. Rasmussen seconded. Carried Reso. #192-95 - Award of Bid - Racine Avenue and City Hall Water 7-0. Reso. #193-95 - A Resolution Amending City Policy for Depositing and Reinvesting City Funds. D'Acquisto moved for adoption. Suhr seconded. D'Acquisto moved to amend to add "but not Sanders seconded, carried. Reso. #193-95, as amended, adopted limited to" in Section 11. D. regarding prohibited investments. 7-0. Reso. #194-95 - Authorize the Expenditure of Funds (Utility D'Acquisto expressed reservations about the software selection Billing). Sanders moved for adoption. Salentine seconded. and cost of annual maintenance agreement. He opposes being limited to selecting this vendor based on previous purchases the City has made. He would like to see alternatives. Sanders expressed support for the purchase. He stated research was done. The staff needs new software to perform their duties. He stated HTE software was being utilized in other departments. This purchase would build on what the City presently has. Rasmussen has concerns because the purchase of this software would commit the City long-term. D'Acquisto would like the City's direction to ,be reviewed. Salentine stated the City did that and made a choice several years ago. This is a step to continue in that direction. Misko called for the question. Sanders objected. Carried 6 in favor, with Sanders voting "no." Reso. #194-95 defeated 5-2 with Salentine and Sanders voting How does she proceed? Patterson stated IS director should be "yes." Clerk stated that a utility billing software is needed. given direction. Rasmussen supports research of other communities. Someone with expertise could be consulted. Mayor Council with a proposal. stated he will discuss with IS director and return to the Ord. #E76 - An Ordinance to Amend Chapter 30, Section 30.00 and to Create Section 30.14 (3.5) of the Municipal Code of the City of Muskego (Building Code). First Reading Attorney Molter was dismissed at 11:06 P.M. COMMITTEE REPORTS Misko requested suspension of the reading of the minutes. There was no objection. D'Acquisto moved for acceptance of minutes of the 9/13/95, 9/20/95 and 9/26/95 Finance Committee Meetings. Patterson seconded, carried. Suhr moved for acceptance of minutes of the 9/14/95 Public Welfare Committee Meeting. Patterson seconded, carried. Sanders moved for acceptance of minutes of the 9/21/95 Public Utilities Committee Meeting. Rasmussen seconded, seconded. Minutes of the 9/19/95 Plan Commission Meeting, the 9/11/95 and 9/14/95 Parks & Recreation Board Meetings and the 9/5/95 Library Board Meeting were received and placed on file. LICENSE APPROVAL D'Acquisto moved for approval of Operators Licenses for Jean Theresa Stegal, and Kim Zaeske. Patterson seconded, carried. Rouselatos, Steven Peterson, Brandi Goings, Paul Stankevich, D'Acquisto moved for approval of General Vouchers in the amount of $1,375,875.78. Patterson seconded. Carried 7-0. There were no tax vouchers. Sanders moved for approval of Utility Vouchers in the amount of $243,409.29. Rasmussen seconded. Carried 7-0. COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW Suhr Draised two Citv of Muskeao Police Officers for their . - assistance to several individuals out of the City. Rasmussen commended the Clerk for her efforts regarding the citywide mailing for the special election. He encouraged people to vote on 10/3. He has begun a newsletter for his district and has received positive feedback. CLOSED SESSION D'Acquisto moved to convene into Closed Session, pursuant S19.85(l)(c) Considering employment, promotion, compensation or performance evaluation data of any public employe over which the more specifically 1996 labor negotiation strategies. Action may governmental body has jurisdiction or exercises responsibility, be taken in Closed Session. Suhr seconded. Carried 7-0. The City Clerk and Deputy Clerk were dismissed.
