ccm19940809COMMON COUNCIL CITY OF MUSKEGO MINUTES OF MEETING HELD AUGUST 9, 1994 .--- The meeting was called to order at 7:34 P.M. by Mayor De Angelis. Also present were Aldermen Patterson, D'Acquisto, Dumke, Misko, Sanders, Taube, Woodard, City Clerk Marenda, Deputy Clerk Blenski and City Attorney Trindl. Patterson moved for approval of minutes of the Common Council Meeting held July 26, 1994. Dumke seconded, carried. COMMITTEE REPORTS Sanders presented minutes of Finance Committee Meetings held 8/3/94 and 8/9/94 and moved for acceptance. Patterson seconded, carried. D'Acquisto presented minutes of Public Works Committee Meeting held 7/28/94 and moved for acceptance. Misko seconded, carried with Ald. Patterson abstaining on Institutional Products Corp. paragraph due to conflict of interest. Woodard presented minutes of Rules, Laws & Ordinance Meeting held 8/4/94 and moved for acceptance. Taube seconded, carried. Woodard presented minutes of Public Safety Committee Meeting held 8/4/94 and moved for acceptance. Misko seconded, carried. r \ Minutes of Plan Commission Meeting held 8/2/94 were received and placed on file. OLD BUSINESS Reso. #146-94 - Proceedings by the Common Council of the City of Muskego to Discontinue and Vacate a Road Right-of-Way (Mercury Drive) Introduced 6/28/94. Patterson moved for adoption. Misko seconded. Patterson moved to defer. Misko seconded, carried. Ord. #846 - An Ordinance to Amend Chapter 16, Section 16.08 of the Municipal Code of the City of Muskego (Plumbing Code) Second Reading. Misko moved for adoption. Woodard seconded. Carried 7-0. Ord. #847 - An Ordinance to Amend Chapter 15, Section 15.14 of the Municipal Code of the City of Muskego (Electrical Code) Second Reading. Misko moved for adoption. Sanders seconded. Carried 7-0. Ord. #848 - An Ordinance to Amend Chapter 29, Section 29.06 of the Municipal Code of the City of Muskego (Soil Erosion) Second Reading. Misko moved for adoption. Taube seconded. Carried 7-0. Ord. #849 - An Ordinance to Amend Chapter 30, Section 30.05 of the Municipal Code of the City of Muskego (Building Code) Second Reading. Misko moved for adoption. D'Acquisto seconded. Carried 7-0. (' Ord. #850 - An Ordinance to Amend ,the Zoning Map of the City of Muskego RS-2 to RS-2/0D - Dominski Second Reading. Taube moved for adoption. D'Acquisto seconded. Patterson clarified his concerns as stated at last Council meeting. He opposes "spot zoning." Defeated 4-3 with with Patterson, Dumke, Misko, and Taube voting "no" and D'Acquisto, Sanders and Woodard voting "yes." Taube moved to amend to correct the total amount for the project from $18,600 to $23,560 and the amount for Phase II from $3,000 to $9,300. Woodard seconded, carried. Reso. *165-94, as amended, adopted 7-0. NEW BUSINESS Reso. *168-94 - Approval of Leave of Absence (Schilling). moved for adoption. Sanders seconded. Carried 7-0. Dumke Reso. *170-94 - Approval of Final Plat - Belsha Estates. Taube moved for adoption. Misko seconded. Carried 7-0. ~. I , Reso. *175-94 - Reapproval of Final Plat - Lakewood Meadows Addn. *1. Reso. *167-94 - Amendment to Final Resolution Authorizing Road Improvements and Levying Special Assessments Against Benefitted Property (Kurtze Lane Road Project MR-2-85). Sanders moved for adoption. Woodard seconded. Discussion took place. The Clerk explained what had transpired. The Council upheld the Finance Committee decision not to pay interest on money to be returned. D'Acquisto moved to amend to add to No.1, "Restrictive endorsement language to be added to check with language provided by City Attorney." Misko seconded. Carried 7-0. Reso. *167-94, as amended, adopted 7-0. r Reso. #169-94 - Acceptance of Quote for Scope of Services for Stormwater Management Plan. Patterson moved for adoption. Misko seconded. Mayor explained how the consultant was chosen. Rating sheets to be made a part of the file. Carried 7-0. Reso. *171-94 - Approval of Certified Survey Map - Wiza. Misko moved for adoption. D'Acquisto seconded. Carried 6-0 with Taube abstaining due to conflict of interest, with no objection to absention. Reso. #172-94 - Approval of Certified Survey Map - Firstar Bank. Taube moved for adoption. Sanders seconded. Carried 7-0. Reso. #173-94 - Approval of Revised Policy Regarding Hiring of Relatives. Patterson moved for adoption. Sanders seconded. Carried 7-0. Reso. *174-94 - Approval of Group Annuity Amendment No. II (Lincoln National Life Insurance Company). Item removed. Ord. *851 - An Ordinance to Amend the Zoning Map of the City of Muskego A (Agriculture) to RS-2 (Single Family Residence). First Reading. (" LICENSE APPROVAL Patterson moved for approval of Operator's Licenses for Myra Stolze subject to 3, 6 and 12 month review. Dumke seconded. Carried 7-0. Patterson moved for reconsideration as he was not clear on the previous motion. Taube seconded. Patterson stated applicant has shown a disregard of the law and he believes license Common Council Minutes August 9, 1994 Page 3 -- should not be approved. Motion to reconsider carried 7-0. Sanders stated that in listening to applicant he believes the review process Finance Committee has requested should be adequate. License approved 6-1 with Patterson casting the "no" vote. Patterson moved for approval of Temporary Operator's License for Jerome Neary. D'Acqusito seconded, carried. Patterson moved for approval of Class "A" Fermented Malt Beverage License for Clark Refining & Marketing, Inc. Taube seconded. Carried 7-0. Patterson moved for approval of Temporary Class "B"/"Class B" Retailer's License for Muskego Sports, Inc. for 8/27 and 8/28 and Muskego Corvette Club for 8/27. Taube seconded. Carried 7-0. Patterson moved for approval of Amendment to Premise Description and Outside Dance Permit for Richard Schaumberg for 8/20/94. D'Acquisto seconded. Carried 7-0. VOUCHER APPROVAL Patterson moved for approval of General Vouchers in the amount of $389,588.29. Dumke seconded. Carried 7-0. Patterson moved for approval of Tax Vouchers in the amount of $3,052.38. Dumke seconded. Carried 7-0. r-. Sanders moved for approval of utility Vouchers in the amount of $32,940.06. Woodard seconded. Carried 7-0. CITY OFFICIALS' REPORTS City Clerk Marenda stated that she is in need of poll workers for the upcoming September and November elections. If interested, please contact her at 679-5625. COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW Patterson requested Finance Committee recommendation of license review by the Committee as a condition of an Operator's License be noted on Council agendas.
