ccm199302090 MINUTES OF MEETING HELD FEBRUARY 9, 1993 CITY OF MUSKEG0 COMMON COUNCIL The meeting was called to order at 8:29 P.M. by Mayor Salentine. Also present were Aldermen Patterson, Dumke, Misko, Schneider, Attorney Molter arrived at 9:20 P.M. Alderman Simmons was absent. Taube, and Sanders, City Clerk Marenda, and Deputy Clerk Blenski. meeting held January 26, 1993. Dumke seconded, carried. Patterson moved for approval of the Common Council minutes of State Senator Lynn Adelman appeared and gave the Council an update on the State Legislature and answered questions from the Council. There were several items of concern brought to his attention; he stated he would pursue those items in Madison. Ord. #I85 - An Ordinance to Amend Chapter 32 of the Municipal Code of the City of Muskego (Fire Prevention Code). First Reading. Ald. Sanders requested research be done on impact of this new restriction regarding garages. Mayor noted that this new Misko recommended the Fire Dept. and Chuck Dykstra be involved in restriction could adversely affect tenants such as Mr. Santoro. review of item regarding garages and overhead doors. Sanders requested John Henderson be allowed to address the Council. Mr. Hendersen opposed the restriction and presented his rationale. Since this ordinance is not in effect at this time, Mr. Santoro would be grandfathered in under the existing Fire Code per consensus of Council. It was recommended this be referred to Public Safety Committee. Reso. #lo-93 - Awarding of Bids-Recycling Center Fencing Project. Possible Reconsideration. Sanders moved to reconsider. Schneider seconded, carried. Sanders stated there was concern regarding the sound levels of the chipping operation in the Industrial Park. Rules and Regulations for the Industrial Park outline the decibel levels allowed. Taube stated there is no way the City has to measure sound decibels; the city does not have a sound level meter. Mayor stated the Police Department addresses and makes determinations regarding noise complaints. Sanders Carried 5-1 with Taube voting "no." Mr. Andersen stated his requested that Mr. Andersen address the Council. Taube objected. business is south of proposed chipping operation. He does not have a problem with the 7' fence height. He would like to see defer and refer to Public Welfare Committee. Misko seconded, trees planted for screening and sound barrier. Taube moved to contracts. Plan Commission to review further. carried. City Clerk requested to obtain extension of bid Ord. #I79 - An Ordinance to Amend Chapter 18, Section 2.6 of the Municipal Code of the City of Muskego (Land Suitability). Deferred 1/26/93. Taube moved to amend to add language that requirements. Lots should have the same square footage as floodplain lands should not be counted toward the minimum lot size baseline zoning, 2 feet above the floodplain. It was suggested in a PUD, the minimum lot size outside the floodplain shall be a minimum of the average lot sizes included in the PUD. Taube requested Mr. Ron Ford be allowed to address Council. Request granted. Mr. Ford stated his support for minimum lot size in PUD. Molter recommended the ordinance go back to the planner to be properly rewritten. Motion to amend withdrawn. Taube moved to defer. Patterson seconded. Motion carried. Mr. Seegar Swanson appeared to explain various borrowings the City may be doing. He distributed financial information to the Council and gave a short presentation on same. Reso. #20-93 - Resolution Authorizing Ehlers and Associates, Inc. to Solicit Competitive Proposals for Not to Exceed $2,615,000 Muskego, Wisconsin. Patterson moved for adoption. Sanders General Obligation Refunding Promissory Notes of the City of seconded. Savings in interest estimated at $155,870. Carried 6-0. Reso. #21-93 - Resolution Authorizing Ehlers and Associates, Inc. to Solicit Competitive Proposals for Not to Exceed $4,500,000 General Obligation Advance Refunding Notes of the City of Muskego, Wisconsin. Patterson moved for adoption. Dumke seconded. Savings in interest estimated at $55,325. Carried 6-0. Reso. #22-93 - Resolution Authorizing Ehlers and Associates, Inc. to Solicit Competitive Proposals for General Obligation Promissory Notes for Public Works and Improvements, City of Muskego, Waukesha County, Wisconsin ($1,460,000). Sanders moved for adoption. Patterson seconded. Dumke questioned the financial responsibility of the developer. Molter stated Subdivider's Agreement and Letter of Credit address this. Carried 6-0. Reso. #33-93 - Authorization for Mayor to Execute State/Municipal Agreement for a Transportation Economic Assistance (T.E.A.) Grant. Sanders moved for adoption. Misko seconded. Molter stated City still could be liable for reimbursement if jobs are not created. Carried 6-0. Reso. #30-93 - Appointment to Metro Landfill Monitoring Committee (Nick Piccione). Patterson moved for adoption. Dumke seconded. Carried 6-0. Attorney Molter was excused at 11:20 P.M. COMMITTEE REPORTS Sanders presented the Finance Committee minutes of meetings held 2/3/93 L 2/9/93 and moved for acceptance. Patterson seconded, carried. of meeting held 1/28/93. Schneider moved for acceptance of Public Works Committee minutes Common Council Minutes February 9, 1993 Page 3 Dumke moved for acceptance of Rules, Laws & Ordinance Committee minutes of meeting held 2/4/93. Taube seconded, carried. Plan Commission minutes of 2/2/93 were received and placed on file. Ald. Schneider requested information regarding #P.C. 17-93 regarding KwikTrip. He believes the corner was to have a shopping center. He would like to see a plan for the entire corner. Taube stated he wants to see Moorland Road extension properly planned out. He would like to see the rerouting of Durham between McShane and Hi View drawn out. Mayor stated there is $1,000 in budget to be used. There may not be any money left to be used as some work has already been completed. Management and Other Non-Represented Employees of the City of Reso. #3-93 - Approval of Amendment to Personnel Code for Muskego 1/1/93-12/31/95. On the floor, deferred 1/26/93. Patterson moved to add to Amendment the following under Article V Foreman. Salary rate to be $15.57 for 1993, $16.19 for 1994, and - Wages & Benefits (Exhibit "A"): 1. Add position of Utilities $16.84 for 1995; 2. Amend 18-Month Salary of Parks Maintenance Person for 14 Week Summer Supervision to $15.57 for 1993, $16.19 for 1994, and $16.84 for 1995; 3. Sanders moved to amend 17.05 to read, "Retired persons (or widow or widower) may choose to enroll in the health insurance plan offered by the City at their own cost if employed by the City for ten (10) continuous calendar years and 50 years or over at time of retirement, and may elect the family plan coverage if Taube and Sanders voting "yes" and Patterson & Dumke voting "no. I' applicable." Misko seconded. Carried 4-2 with Misko, Schneider, Patterson moved to amend 10 years to 15 with the age remaining at 50. Dumke seconded. Defeated 2-4 with Patterson and Dumke voting "yes" and Misko, Schneider, Taube and Sanders voting "no." Reso. #3-93, as amended, carried 6-0. 0 Reso. #286-92 - Approval of Certified Survey Map-De Angelis On the floor, deferred 11/22/92. Ord. #781 - An Ordinance to Create Chapter 9, Section 9.38, of the Municipal Code of the City of Muskego Regarding the Taube moved to amend to remove, "or should know to be," from Harboring of Juvenile Runaways. Deferred 1/26/93. adopted 6-0. Section 9.38 (a). Dumke seconded, carried. Ord #781, as amended, Reso. #14-93 - Approval of Design Engineering Firm for Interior Restoration of Parks Headquarters Building. Possible Reconsideration. Misko moved to reconsider. Patterson seconded, carried. Misko moved to remove "at $50 an hour" from the 5th paragraph and replace with "per Article 12.2 and/or Exhibit A as attached." Taube seconded, carried. Ord. #788 - An Ordinance to Amend the Zoning Map of the City of Muskego from B-2 to RS-3/0PD (Kwik Trip). First Reading. Schneider stated his opposition. Ord. #789 - An Ordinance to Amend Chapter 9, Section 9.16 (2) (Littering). First Reading. LICENSE APPROVAL Patterson moved for approval of Operator's Licenses for Mark Malison, Michael Ring, Katherine Koch, Jeannine Rowe subject to favorable police report. Dumke seconded, carried. COMMUNICATIONS Public Hearinq to be held 2/23/93 at 1:25 P.M. to consider petition for amendment to Chapter 17 of the Municipal Code relating to Adult Oriented Establishments.
