ccm19940628COMMON COUNCIL CITY OF MUSKEGO MINUTES OF MEETING HELD JUNE 28, 1994 The meeting was called to order at 7:36 P.M. by Mayor De Angelis. Also present were Aldermen D'Acquisto, Dumke, Misko, Sanders, Taube, Woodard, City Clerk Marenda, City Attorney Molter, and Deputy Clerk Blenski. Alderman Patterson arrived at 1:55 during reading of Public Utilities Committee Minutes. Sanders moved for approval of minutes of the Common Council Meeting held June 14, 1994. Dumke seconded, carried. COMMITTEE REPORTS Sanders presented minutes of Finance Committee Meetings held 6/22/94 and 6/28/94 and moved for acceptance. Dumke seconded, carried. D'Acquisto presented minutes of Public Welfare Committee Meeting held 6/15/94 and moved for acceptance. Dumke seconded, carried. D'Acquisto presented minutes of Public Utilities Committee Meeting held 6/16/94 and moved for acceptance. Sanders seconded, carried. D'Acquisto presented minutes of Public Works Committee Meeting held 6/23/94 and moved for acceptance. Dumke seconded, carried. Minutes of Library Board (6/7/94), Parks E, Recreation Board (6/13/94) and Plan Commission Meeting (6/21/94) were received and placed on file. OLD BUSINESS Ord. #043 - An Ordinance to Amend the Zoning Map of the City of Muskego from RS-l/RS-2/8-2/W to RS-3/0PD (MSI General - Janesville and Racine). Second Reading. Taube moved for adoption. D'Acquisto seconded. Taube expressed concern about approving the zoning change until all the concerns are addressed by developer. Mayor stated that the length of time for the entire site to be completed is uncertain. The City still has control with the need for the approval of the Building, Site and Operation plan. Taube moved to amend the ordinance to exclude the outlots and the department store lot. Dumke seconded. Mayor stated that petitioner approval is required to amend the ordinance. Several Council members expressed support for the rezoning. Sanders stated that too many roadblocks have been put up in developing this area. D'Acqusito requested developer be allowed to address the Council. There was no objection. The current owner, KTDT, represented by Mr. Tim Hayes addressed the Council. He stated that this property is in the process of being sold to MSI. MSI has worked very dilligently and swiftly to address the concerns of the City with regards to this development. Mr. Hayes requested who just arrived. Request granted. Mr. Dirk Debbink stated that a recess to confer with a representative of MSI, Mr. Dirk Debbink, desire to amend that petition. the petition to rezone is for the entire parcel and MSI does not He stated that this type of project is difficult to put together. Rezoning for the entire parcel is necessary. D'Acquisto stated and public concerns. Taube withdrew his motion to amend. Dumke that he has been impressed with MSI and their response to both City agreed. Ord. #043, adopted 1-0. Common Council Minutes June 28, 1994 Page 2 Municipal Code of the City of Muskego (Vicious Animals). Second Ord. #844 - An Ordinance to Amend Chapter 13, Section 13.025 of the Reading. Misko moved for adoption. Taube seconded, carried. Carried 7-0. NEW BUSINESS Muskego to Discontinue and Vacate a Right-of-way (Mercury Drive) Reso. #146-94 - Proceedings by the Common Council of the City of (Introduction Only). Public Hearing is scheduled for August 9, 1994 at 7:25 P.M. Reso. #147-94 - Approval of Amendment to "Petition for Country Club Villages, Inc. and City of Muskego. Patterson moved Improvements and Agreement Regarding Special Assessments" between Molter advised that the Amendment should not be changed because it for adoption. Sanders seconded. Mayor explained the amendment. was drafted by bond counsel, Quarles & Erady. D'Acquisto requested well as the original document. Discussion took place. Patterson to abstain due to a lack of knowledge regarding the amendment as with Sanders and Taube voting "no." Motion to adopt Reso. #147-94 moved to allow D'Acquisto to abstain. Misko seconded. Carried 4-2 carried 6-0 with D'Acquisto abstaining. Reso. #148-94 - Approval of Various License Applications for the City of Muskego for the Licensing Period July 1, 1994 to June 30, 1995. Sanders moved for adoption. Patterson seconded. Patterson moved to amend the second WHEREAS to add "with the Misko seconded. Carried 7-0. Misko moved to add "Footnote (4)" to the attached list to read, "License granted subject to approval of Building, Site and Operation Plan by the Plan Commission and Control of the Premise." Said footnote reference to be placed after Item 2. Art Dyer. Resolution to be further amended to note that the attached list was amended. Patterson seconded. Carried 7-0. Reso. #148-94, as amended, carried 6-1 with Misko casting the ,Vno I, Reso. #149-94 - Award of Bid - Well No. 7 Test Borings. Sanders moved for adoption. D'Acquisto seconded. Carried 7-0. Taube moved for adoption. Dumke seconded. Sanders moved to amend Reso. #150-94 -Renewal of Extractive Permit - Glockner. Department in three months." D'Acquisto seconded. Carried 7-0. to add to Paragraph 5 "subject to favorable review by the Plan Reso. #150-94, as amended, carried 7-0. Reso. #151-94 - Approval of Certified Survey Map - Mahoney. Taube moved for adoption. Sanders seconded. Carried 6-1 with Taube voting "no. I' Code of the City of Muskego to add Section 17:6.11(6) (Compliance Ord. #845 - An Ordinance to Amend Chapter 17 of the Municipal to Building, Site and Operational Plans). Bret Miller, Kathleen Rynders, Amy Mayer, and Jeannie Geddes (with review every three months for one year period). Dumke seconded, carried. Patterson moved for denial of Operator's License for Jill Maciosek while the holder of a "Class B" Liquor and Beer license and due to recommendation of Chief Johnson regarding past convictions lying about said convictions on two application forms. D'Acquisto seconded. Carried 7-0. Patterson moved for approval of Outside Dance Permit for Waylyn, outlined by the Finance Committee regarding times and description Inc. (Bushy's Pub) July 22, 23, 24, 1994 with conditions as of premise. Dumke seconded. Carried 7-0. Patterson moved for approval of Refuse License for Town h Country Waste (BFI). Misko seconded, carried. Patterson moved for approval of Salvage & Recycling Permit for James Kohne. Taube seconded. Taube noted that fencing on site is not required in reference to a report submitted from the Plan Dept. regarding this site. Motion carried. VOUCHER APPROVAL @ Patterson moved for approval of Operator's Licenses for Susan Patterson moved for approval of General Vouchers in the amount of $352,871.44. Dumke seconded. Carried 7-0. Patterson moved for approval of Tax Vouchers in the amount of $565.74. Sanders seconded. Carried 7-0. Sanders moved for approval of Utility Vouchers in the amount of $412,916.85. Woodard seconded.
