ccm19930629COMMON COUNCIL CITY OF MUSKEG0 MINUTES OF SPECIAL COMMON COUNCIL MEETING HELD JUNE 29, 1993 The meeting was called to order at 7:30 P.M. by Mayor De Angelis. Also present were Aldermen Patterson, Dumke (arrived Clerk Marenda and City Attorney Riffle. 8:OO P.M.), Misko, Sanders, Schneider, Taube, and Woodard, City Patterson moved to convene into Closed Session pursuant to §19.85(1)(g) Conferring with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to specifically, Little Muskego Lake Association threatened litigation in which it is or is likely to become involved, more over construction of the Lake Forest Development and/or other litigation under the Clean Water Act against Terra Development Development; and, pursuant to §19.85(l)(c) will interview litigation arising from the construction of the Lake Forest candidates and consider employment of special counsel to represent the City of Muskego with respect to litigation in which it is or is likely to become involved, more specifically, Little Muskego Lake Association threatened litigation under the Clean Water Act against Terra Development over construction of the Lake Forest Development and/or other litigation arising Common Council then reconvening into Open Session to continue from the construction of the Lake Forest Development, with the with agenda items. Misko seconded, carried 6-0 (Dumke absent). The Common Council reconvened into Open Session. NEW BUSINESS Reso. #166-93 - A Resolution to Retain Special Counsel to Arising out of the Construction of the Lake Forest Represent the City of Muskego in Regards to any Litigation Development. Schneider moved for adoption. Dumke seconded. Discussion followed on merits of attorney interviewed in Closed with actual experience in the same type of case. Mayor stated Session. Taube expressed concern about finding an attorney with a background in both municipal law and environmental law. that consideration should be given that this attorney comes Schneider moved to amend to insert the name of the law firm of “Frebert, Finnerty h St. John, S.C.“. Misko seconded, carried amended, adopted 6-1 with Taube voting “no“. 5-2 with Dumke and Taube voting “no“. Resolution #166-93, as Attorney Riffle was directed to meet with Special Counsel William Guis to bring him up to speed and to request a report for the July 13, 1993 Common Council meeting. Attorney Riffle will send a letter recapping the hours to be spent by Special Counsel on this matter, as reviewed in Closed Session. 0 e a Common Council Minutes June 29, 1993 Page 2 Sanders moved to adjourn at 9:39 P.M.
