ccm199506130 MINUTES OF MEETING HELD JUNE 13, 1995 COMMON COUNCIL - CITY OF MUSKEGO The meeting was called to order at 7:58 P.M. by Mayor De Angelis. Also present were Aldermen D'Acquisto, Misko, Patterson, Rasmussen, Salentine, Sanders and Suhr, City Clerk Marenda and City Attorney Molter. Clerk reported that the meeting was noticed in accordance with the Open Meeting Law. Clerk read Notice of Closed Session. PERSONAL APPEARANCE Chief Johnson introduced new Police Officer Michelle Jolitz, who was presented with a Certificate of Appointment by the Clerk. Misko requested information in writing from developer on money they will set aside for controlled intersections. Mayor advised that will be a part of the Subdivider's Agreement. Motion carried. Salentine seconded. and Letter of Credit - Champions Villages of Country Club Agreement to insert $40,000 in first two blanks, and $20,000 in Sanders moved to amend Section I.F.5 of the Subdivider's third blank, and Section X1V.A. to insert amount of Financial Guarantee of $2,562,273.70; and to amend Letter of Credit to Misko seconded, carried. Reso. #122-95 - Resolution Indicating Opposition to AB290 by the Common Council of the City of Muskego. Salentine moved for adoption. Sanders seconded. Carried 6-1 with D'Acquisto voting "no". Reso. #123-95 - Resolution Indicating Support of LRB 3336/3 Relating to Scheduling of Referenda by Local Governments. Salentine moved for adoption. Sanders seconded. D'Acquisto spoke in opposition of offering support because it takes away the right of the municipality to schedule special elections. Misko and Suhr concurred. Motion defeated 0-7. Reso. #124-95 - Approval of Amendment to Offer to Purchase (Racine Avenue Hydrant Relocation). Sanders moved for adoption. D'Acquisto seconded, carried 7-0. Miedzybrocki. Misko moved for adoption. Rasmussen seconded. Reso. #125-95 - Approval of Certified Survey Map - Misko moved to amend to add "Be it further resolved that approval is subject to receipt of a Cross Access Agreement. Sanders seconded, carried. Resolution #125-95 As Amended 0 Motion carried 4-3 with Misko, Patterson, Sanders and Suhr 0 adopted 7-0. D'Acquisto moved for approval of Operators' Licenses for Gerry Jacques, Donna Jankowski, Jill Kulas and Donna Lipofski. Misko seconded, carried. D'Acquisto moved for approval of payment of General Vouchers in amount of $300,389.86. Sanders seconded, carried 7-0. D'Acquisto moved for approval of payment of Tax Vouchers in amount of $1,075.52. Sanders seconded, carried 7-0. Sanders moved for approval of payment of Utility Vouchers in amount of $973,205.00. Rasmussen seconded, carried 7-0. CITY OFFICIALS' REPORTS City Clerk announced petition received from Jerry C. Schwarten, Agent for Walter Bohrer for rezoning of property at 583 W20411 Janesville Road from RS-2/0HS to B-4/0HS to allow Truck Parking. Public Hearing to be held at 7:25 PM on 6/27/95. City Clerk reminded Council of the Special Assessment public hearings to be held on Monday, June 19, 1995 - 7:OO PM for Racine Ave. Water Project and 8:OO PM for Boxhorn/Groveway/Ryan Sewer Project. Mayor noted special Utilities Committee mtg. will be at 6:50 PM on 6/19/95. 0 Common Council Minutes June 13, 1995 Page 4 COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW Discussion held on Elected versus Amointed status and other - alternatives for the positions of Assessor, Clerk/Comptroller and Treasurer to determine a course of action. Since Treasurer not running for re-election, opportunity is now to re-evaluate our Administrative structure. Ald. Rasmussen proposed to yrs. Change City Clerk/Comptroller position to combined City continue to Elect Assessor changing term from 2 yrs. to 3 or 4 Clerk/Treasurer, continue to Elect, changing term from 2 to 3 or 4 yrs. Hire a Finance Director to assume the Investment duties of the Treasurer and the Comptroller duties in order to place qualifications on the position. New position to be financed by eventual savings in audit fees and treasurer's Misko preferred 3 year terms. Mayor preferred 4 yr. terms to salary. Opportunities to increase revenue on investments. avoid Mayor, Clerk and Assessor all up for election at same time, since Mayor is 3 yr term. D'Acquisto felt public input is important and more alternatives explored. Salentine asked if a Referendum election could be held this fall. Clerk advised Notice of Election must be published,in October. Sanders suggested a Charter Ordinance be drafted and proceed to a Public Hearing. Patterson and D'Acquisto thought the process was moving too quickly. Rasmussen felt the Treasurer leaving is the catalyst bringing issue to forefront. First looked at alternative. Let's do what's best for the City. He expressed concern we don't have a financial professional. Mayor said we as elected officials must look out for the best interests of the electorate. There are potentials for improvement to the current system. Misko agreed with some of Rasmussen's points, but he favored having these positions elected. D'Acquisto said one alternative is to maintain the status quo, and another is to have all Appointed. Salentine noted clarification needs to be made on method of "hiring" or "appointing". A Public Hearing was scheduled for Thursday, July 6, 1995 at 7:OO PM at Muskego City Hall on Elected/Appointed or combination thereof and terms of office for Assessor, Treasurer and City Clerk/Comptroller. Public Utilities Committee meeting for that evening was cancelled. CLOSED SESSION D'Acquisto moved to convene into Closed Session pursuant to S/S 19.85(1)(c) Considering employment, promotion, compensation or performance evaluation data of any public employee over which the governmental body has jurisdiction or exercises strategies. Action may be taken in Closed Session. Misko 0 making these positions all Appointed.
