ccm19950627CORRECTED COMMON COUNCIL - CITY OF MUSKEGO MINUTES OF MEETING HELD JUNE 27, 1995 The meeting was called to order at 9:20 P.M. by Mayor De Angelis. Also present were Aldermen D'Acquisto, Misko, Rasmussen, Salentine, Sanders and Suhr, City Clerk Marenda, Deputy Clerk Blenski, and City Attorney Molter. Alderman Patterson was not present. Clerk reported that the meeting was noticed in accordance with the Open Meeting Law. D'Acquisto moved for approval of minutes of the 6/13/95 Common Council meeting. Salentine seconded, carried. Clerk read Notice of Closed Session. COMMUNICATIONS FROM THE MAYOR'S OFFICE Certificate of Appreciation was presented to Mr. Darl Honl for his dedicated years of service on the City's Plan Commission. Rasmussen and Salentine have agreed to work with members of the school board on a subcommittee for the proposed library building project. Mayor wished everyone a happy Fourth of July holiday. COMMITTEE REPORTS D'Acquisto requested that minutes not be read due to the late hour. Sanders moved for acceptance of minutes of the 6/19/95 and 6/22/95 Public Utilities Committee meetings. Salentine seconded, carried. Minutes of the 6/20/95 Plan Commission Meeting, 6/6/95 Library Board Meeting, and 6/12/95 Parks & Recreation Board Meeting were received and placed on file. OLD BUSINESS Muskego RS-2 to RS-2/0PD (Deer Creek). On the floor, deferred Ord. #E68 - An Ordinance to Amend the Zoning Map of the City of 6/13/95. Carried 4-3 with D'Acquisto, Salentine, and Sanders voting "yes" and Misko, Rasmussen, and Suhr voting "no" and Mayor De Angelis voting "yes" to break the tie. e Reso. #117-95 - Award of Bid - Well No. I (Muskego County Park). NEW BUSINESS Common Council Minutes June 27, 1995 Page 2 Reso. #137-95 - Approval of Final Plat, Subdivider's Agreement and Letter of Credit - Deer Creek. Sanders moved for adoption. Salentine seconded. Sanders moved to amend to add to the first BE IT FURTHER RESOLVED, "and review and approval holder of the Letter of Credit; the dollar amount inserted for of the City's Financial Consultant with regards to the mortgage the traffic lights of $20,125 in Section v. c, of the Subdivider's Agreement; Section V. C. to include that the five (5) years starts as of June 27, 1995, but if the project is in the process at the end of five (5) years, the funds will not be released; $615,199 to be inserted in Section XIV. A; and, Carried 4-3 with D'Acquisto, Salentine and Sanders voting "yes" $8,650 inserted in Section I. F. 5." Salentine seconded. and Misko, Rasmussen and Suhr voting "no" and Mayor De Angelis voting "yes" to break the tie. Reso. #137-95, as amended, and Misko, Rasmussen, and Suhr voting "no" carried 4-3 with D'Acquisto, Salentine and Sanders voting "yes" and Mayor De Angelis voting "yes" to break the tie. Muskego from RS-2/0HS to B-4/0HS (Bohrer). First Reading. Ord. #870 - An Ordinance to Amend the Zoning Map of the City of Misko requested report by next Council of similar properties. Mayor stated that Council will probably act on at 7/25 Council because this is on the 7/18 Plan Commission agenda. Reso. #141-95 - Resolution as to Offers to Purchase - Easements for Boxhorn/Groveway/Ryan Sewer Project. Sanders moved for adoption. Rasmussen seconded. Carried 6-0. Reso. #142-95 - Final Resolution Authorizing Installation of Against Benefited Property (Boxhorn/Groveway/Ryan, Project MSS Sanitary Sewer Improvements and Levying of Special Assessments Salentine seconded. Rasmussen moved to defer to complete 1-93, Assessment District "SF"). Sanders moved for adoption. and to review assessable vs. nonassessable costs of past survey of the area constituents to be affected by the project projects. Salentine seconded. D'Acquisto requested results of survey. Mayor also noted letter submitted by Mark Slocomb stating his oppostion to method of assessment. Motion to defer carried 6-0. Reso. #143-95 - Award of Bid - Boxhorn/Groveway/Ryan Sewer Project. Sanders moved for adoption. Rasmussen seconded. Rasmussen moved to defer. Sanders seconded, carried. Reso. #138-95 - Approval of Final Plat, Subdivider's Agreement and Letter of Credit - Foxboro North. D'Acquisto moved for adoption. Sanders seconded. D'Acquisto moved to amend to insert the Letter of Credit amount of $115,000 which includes 15% contingency requested by City Engineers in Section XIV. A. of the Subdivider's Agreement. Sanders seconded. Carried Rasmussen wanted to state for the record that developer would be 6-0. Reso. #138-95, as amended, carried 6-0. responsible for Duklas property driveway modifications. Sanders seconded. Carried. D'Acquisto moved for approval of Operator's License for Jill Misko moved to defer. Motion defeated for lack of second. Macioszek subject to 3, 6, 9 month review. Sanders seconded. Carried 5-1 with Misko casting the "no" vote. D'Acquisto moved for approval of Outside Dance Permit for Waylyn, Inc. (Bushy's Pub) 7/21, 7/22, 7/23 with conditions as per last year. Salentine seconded. Suhr noted for record that Motion carried. he has received calls regarding noise complaints for this event D'Acquisto moved for denial of Operator's License for Linda Kolander due to applicant's background information which Carried 6-0. indicated recent alcohol related violations. Sanders seconded. D'Acquisto moved for approval of change of agent for Dairyland Pizza Hut (Heather Stigler). Misko seconded. Carried 6-0. VOUCHER APPROVAL D'Acquisto moved for approval of General Vouchers in the amount of $433,238.39. Sanders seconded. Carried 6-0. D'Acquisto moved for approval of Tax Vouchers in the amount of $445.69. Suhr seconded. Carried 6-0. Sanders moved for approval of Utility Vouchers in the amount of $31,628.27. Rasmussen seconded. Carried 6-0. CITY OFFICIALS' REPORTS Clerk stated a Public Hearing will be held on July 11, 1995 at 7:15 P.M. to consider petition of Regency Senior Communities to Mayor stated that a Public Hearing will be held on July 11, 1995 rezone on Racine Avenue and Woods Road from RS-3 to RSM/OPD. at 7:30 regarding the Racine Avenue Water Project. The Clerk reminded the Aldermen of the Public Hearing to be held July 6 at 7:OO P.M. regarding Elected/Appointed issue. COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW D'Acquisto spoke about the fund raising efforts for Chris Povlich.
