COMMON COUNCIL
MINUTES OF MEETING HELD MAY 25, 1993
0 The meeting was called to order at 7:34 P.M. by Mayor De Angelis.
Also present were Aldermen Patterson, Dumke, Misko, Sanders,
Schneider, Taube, and Woodard, City Clerk Marenda (arrived at 7:40
P.M.), City Attorney Molter, and Deputy City Clerk Blenski.
Patterson moved for approval of the Common Council minutes of
meeting held May 11, 1993. Dumke seconded, carried.
PERSONAL APPEARANCES
Crime Stoppers Award presentation given by Chief Johnson and Mary
Dibb to Allen J. Weber.
COMMITTEE REPORTS
Sanders presented minutes of Finance Committee Meetings held May
19 and 25, 1993 and moved for acceptance. Patterson seconded,
carried.
Woodard presented minutes of Public Safety Committee Meeting held
May 13, 1993 and moved for acceptance. Misko seconded, carried.
Schneider presented minutes of Public Welfare Committee Meeting
held May 17, 1993 and moved for acceptance. Patterson seconded,
carried.
Woodard presented minutes of Public Utilities Committee Meeting
held Mav 20, 1993 and moved for acceptance. Sanders seconded, - 0 carried:
Plan Commission Minutes of meeting held May 18, 1993 were received
and placed on file.
Ord. #797 - An Ordinance to Amend Chapter 5, to add Section 5.07
(6) to the Municipal Code of the City of Muskego (Public Records -
Destruction of Records). Second Reading. Taube moved to adopt.
Misko seconded. Taube moved to amend to add at the end of
Section 3 “and approval of the State of Wisconsin Public Records
and Forms Board.” Misko seconded, carried. Ord. #797, as
amended, carried 7-0.
Ord. #798 - An Ordinance to Amend Chapter 9, Section 9.001 of
the Municipal Code of the City of Muskego (Adopting State Statutes
Woodard seconded. Carried 7-0.
Re Drug Paraphernalia). Second Reading. Taube moved to adopt.
Mayor De Angelis turned the chair over to Council President
Patterson at this time.
Reso. #137-93 - Resolution of Necessity (Lutsch/Kurth Park).
Taube moved for adoption. Schneider seconded. Molter stated this
is the initial step to acquire property. Taube moved to amend to
change the Resolution sponsor name to “Patrick Patterson, Council
President. Misko seconded. Carried 7-0. Resolution #137-93, as a amended, carried 7-0.

The chair was turned back to Mayor. De Angelis.

Taube moved for adoption. Patterson seconded. Carried 7-0.
Reso. #140-93 - Approval of Certified Survey Map - Spitzner.
Taube moved for adoption. Schneider seconded. Carried 7-0.
Reso. #141-93 - Approval of Certified Survey Map - Kwik Trip.
Removed from the agenda.
Reso. #142-93 - Preliminary Resolution Declaring Intent to
Wisconsin Statutes, as to Sanitary Sewer Assessment Area for
Exercise Special Assessment Police Powers Under S66.60,
Boxhorn/Groveway/Ryan Sewer Project (MSS-1-93). Sanders moved for
adoption. Woodard seconded. A Public Hearing will be held in
about a year. Carried 7-0.
Reso. #143-93 - Approval of Lease Agreement for City-Owned Land
(Parkland Plaza Phase IV). Misko moved for adoption. Sanders
seconded. It was noted that a correction was made to the lease in
period" after "If the land is not used for active cropping."

Reso. #144-93 - Approval of Loan Fund Application (Country
Wetlands Nursery. Patterson moved for adoption. Dumke seconded.

Reso. #145-93 - Approval of Amendment to Listing Contract
between the City of Muskego and Mooney LeSage L Associates.
Patterson moved for adoption. Taube seconded. Carried 7-0.
Ord. #799 - An Ordinance to Amend the Zoning Map of the City of
Muskego from B-2 to RS-3/0PD (Kwik Trip). First Reading. Removed
from the agenda.
Ord. #e00 - An Ordinance to Amend Chapter 12.02 (Licensing of
Soda Water Beverages). First Reading.

Patterson moved for approval of "Class B" Beer L Liquor License
for P-K Entertainment d/b/a Patti's Pub, Ken Christensen, Agent
seconded. Denied 6-1 with Sanders casting the only "yes" vote.
for the 1992-1993 year. (Subject to publication) Sanders
Attorney Molter advised if a license is to be denied, the
applicant must be given an opportunity for a hearing, with reasons
for denial to be in writing and submitted to the applicant.
Patterson moved to reconsider. Misko seconded. Carried 7-0.

Patterson moved for approval of Outside Dance Permit and Amendment

to "Class B" Beer & Liquor License (Amending Premise Description)
Carried 6-1 with Taube voting "no."
VOUCHER APPROVAL
amount of $186,232.26. Dumke seconded. Carried 7-0.
Patterson moved for approval of payment of General Vouchers in the

amount of $26,870.10. Dumke seconded. Carried 7-0.
Clerk reported that a Public Hearing would be held on June 22,
1993 at 1:25 P.M. to consider amendment to Chapter 17 of the
Procedures.
Zoning Ordinance regarding Board of Appeals Filing Fee and
Patterson moved to adjourn at 8:47 P.M. Schneider seconded,
carried.
