ccm19941122COMMON COUNCIL - CITY OF MUSKEGO MINUTES OF MEETING HELD NOVEMBER 22, 1994 The meeting was called to order at 9:25 P.M. by Mayor De Angelis. Also present were Aldermen Patterson, D'Acquisto, Dumke, Misko, Sanders, Taube and Woodard, City Clerk Marenda, City Attorney Molter and Deputy Clerk Blenski. Clerk reported that the meeting was noticed in accordance with the Open Meeting Law on November 18, 1994. Patterson moved for approval of minutes of the November 8, 1994 Common Council meeting. Sanders seconded, carried. COMMUNICATIONS PROM THE MAYOR'S OFFICE Mayor reported on the status of the Term Limits litigation and wished everyone a safe and happy holiday. Reso. #252-94 - Proceedings by the Common Council of the City of Muskego to Discontinue and Vacate a Road Right-of-way in the City of Muskego, Wisconsin (Alley/Kingston's on Muskego Subdivision No. 2). Taube moved for adoption. D'Acquisto seconded. Carried 7-0. Reso. #253-94 - Proceedings by the Common Council of the City City of Muskego, Wisconsin (Skylark Lane). Patterson moved for of Muskego to Discontinue and Vacate a Road Right-of-way in the adoption. Dumke seconded. Carried 6-1 with Taube voting "no." COMMITTEE REPORTS Patterson moved to suspend the reading of the Committee minutes. Woodard seconded, carried. Patterson moved for acceptance of minutes of the 11/16/94 and 11/22/94 Finance Committee Meetings. Dumke seconded, carried. Dumke moved for acceptance of minutes of the 11/10/94 Public Works Committee Meeting. Misko seconded, carried. Patterson moved for acceptance of minutes of the 11/14/94 D'Acquisto moved for separate consideration of Paragraph 6 on Public Welfare Committee Meeting. D'Acquisto seconded. Page 2 regarding East Troy Landfill to be sent back to Committee. Misko seconded. D'Acquisto opposes payment for privlege of participating in negotiations when the City's liability has not been proven. Patterson favors entering the agreement. He believes it will be money well spent. Sanders supported moving the matter along so that the next step could be reached. Motion carried 5 to 2 with Dumke and Sanders voting "no." Motion to accept minutes without above-referred-to paragraph carried. Sanders moved for acceptance of minutes of the 11/17/94 and 11/22/94 Public Utilities Committee Meetings. D'Acquisto seconded, carried. Minutes of the 11/1/94 Library Board Meeting, 11/14/94 Parks E, Recreation Board Meeting and 11/15/94 Plan Commission Meeting were received and placed on file. Ord. #856 - An Ordinance to Amend Chapter 17 to Create Section 5.09 and Amend Section 6.04(4)G of the City of Muskego Zoning Common Council Minutes November 22, 1994 Page 2 Ordinance (To Allow Certain Types of Manufactured Housing). Discussion took place regarding the compliance of this type Second Reading. Taube moved for adoption. Woodard seconded. of housing with the City's building codes. D'Acquisto moved defer for City Attorney review. Misko seconded, carried. to Reso. #250-94 - Offers to Purchase (Mystic Drive/Foxboro North). with Patterson voting "no. 'I Sanders moved for adoption. Carried 6-1 Against Benefitted Properties and Waiving Special Assessment Reso. #251-94 - Final Resolution Levying Special Assessments Notices and Hearings Under §66.60(18) (Mystic Drive/Foxboro North). Sanders moved for adoption. Woodard seconded. Carried 7-0. Attorney Molter was dismissed at 10:28 P.M. Reso. #244-94 - Resolution Acknowledging the Southeastern Conference Champions: Muskego High School's 1994 Football Team. Patterson moved for adoption. Taube seconded. Carried 7-0. Reso. #245-94 - Appropriating the Necessary Funds for the Muskego for the Year 1995. Sanders moved for adoption. Operation of the Government and Administration of the City of D'Acquisto seconded. D'Acquisto moved to remove $71,552 from Police Department Operating Budget for salaries and benefits for by $71,552. Misko seconded, carried. Patterson moved to place two officers with start date of 4/1/95 and increase Contingency only $35,776 (for one police officer) in Contingency. Taube seconded. Misko requested Chief Johnson be allowed to address City's chances to receive grant money. Taube agreed to allow the Council. Taube opposed. D'Acquisto asked what were the Chief to respond. Chief stated that application has been submitted; the criteria for selection is not known. He added that the addition of one officer is not sufficient. Motion failed 6-1 with Patterson casting the "yes" vote. Patterson moved to approve one Patrol Truck for Public Works instead of two. Mayor stated that was a Capital Budget item and Capital Budget. Dumke stated that much work went into the said motion would have to be made under discussion of the budget process and many cuts have been made. He believes this is a good budget. Mayor stated that a certain level of services are expected and must continue to be provided to the community. There is a zero increase in the City's 1995 proposed tax rate. Taube moved to amend the Information Systems budget to remove $160 for Wall Street Journal and Muskego Sun. Patterson seconded. Motion failed 6 to 1 with Taube casting the "yes" vote. Misko moved to amend Health and Sanitation to include an additional $1,000 as recommended by the Finance Committee for supplies, postage, etc. D'Acquisto seconded, carried. Misko moved to increase Revenue Acct. #100.0041.0727 by $14,000 Expenditure Acct. #100.2000.3910 by $15,750 due to increased for D.A.R.E. reimbursement from Waukesha County and increase Common Council Minutes November 22, 1994 with Taube voting "no. Page 3 Carried 6 to 1 D'Acquisto moved to amend the Tax Increment District Fund Special Revenue Fund Budget to include the use of $240,725 as a transfer to Capital Outlay. Woodard seconded. Carried 5-2 with Taube and Patterson voting "no. D'Acquisto moved to increase Priority Lakes Grant Fund revenues to $146,000, expenditures to $196,500 and transfer to general fund to $50,500. Misko seconded. Carried 7-0. Taube moved to remove full-time maintenance position from Parks with Patterson and Taube voting "yes." Taube moved to remove .S Recreation Budget. Patterson seconded. Motion failed 5-2 new City Hall part-time maintenance position. Patterson seconded. Motion failed 6-1 with Taube voting "yes." Reso. #245-94, as amended, adopted 5-2 with Patterson and Taube voting "no. I' Reso. #246-94 - Approval of 1995 Capital Budget. Sanders moved correct "Transfer from TIF" category to be titled "Reimbursement for adoption. D'Acquisto seconded. Misko moved to amend to from TIF" and include the Unclassified (Priority Lakes Exp.) in the amount of $42,500 in the Reimbursement from TIF category amending the total from $198,225 to $240,725. Woodard seconded. Carried-5-2 with Patterson and Taube voting "no." Reso. #247-94 - Approval of 1995 Sewer Utility Budget. Sanders moved for adoption. Woodard seconded. Carried 7-0 Sewer rates to remain the same. Reso. #248-94 - Approval of 1995 Water Utility Budget. Water rates to remain the same. Sanders moved for adoption. D'Acquisto seconded. Carried 7-0. Reso. #249-94 - Approval of Final Plat, Subdivider's Agreement and Letter of Credit for Foxboro North. Sanders moved for adoption. Misko seconded. Sanders moved to defer. Misko seconded, carried. Reso. #254-94 - Approval of Certified Survey Map - Whitehouse. Taube moved for adoption. Woodard seconded, Carried 7-0. Reso. #255-94 - Approval of Dental Insurance Contracts for 1995. Patterson moved for the approval of Operators' Licenses for William Boyce, Julie Brandt, Meredith Halbrucker, Sandy Gagliano, Sharon Woods and a 60-day provisional Operator's License for Angela Freitag. Dumke seconded, carried. Patterson moved for approval of Operator's License for Kathy Rea D'Acquisto moved to defer for further review. Taube seconded, subject to 3, 6, 9 and 12 month review. Dumke seconded. carried. Patterson moved for approval of General Vouchers in t.he amount of $2,537,023.38. Dumke seconded. Carried 7-0. Sanders moved for approval of Utility Vouchers in the amount of $349,733.91. Woodard seconded. Carried 7-0. CITY OFFICIALS' REPORTS City Clerk reported that a Public Hearing will be held on 12/13/94 at 7:25 P.M. to consider a rezoning from RS-1 to RS-1/OIP for the water reservoir site.
