ccm19930223CITY OF MUSKEG0 COMMON COUNCIL MINUTES OF MEETING HELD FEBRUARY 23, 1993 The meeting was called to order at 8.09 P.M. by Mayor Salentine. Also present were Aldermen Patterson, Dumke, Misko, Sanders, Schneider, Simmons, and Taube, City Clerk Marenda, City Attorneys Molter and Trindl, and Deputy Clerk Blenski. Patterson moved for approval of the Common Council minutes of meeting held February 9, 1993. Dumke seconded, carried. Ord. #784 - An Ordinance to Amend Chapter 17 of the City of Muskego Municipal Code to Regulate Adult-Oriented Establishments. First Reading. Attorney Molter was requested to review Section 17: 2.02 (.5)(b) "Adult bookstore" following information presented by Laverne Decamp. The Planning Director's Report on Secondary Effects of Adult-Oriented Entertainment Establishments was presented for the record. Taube moved for adoption. Sanders seconded. Carried 7-0. Reso. #34-93 - Approval of Preliminary Plat - Lowe Subdivison. moved for adoption. Sanders seconded. Carried 7-0. Reso. #35-93 - Approval of Certified Survey Map - Mecca. Taube Wilkinson Property Made by Resolutions #198-91 and #199-91. Reso. #40-93 - Resolution as to Water and Sewer Assessments of development is allowed to take place before assessment is due. Paul Hanson, representative of Kwik Trip, presented sketches of various architectural designs for the proposed gas station as requested by Plan Commission. Several Council members expressed a desire to see what the entire retail center will look like. They voiced a strong desire for continuity and a theme look for the entire center. The developers, Mr. Tessman and Mr. Koss, stated they will attempt to achieve the architectural continuity Council members are calling for. They do not believe the appearance of will be built on one of the outlots. Mr. Hanson asked for the proposed retail center should be dictated by Kwik Trip, which direction from Council. A poll of the Council members indicated Commission agenda at their next meeting. Patterson moved to the majority favored Sketch D. This will again be on the Plan defer, Taube seconded, carried. Attorney Molter was excused at 9:50 P.M. Municipal Code of the City of Muskego (Land Suitability). On the Ord. #779 - An Ordinance to Amend Chapter 18, Section 2.6 of the floor, deferred 1/26/93, 2/9/93. Taube moved to amend 2.6 (A) Floodlands to read as follows: 1. No lot served by public area, as specified in the Zoning District Regulations, below the sanitary sewerage facilities shall have less than its required lot elevation of the 100-year recurrence interval flood, or where such Common Council Minutes February 23, 1993 Page 2 data is not available, the elevation shall be determined by a Registered Professional Engineer and the sealed documents shall be projects served by public sanitary sewerage facilities, no lot approved by the City Engineer. 2. For Planned Development Plan Commission, below the elevation of the 100-year recurrence shall have less than the average lot area, as specified by the interval flood, or where such data is not available, the elevation shall be determined by a Registered Professional Engineer and the sealed documents shall be approved by the City Engineer. 3. No lot of one (1) acre or less in area served by an on-site sanitary sewage disposal (septic tank or mound) system shall include floodlands. All lots more than one (1) acre in area served by a septic tank system or mound system shall contain not less than 40,000 square feet of land which is at an elevation above the elevation of the one hundred (100) year recurrence interval flood or, where such data is not available the elevation shall be documents shall be approved by the City Engineer. Deferred 2/9/93. Patterson moved to table. Dumke seconded. Carried 5-2 with Patterson, Dumke, Misko, Schneider, and Taube voting "yes" and Sanders and Simmons voting "no." Ord. #782 - An Ordinance to Amend Chapter 14, Section 1.5 (2) of the Floodplain Zoning Ordinance (Map Amendment) seconded. Carried 7-0. (Bushberger). Second Reading. Dumke moved to adopt. Simmons Ord. #785 - An Ordinance to Amend Chapter 32 of the Municipal Code of the City of Muskego (Fire Prevention Code). Second Reading. Sanders moved to adopt. Misko seconded. Sanders moved to amend to add all language per the Public Safety Minutes of February 22, 1993 and to include in 32.02 (15) that sign(s) will building. Misko seconded. Carried 7-0. Ord. #785, as amended, state that there will be no parking of unattended vehicles in the adopted 7-0. Ord. #787 - An Ordinance to Amend Chapter 1, Section 1.09 of the Municipal Code of the City of Muskego Regarding Elections. Second Readinq. Misko moved to adopt. Taube seconded. Patterson stated that SEWRPC would conduct a transportation study for the entire city which this project could come under. Taube moved to amend to add "BE IT FURTHER RESOLVED that this funding should not be authorized due to the transportation study being conducted by SEWRPC" and to insert "0" in the dollar amount. Sanders clarified that he felt the type of water tower structure will be dependent on cost factors. Motion carried. Schneider presented minutes of the Public Welfare Committee meeting held February 22, 1993 and moved for acceptance. Patterson seconded. Patterson announced BFI in Tess Corners will be open Motion carried. from 6AM-Noon on Saturdays effective 4/15/93 for disposal of brush. Misko presented minutes of the Public Safety Committee meeting held February 22, 1993 and moved for acceptance. Sanders seconded, carried. Plan Commission minutes of the meeting held February 16, 1993 were received and placed on file. Patterson moved for approval of payment of General Vouchers in the amount of $204,133.12 with the check to C.O.S. for $1,090 to be held for further Finance Committee review. Dumke seconded, carried 7-0. amount of $36,668.58. Schneider seconded, carried 7-0. Sanders moved for approval of payment of Utilities Vouchers in COMMUNICATIONS Clerk read response to Council's invitation to appear at Council meeting from Rep. Kleczka stating he could appear on a Saturday. Meeting to be set up after April election. Patterson moved to adjourn at ll:42PM. Misko seconded, carried.
