ccm19930928CITY OF MUSKEGO COMMON COUNCIL MINUTES OF MEETING HELD SEPTEMBER 28, 1993 The meeting'was called to order at 7:27 P.M. by Mayor De Angelis. Also present were Aldermen Patterson, Dumke, Misko, Sanders, Schneider, Taube, and Woodard, City Clerk Marenda, City Attorney Molter, and Deputy Clerk Blenski. Patterson moved for approval of minutes of the Common Council meeting held September 14, 1993. Misko seconded, carried. COMMUNICATIONS PROM THE MAYOR'S OFFICE Mayor announced his appointments to the Personnel Committee being formed for the selection of a Planning Director: Mayor, Council President Patterson, Ald. Taube as Plan Commission representative, City Clerk Marenda and Citizen member Joy Kuhns. Mayor stated he has attended several committee meetings of the County Board in an effort to put the Moorland Road Extension project back in the county budget. COMMITTEE REPORTS Sanders presented minutes of Finance Committee Meetings held 9/15, 9/22, 9/28 and moved for acceptance. Patterson seconded, carried. Schneider presented minutes of Public Works Committee Meeting held that Big Muskego Lake Deputy Commissioner Leonard Pilak be allowed 9/23/93 and moved for acceptance. Misko seconded. Dumke requested to address the Council. There were no objections. Mr. Pilak expressed concerns of Big Muskego Lake residents regarding delaying the draw down of Little Muskego Lake to October 15. Mr. Pilak reported that there was much property damage this spring and the delayed draw down would be detrimental and possibly cause more districts take place in the future to alleviate problems. BML damage. He is requesting that a coordination between the two lake Deputy Commissioners will be meeting on 9/29. Ald. Taube stated he would attempt to have someone from the Little Muskego Lake District attend. Mayor stated there is still time to arrive at a solution to this problem for this year. Mr. Pilak will contact the DNR. Rich Eberhardt was directed to provide draw down calculations for BML for the 9/29 meeting. Mayor gave an update regarding the Lake Forect Subdivision revised master grading and drainage plans submitted to Public Works Committee 9/23. He stated that soil erosion plans have been submitted and approved by the City inspector. Ruekert E, Mielke's concerns have also been addressed and as far as the City is aware, the DNR has been contacted. Motion carried. Woodard presented minutes of Public Safety Committee Meetings held 9/16/93 and 9/22/93 and moved for acceptance. Sanders seconded, carried. Woodard presented minutes of Public Utilities Committee Meeting held 9/16/93 and moved for acceptance. Sanders seconded, carried. Plan Commission minutes of 9/21/93 were received and placed on file. Mayor De Angelis presented Mirjam with the Resolution and various Patterson moved for adoption. Schneider seconded. Carried 7-0. Muskego souvenirs . Reso. #226-93 - Honoring Muskego's AFS Student - Pedro Rondon. Misko moved for adoption. Sanders seconded. Carried 7-0. Mayor presented Pedro with the Resolution and various Muskego souvenirs. OLD BUSINESS Reso. #215-93 - Approval of Preliminary Plat - Kimberly Estates, on the floor, deferred 9/14/93. Resolution adopted 7-0. Reso. #221-93 - Establishing Salaries for Elected Officials, on the floor, deferred 9/14/93. Sanders moved to amend to increase assessor's salary from $40,616.23 to $41,616.23. Woodard seconded. Dumke stated all elected officials should get the same percentage of increase. Patterson opposes the amendment. Sanders stated the reasons for his support. Defeated 5-2 with Patterson, Woodard voting "yes." Resolution #221-93 adopted 6-1 with Dumke Dumke, Misko, Schneider and Taube voting "no" and Sanders and casting the only "no" vote. Ord. #812 - An Ordinance to Amend Chapter 14, Section 8.2 of the Municipal Code of the City of Muskego (Floodplain Zoning Ordinance) Second Reading. Taube moved for adoption. Sanders seconded. Carried 7-0. Code of the City of Muskego (Zoning Ordinance) Second Reading. Ord. #E13 - An Ordinance to Amend Chapter 17 of the Municipal Taube moved for adoption. Schneider seconded. Taube moved to amend Section 5 to read, "A minimum review fee, as from time to charged for all applications to the Plan Commission where a fee has time established by Resolution of the Common Council, shall be not been otherwise established by the zoning ordinance. The review fee shall be applicable for, but not limited to the following: Sign Approvals, Landscape Plan Reviews, Kennel Permit Renewals, and Fireworks Stand Permits. Fees for other applications to the Plan Commission for, but not limited to Building Site and Operation Plan Review, Truck Parking Review, Second Garage Structure Requests, and Legal Lot Determinations shall be, as from time to time, established by Resolution of the Common Council." Schneider seconded. Carried 7-0. Ord. #813, as amended, adopted 7-0. Ord. #E14 - An Ordinance to Amend Chapter 18 of the Municipal Code of the City of Muskego (Land Division Ordinance) Second Reading. Taube moved for adoption. Sanders seconded. Mayor reported that Municipal Code Corporation quoted the City a price not to exceed utilized for this project. Misko moved to defer to 1994 following $2,200 for codifying Chapter 18. 1994 budget funds will be this service being performed. Dumke seconded, carried. Muskego - Purdy EA to A Second Reading. Sanders moved for Ord. #815 - An Ordinance to Amend the Zoning Map of the City of adoption. Taube seconded. Carried 7-0. Ord. #816 - An Ordinance to Amend Chapter 12, Section 12.08(6)(d), of the Municipal Code of the City of Muskego . Carried 7-0. for Garbage and Refuse Disposal and Recycling Service. Patterson Reso. #228-93 - Authorize Execution of Contract for Weekly Refuse Collection and Disposal and Biweekly Recycling Collection and Disposal Between the City of Muskego and BFI. Removed from the agenda. Reso. #229-93 - Amendment to Deposit & Forfeiture Schedule. Sanders moved for adoption. Taube seconded. Carried 7-0.
