ccm19930126CITY OF MUSKEG0 COMMON COUNCIL MINUTES OF MEETING HELD JANUARY 26, 1993 The meeting was called to order at 7:56 P.M. by Mayor Salentine. . Also present were Aldermen Patterson, Dumke, Misko, Sanders, Schneider and Taube, City Clerk Marenda, Attorney Molter, and Deputy Clerk Blenski. Simmons was absent. Patterson moved for approval of the Common Council minutes of meeting held January 12, 1993. Dumke seconded, carried. PERSONAL APPEARANCES Ms. Stareen Schneider appeared before the Council as a representative of the Pa;ent-to-Parent Program. Reso. #6-93 - City's Endorsement of Parent-to-Parent Program. Schneider moved for adoption. Patterson seconded. Carried 6-0. The City Clerk presented Ms. Schneider with a certified copy of the adopted resolution. Ms. Schneider thanked the Council for their support of this program. County Supervisors Hahn, De Angelis and DesMonie appeared before the Council. Each gave a short presentation on Waukesha County issues and their relationship to the City of Muskego. Mr. Donald Vilione of Conley McDonald presented a summary of the 1991 TIF reports to the Council. Ord. #780 - An Ordinance to Create Chapter 13, Section 13.026 of the Municipal Code of the City of Muskego Regarding the Keeping of Potbellied Pigs. Second Reading. Patterson moved Kathi Gough be allowed to address the Council. She provided for adoption. Misko seconded. Alderman Dumke requested that information in support of potbellied pigs as pets. Several Council members expressed opposition to potbellied pigs as pets. Ordinance defeated by a vote of 6-0. Financial Requirement in the Conditional Use for the Future Reso. #7-93 - Resolution to Incorporate Welfare Committee's Parkland Landfill. Patterson moved for adoption. Schneider seconded. Taube moved to amend to increase fee from $7,500 to $30,000. Patterson seconded. Patterson requested that representatives from Future Parkland be allowed to address the They feel the $7,500 is fair. Payments will continue to be Council. The Consulting Engineer presented a Cost Comparison. made for 10 years even if the two additional waste streams are not used. Motion to amend defeated 4 to 2 with Dumke, Misko, voting "yes." Misko moved to amend $7,500 to $12,000. Sanders Sanders and Schneider voting "no" and Patterson and Taube seconded. Carried 5-1 with Taube voting "no." Taube seconded, carried. Reso. #7-93, as amended, adopted 6-0. Reso. #15-93 - Approval of Certified Survey Map-Sonnentag. Taube moved for adoption, Sanders seconded. Carried 6-0. Ord. #783 - An Ordinance to Create Section 12.20 of the Municipal Code Relative to Adult-Oriented Establishments. First Reading. Misko moved to suspend rules. Taube seconded. Carried 6-0. Ord. #783 Second Reading. Misko moved for approval. Taube seconded. Taube requested citizen from audience to address the Council. Sanders objected. Request granted 5-1 with Sanders voting "no." Individual asked about the Public Hearing that was needed to be held for the passage of Ord. #784. Ord. #783 adopted 6-0. Mayor Salentine called for a recess at 1O:lO. Council reconvened at 10:20. COMMITTEE REPORTS Sanders presented minutes of the Finance Committee meetings held January 20 and 26, 1993 and moved for acceptance. Patterson seconded, carried. meeting held January 13, 1993 and moved for acceptance. Schneider presented minutes of the Public Welfare Committee Patterson seconded, carried. Taube stated public needs to be better informed if recycling dates are changed due to holidays. Misko moved for acceptance of minutes of the Public Safety Committee meeting held January 14, 1993. Sanders seconded. Misko requested individual consideration of first two paragraphs on Page 3. Minutes approved with deletion of said paragraphs. Misko moved to refer said paragraphs on proposed schedule of permit fees and proposed revisions to Chapter 30 to go back to Safety Committee. Sanders seconded, carried. Schneider presented minutes of the Public Utilities Committee meeting held January 21, 1993 and moved for acceptance. Sanders seconded. Discussion took place on the Utility Foreman Position. Schneider requested individual consideration of third paragraph on Page 2 regarding sewer backup claim. Minutes approved with deletion of said paragraph. Sanders moved to delete paragraph from minutes. Schneider seconded, carried. Ord. #779 - An Ordinance to Amend Chapter 18, Section 2.6 of the Municipal Code of the City of Muskego (Land Suitability). Second Reading. Taube moved to adopt. Misko seconded. Taube moved to defer and refer to Rules, Laws & Ordinance Committee. Schneider seconded, carried. Common Council Minutes January 26, 1993 Page 3 0 Reso. #11-93 - Awarding of Bid - City-Wide Revaluation Project. Patterson moved for adoption. Dumke seconded. Carried 6-0. Reso. #14-93 - Approval of Design Engineering Firm for Interior Restoration of Parks Headquarters Building. Misko moved for adoption. Patterson seconded. Attorney Molter requested deferral to review Agreement. Patterson moved to amend to add to fourth paragraph, "contingent upon approval of the Finance Committee" and to sixth paragraph, "upon approval of the Finance Committee." Misko seconded, carried. Taube moved to further amend to add to the fifth paragraph, "which will be approved by the Parks Director in consultation with the Mayor." Sanders seconded, carried. Reso. #14-93, as amended, adopted 6-0. Reso. #16-93 - Modification of Deed Restrictions-Stefaniak. Sanders moved for adoption. Dumke seconded. Taube expressed opposition. Carried 5-1, with Taube voting "no." Attorney Molter stated the City will receive shortly information from his office on the School Impact Fee. Attorney Molter was excused at 11:40 P.M. Reso. #308-92 - Proceedings by the Common Council of the City of Muskego to Discontinue and Vacate a Road Right-of-way (Tess Corners Fire Dept. Substation). Introduced 12/8/92. Dumke moved for adoption. Schneider seconded. Carried 6-0. Reso. #3-93 - Approval of Amendment to Personnel Code for Management and Other Non-Represented Employees of the City of Muskego 1/1/93 - 12/31/95. Patterson moved for reconsideration. Sanders seconded. Carried 6-0. Patterson moved to defer. Sanders seconded, carried. Ord. #781 - An Ordinance to Create Chapter 9, Section 9.38, of the Municipal Code of the City of Muskego Regarding the Harboring of Juvenile Runaways. Second Reading. Taube moved for adoption. Misko seconded. Taube moved to defer and refer to Rules, Laws & Ordinance Committee. Patterson seconded, carried. Reso. #8-93 - Approval of Amendment to Contract of Sale-Kids Kampus, Inc. Patterson moved for adoption. Dumke seconded. Carried 6-0. Reso. #9-93 - Appointment of Citizen Member to Library Board-Russell Jankowski. Sanders moved for adoption. Dumke seconded. Carried 6-0. Mayor Salentine noted that an appointment still needs to be made to the Metro Landfill Monitoring Committee. Reso. #lo-93 - Awarding of Bid - Recycling Center Fencing Project. Dumke moved for adoption. Sanders seconded. Carried 6-0. from WEPCO (Kristin Down to Meadow Green West Connection). Reso. #13-93 - Authorize Expenditure of Park Dedication Funds Sanders seconded. Carried 6-0. (Jensen Ball Field Renovation). Misko moved for adoption. Reso. #17-93 - Designating 1992 Unexpended Capital Project Funds to be Carried Over into 1993. Patterson moved for adoption. Sanders seconded. Carried 6-0. Reso. #18-93 - Creating Position of Utilities Foreman. Sanders moved for adoption. Misko seconded. After discussion about the need to promote an employee to this position, Patterson moved to defer. Taube seconded. Defeated 4 to 2 with Dumke, Misko, Sanders and Schneider voting "no" and Patterson and Taube voting "yes." Schneider called for the question. Misko objected. Roll call vote 4 to 3 with Dumke, Sanders and Schneider voting "yes," Patterson, Misko and Taube voting "no," and Mayor casting tie breaking "yes" vote. Resolution adopted 4 to 2 with Dumke, Misko, Sanders, and Schneider voting "yes" and Patterson and Taube voting "no. 'I Reso. #19-93 - Amendment to Deposit and Forfeiture Taube moved to defer. LICENSE APPROVAL Patterson moved for approval of Operator's Licenses subject to favorable police reports and required applications and fees for Amy Wieting, Barb Herfurth, Carol Mack, Kimberly Williams, Ron Seliger, Ron Erickson, and Kurt Johnson. Sanders seconded, carried. Patterson moved for approval of two Class "B" Gathering Permits Misko seconded, carried. for St. Leonard Congregation for 2/20/93 and 10/9/93. VOUCHER APPROVAL Patterson moved for approval of payment of General Vouchers in the amount of $206,913.67. Dumke seconded. Carried 6-0. Sanders moved for approval of payment of Utility Vouchers in the amount of $34,169.46. Misko seconded. Carried 6-0.
