ccm19931228CITY OF MUSKEGO COMblON COUNCIL MINUTES OF MEETING HELD DECEMBER 28, 1993 The meeting was called to order at 7:50 P.M. by Mayor De Angelis. Also present were Aldermen Patterson, Dumke, Misko, Sanders, Aldermen Taube and Woodard were absent. Schneider, Deputy Clerk Blenski, and City Attorney Trindl. Patterson moved for approval of the minutes of the Common Council meeting held December 14, 1993. Schneider seconded, carried. COMMUNICATIONS FROM THE MAYOR'S OFFICE Mayor stated that Citv Hall would be oDen on 12/31 for collection Chambers would be relocated to the Muskego Room in the lower level. of-taxes. COMMITTEE REPORTS Sanders presented minutes of Finance Committee meetings held 12/22 and 12/28 and moved for acceptance. Patterson seconded, carried. Schneider presented minutes of Public Welfare Committee meeting held 12/15 and moved for acceptance. Patterson seconded, carried. Sanders presented minutes of Public Utilities Committee meeting held 12/16 and moved for acceptance. Schneider seconded, carried. Minutes of 12/21 Plan Commission meeting were received and placed on file. OLD BUSINESS Ord. #823 - An Ordinance to Amend the Zoning Map of the City of Muskego RS-2 to RS-2/0D (Steinhauer). First Reading. Mayor stated that Plan Commission did not recommend approval of the rezoning. suggested by the Plan Commission. Mayor requested permission for Schneider asked if petitioner did consider a mother-in-law unit as Mr. Yeager to respond. Permission granted. Mr. Yeager responded that this was considered, however, owner believes duplex would be a better overall investment for the future. Reso. #268-93 - Rejection of Lanke's Offer to Sell Property in Industrial Park to City of Muskego, on the floor deferred 12/14. Mayor stated attorney opinion was provided to the Council members. Resolution #268-93 adopted 4-1 with Dumke casting the only "no" vote. Ord. #E21 - An Ordinance to Amend Chapter 21 of the Municipal Code moved for adoption. Sanders seconded. Sanders moved to amend to (Residential Equivalency Charge Chart). Second Reading. Patterson change the words, "and January 1, 1994" to "and publication" in Section 5 and to add "PER BUILDING" following "1 REC MINIMUM" to Note a) of Appendix A (Residential Equivalency Charge Chart). 5-0. Schneider seconded, carried. Ordinance #821, as amended, adopted Common Council Minutes December 28, 1993 Page 2 Reso. #284-93 - Resolution as to Acceptance of Land for BML Access (Bass Bay Sportsman Assn.). Schneider moved for adoption. Dumke seconded. Carried 5-0. Reso. #285-93 - Acceptance of Big Muskego Lake Dam. Dumke moved for adoption. Schneider seconded. Discussion took place as to the assurance the City has about the structure of the earthen dam. Sanders did not want City Attorney to do title search until all conditions are met. Sanders moved to amend to add, "WHEREAS, the DNR will supply written correspondence stating that the earthen dam was built to specifications and that the dam spillway meets all current state requirements" and "BE IT FURTHER RESOLVED that the City Attorney is authorized to order the necessary title evidence subject to all of the above conditions being met." Schneider seconded. Carried 5-0. Resolution #285-93, as amended, carried 4-1 with Misko casting the "no" vote. moved for adoption. Misko seconded. Carried 5-0. Reso. #286-93 - Acceptance of Quote for New Squad Cars. Patterson of Norway. Dumke moved for adoption. Sanders seconded. Carried Reso. #287-93 - Approval of Certified Survey Map - Kirchner, Town 3-2 with Patterson, Dumke, and Sanders voting "yes" and Misko and Schneider voting "no. 'I moved for adoption. Reso. #289-93 - Approval of Carriers for City's Insurance. Reso. #290-93 - Amendment to 1993 Budget. Misko moved for adoption. Schneider seconded. Carried 5-0. Reso. #291-93 - Approval of Contract Between Waukesha County Dept. of Aging and City of Muskego. Removed due to contract not being received. Reso. #292-93 - Appointment of Citizen Member to Plan Commission (Robert Vitt). Sanders moved for adoption. Misko seconded. Carried 5-0. Chapter 17, Section 17.5.02 (2) A. 1. of the Municipal Code of the Ord. #822 - An Ordinance to Amend Chapter 8, Section 8.1 (1) and City of Muskego (Reference to Highway Width Map). First Reading. LICENSE APPROVAL Patterson moved for approval of Operators' Licenses for Annmarie Giuliani, Brian Kelly, Nancy Kwaterski, Keith Stark and Thomas Kitzke (Temporary) subject to favorable police reports. Dumke seconded, carried. Patterson moved for approval of Temporary Class "B"/"Class B" Association for January 8, 1994. Misko seconded. Carried 5-0. Retailer's License (Gathering Permit) for St. Leonard Athletic Common Council Minutes December 28, 1993 Page 3 VOUCHER APPROVAL Patterson moved for approval of General Vouchers in the amount of $209,125.59. Schneider seconded. Carried 5-0. Patterson moved for approval of Tax Refund Checks in the amount of $25,498.19. Dumke seconded. Carried 5-0. Sanders moved for approval of Utility Vouchers in the amount of $49,792.11. Schneider seconded. Carried 5-0. Patterson reminded everyone that the mandatory curbside trash/recycling program for residential properties would begin January 3, 1994. Misko moved to adjourn at 9:02 P.M.
