ccm19930914CITY OF MUSKEGO COMMON COUNCIL MINUTES OF MEETING HELD SEPTEMBER 14, 1993 The meeting was called to order at 7:52 P.M. by Mayor De Angelis. Also present were Aldermen Patterson, Misko, Sanders, Schneider, Taube, and Woodard, City Clerk Marenda, City Attorney Molter, and Deputy Clerk Blenski. Alderman Dumke was absent. Patterson moved for approval of the minutes of the Common Council meeting held August 24, 1993. Misko seconded, carried. COMMUNICATIONS FROM THE MAYOR'S OFFICE Mayor is forming a Personnel Committee consisting of five members for the purpose of interviewing and selecting a Director for the Planning Department. Appointments will be made shortly. COMMITTEE REPORTS Sanders presented minutes of Finance Committee Meetings held 9/8/93 and 9/14/93 and moved for acceptance. Patterson seconded, carried. Woodard presented minutes of Public Safety Committee Meeting held 9/2/93 and moved for acceptance. Misko seconded, carried. Misko presented minutes of Public Works Committee Meetings held 8/26/93 and 8/27/93 and moved for acceptance. Schneider seconded, carried. Schneider presented minutes of Public Welfare Committee Meetings held 8/30, 8/31, 9/1 and 9/9/93 and moved for acceptance. Patterson seconded, carried. Plan Commission minutes of 9/7/93 were received and placed on file. Reso. #212-93 - Approval of Lease Agreement Between the City of Muskego and Soil Remediation Service, Inc. Patterson moved for adoption. Schneider seconded. Patterson moved to amend to add language to lease to include that the tenant will be responsible for air filter replacement expenses for American 6, Foreign Auto Body for their exchange unit and their spray booth. Mayor stated that the tenant has agreed to this. Taube seconded, carried. Reso. #212-93, as amended, Carried 6-0. Reso. #216-93 - Approval of Certified Survey Map - Belsha. Taube moved for adoption. Schneider seconded. Carried 6-0. Reso. #209-93 - Authorize Execution of Easement Document for WEPCO, on the floor, deferred 8/24/93. Reso. #209-93 adopted 6-0. Ord. #811 - An Ordinance to Amend Chapter 32, Sections 32.02(15) and Second Reading. Taube moved for adoption. Misko seconded. Carried 32.03(7) of the Municipal Code of the City of Muskego (Fire Prevention). 6-0. Reso. #213-93 - Approval of Offer to Purchase - Muskego Industrial Park. Patterson moved for adoption. Schneider seconded. Mikso moved to amend to add to last paragraph, "if buyers initial Lines 80-83 with dates inserted which refer to specific flood plain and wetland maps and to include social security number of buyer and signature of broker." Sanders expressed Reso. #215-93 - Approval of Preliminary Plat - Kimberly Estates. opposition to the private park access referred to in minutes of Plan Commission meeting. Park access from Lake Forest was discussed. public or private. Patterson moved to defer to Plan Commission for Sanders requested clarification as to whether the Lake Forest access is further review of the park access. Sanders seconded. Carried 6-0. Reso. #217-93 - Approval of Certified Survey Map - Peters. Taube moved for adoption. Sanders seconded. Carried 6-0. Reso. #218-93 - Amendment to Deposit E, Forfeiture Schedule. Patterson moved for adoption. Schneider seconded. Patterson moved to amend to remove "Section 350.101 (l)(c) Absolute Sobriety" for clarification of correct deposit and forfeiture. Sanders seconded, carried. Reso. #218-93, as amended, carried 5-1 with Taube voting "no." McDonald for Audit Service of General Fund and Sewer and Water Utilities Reso. #219-93 - Approval of Agreement Between the City and Conley Carried 6-0. for Year Ending 12/31/93. Reso. #221-93 - Establishing Salaries for Elected Officials. Sanders moved for adoption. Misko seconded. Patterson moved to defer and refer to 9/22 Finance Committee meeting. Sanders seconded, carried 6-0. Reso. #222-93 - Approval of Muskego Parks & Recreation Department Part-Time/Seasonal Compensation Plan Pay Scale. Woodard moved for adoption. Schneider seconded. Carried 6-0. Reso. #223-93 - Authorize Execution of Easement Document for WEPCO (Foxboro North). Sanders moved for adoption. Schneider seconded. Carried 6-0. Reso. #224-93 - Approval of Amendment to Cleaning Service Contract seconded. Carried 6-0. (Parks Headquarters Bldg.). Misko moved for adoption. Woodard Ord. #E12 - An Ordinance to Amend Chapter 14, Section 8.2 of the Municipal Code of the City of Muskego (Floodplain Zoning Ordinance). First Reading. Ord. #E13 - An Ordinance to Amend Chapter 17 of the Municipal Code of the City of Muskego (Zoning Ordinance). First Reading. Ord. #E14 - An Ordinance to Amend Chapter 18 of the Municipal Code of Attorney recommended that the City proceed slowly; changes should be the City of Muskego (Land Division Ordinance). First Reading. City reviewed carefully from the legal end. He has some specific concerns. First Reading. Ord. #E16 - An Ordinance to Amend Chapter 12, Section 12.08(6)(d), of Yards). First Reading. Further clarification was requested and sample the Municipal Code of the City of Muskego (Enclosure of Junk or Salvage ordinances from surrounding municipalities. LICENSE APPROVAL Patterson moved for approval of Operator‘s Licenses for David Furru, Vernon Kittler, Carlyn Rittenhouse, and Douglas Schmidbauer. subject to favorable police reports. Sanders seconded, carried 6-0. Patterson moved for approval of Temporary Class “B“ to Sell Beer and Temporary “Class B” to Sell Wine for St. Leonard Congregation on 9/24 will be allowed on the premises. Misko seconded. Carried 6-0. and 9/25 between the hours of 7:OO P.M. and 12:OO A.M. Underage people VOUCHER APPROVAL Patterson moved for approval of payment of General Vouchers in the amount of $678,402.65. Schneider seconded. Carried 6-0. Sanders moved for payment of Utility Vouchers in the amount of $59,141.17. Woodard seconded. Carried 6-0. CITY OFFICIALS’ REPORTS City Clerk reported petition received to amend Chapter 14, Section 1.5 (2) of the Floodplain Zoning Ordinance to adopt a revised Official Floodplain Map. A Public Hearing is scheduled for 9/28 at 7:25 P.M. City Clerk also reported a Public Hearing is scheduled for 10/26 at 7:25 to consider petition of Plum Creek, Plum Creek Addn. #1 and Plum Creek East to grant a zoning change from RS-3 to RS-3/0PD. COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW Patterson reported that a home composting workshop will be held at the Retzer Nature Center on Tuesday, October-5 from 4:30 - 6:OO P.M.
