ccm19920811CITY OF MUSKEG0 COMMON COUNCIL MINUTES OF MEETING HELD AUGUST 11, 1992 The meeting was called to order at 8:43 P.M. by Mayor Salentine. Also present were Aldermen Dumke, Misko, Patterson, Sanders, Schneider, and Taube, City Clerk Marenda, and Attorney Trindl. Alderman Simmons was absent. Patterson moved for approval of the Common Council minutes of meeting held July 28, 1992. Dumke seconded, carried. Reso. #204-92 - Resolution to amend the Final Resolution Levying Special Assessment #26-89. Dumke moved for adoption, Sanders seconded. Patterson moved to amend #1 and #3 to change "60 days" to "90 days". Misko seconded, carried. Resolution #204-92 as amended, adopted 6-0. Reso. #205-92 - Resolution as to Moratorium Resolution #149-92 (DeBack/Santi). Taube moved for adoption, Sanders seconded. Sanders moved to amend to add "subject to the condition that a restriction be placed on the RS-2 zoned portion to allow only one single family residence on this parcel." Taube seconded. Taube requested permission for Mr. Santi to address the Council. Permission granted. Santi stated he had certain tax considerations to be resolved and requested the matter be addressed at the time of the land division. Sanders withdrew his motion with the approval of the second. Motion to adopt Resolution #205-92 carried 6-0. Reso. #206-92 - Approval of Certified Survey Map -- Sawyer. Taube moved for adoption. Misko seconded. Carried 6-0. Reso. #207-92 - Approval of Certified Survey Map -- Palmer/Town of Norway. Taube moved for adoption. Patterson seconded. Carried 6-0. moved for adoption. Sanders Seconded. Carried 6-0. Reso. #208-92 - Approval of Legal Lot Status -- Brauer. Taube Ord. #765 - An ordinance to Amend the Zoning Map of the City of Muskego (RS-2 to 1-1 -- DeBack/Santi). First Reading. Recess declared at 9:15 P.M. Reso. #136-92 - Approval of Intergovernmental Cooperation Agreement for Hazardous Material Spill Services. On floor, deferred July 28, 1992. Memo from Clerk dated August 7, 1992, read indicating 100% participation by county municipalities has not been achieved and county researching other alternatives. Attorney Trindl indicated this is a policy decision and certainly the community would be taking some risks if insurance coverage is not available. Mayor was requested to communicate with the county, that the city is interested in participating in the program, but participate at this time. because of lack of insurance coverage we feel we are unable to Attorney Trindl was excused from the meeting at 9:45 P.M. COMMITTEE MINUTES Sanders presented minutes of Finance Committee Meetings held August 5, 1992, and August 11, 1992, and moved for acceptance. Patterson seconded, carried. Schneider presented Public Works Committee minutes of meeting held July 29, 1992 and moved for acceptance. Dumke seconded, carried. Misko presented Public Safety Committee minutes of meeting held August 6, 1992, and moved for acceptance. Sanders seconded, carried. Dumke presented Rules, Laws, Ordinance Committee minutes of meeting carried. held August 6, 1992, and moved for acceptance. Taube seconded, Plan Commission minutes of meeting held August 4, 1992, were received and placed on file. Ord. #756 - An Ordinance to Amend Chapter 16, Section 16.20 of the Municipal Code of the City of Muskego -- Plumbing Code: Sump pumps. Deferred 6/23/92. Dumke moved to amend (1) to change "not a roadside ditch" to "or to a roadside ditch". Carried. Ordinance #756 as amended, adopted 6-0. Ord. #763 - An Ordinance to Amend the Zoning Map of the City of Muskego (RS-2 to RSA -- Lemke) Second reading. Taube moved for adoption. Dumke seconded. Patterson reported he talked to neighbors and no one liked idea of duplexes in that area. Mayor people don't want duplexes due to potential of effect on stated Plan Commission recommended one duplex. Patterson responded neighborhood, additional children and repeated change of neighbors. Misko noted the RSA zoning would allow 4 family RS-2 (OD) to limit this property to one duplex or 2 single family structure. Mayor stated an amendment could be made to rezone to structures. Ordinance #763 defeated 5-1 with Patterson, Misko, Sanders, Schneider and Taube voting "no" and Dumke voting "yes". Ord. #764 - An Ordinance to Amend Chapter 21, Section 21.07 (8) and (ll), of the Municipal Code of the City of Muskego -- Sewer Utility: Annual Budget and Method of Payment of Charges. Second Reading. Sanders moved for adoption, Misko seconded. Carried 6-0. Project - Tess Corners Volunteer Fire Department Parking Lot Reso. #209-92 - Direct Public Works Superintendent to Bid Out Paving. Dumke moved for adoption, Sanders seconded. Carried. Reso. #210-92 - Appointment of Citizen Members to Blue Chip Economic Development Committee - Removed from agenda. Common Council Minutes August 11, 1992 Page 3 LICENSE APPROVAL Patterson moved for approval of Operator's Licenses subject to favorable police reports and required application fees for George Crawford. Sanders seconded, carried. Patterson moved for approval of Gathering Permit and Soda License for St Leonard's Church Variety Show, September 11-12, 1992. Misko seconded, carried 6-0. Patterson moved for approval of Gathering Permit, Soda License, Parade Permit and Temporary Operator's Licenses for Joanne Chaput, August 28-30, 1992, and to waive all associated fees. Taube Norman Chaput and Carrie Chaput for Muskego Community Festival, seconded, carried. Disposal Systems, BFI Waste Systems of Wisconsin, Expert Disposal Patterson moved for approval of Refuse Haulers Permits for Best Wisconsin, and Alley Cat, Inc. Sanders seconded, carried. Service, Inc., Laidlaw Waste System, Inc., Waste Management of Clerk directed to submit letter with license to Alley Cat informing them of complaints that they do not contain their trash on their trucks. VOUCHER APPROVAL Patterson moved for approval of payment of general vouchers in the amount $309,147.90. Dumke seconded, carried 6-0. Sanders moved for approval of payment of utility vouchers in the amount $533,939.25. Schneider seconded, carried 6-0. CITY OFFICIALS REPORTS Mayor reported attorney researching private/public contract for extension of Enterprise Drive. Mayor reported State Ways and Means Committee met today to discuss Impact Fees. Mayor reported he is working with Attorney Macy on how to proceed with house on the Lakeview Meadows site. As to Council action to delete sections of committee minutes, it was decided that the Council could move to disapprove action of the committee rather than "delete" the action. Due to no cable operator being present to televise the Council proceedings, Alderman Misko was requested to check with G. Jacobson. Mayor noted the preconstruction meeting for Plum Creek scheduled for August 12, 1992, has been cancelled and will be rescheduled. Common Council Minutes August 11, 1992 Page 4 Mayor reported that through informal discussion with the Safety Committee the Building and Plan Departments will be available during the hours of 12 - 3 to serve someone on an emergency basis by having the secretary take a phone message, arrange an appointment, or do a simple task. Mayor noted the City is a participant in the Waukesha County Block Grant Program until May of 1993, and not eligible for Wisconsin Development Funds until then. Determination will be made if application can be submitted prior to that date. The Clerk indicated complaints have been received on the increase in the cost of printed labels, lists etc. to .05$ per address. This matter will be placed on the Finance Committee agenda of August 19, implemented prior to Council approval of the minutes. Joe Sommers 1992, to review, and any action taken by that committee can be to present projection of costs and comparisons. Taube moved to adjourn at 11:OE PM. Schneider seconded, carried.
