ccm19920414CITY OF MUSKEGO COMMON COUNCIL MINUTES OF MEETING HELD APRIL 14, 1992 The meeting was called to order at 8:46 PM by Mayor Salentine. Also present were Aldermen Dumke, Patterson, Sanders, Simmons, and Taube, City Clerk Marenda, and Attorney Molter. Alderman Hilt was excused. Absent: 5th District, vacant. Dumke moved for approval of the Common Council minutes of meeting held March 24, 1992. Simmons seconded. Carried. COMMITTEE REPORTS Dumke presented Finance Committee minutes of meeting held April 8, 1992 and moved for acceptance. Sanders seconded. Carried. Simmons presented Public Works Committee minutes of meeting held March 26, 1992 and moved for acceptance. Dumke seconded. Carried. April 9, 1992 and moved for acceptance. Patterson seconded. Sanders presented Public Welfare Committee minutes of meeting held Carried. Plan Commission minutes of meeting held April 7, 1992 were received and placed on file. OLD BUSINESS Ord. #746 - An Ordinance to Amend the Zoning Map of the City of Muskego (EA to A -- Muskego Land Development/ Parker Road). Second Reading. Sanders moved for adoption, Taube seconded. Carried 5-0. Ord. #747 - An Ordinance to Amend Chapter 26, Section 26.02(1)(d), of the Municipal Code of the City of Muskego (Park & Recreation Regulations -- Alcohol Beverages). Second Reading. Dumke moved for adoption, Taube seconded. Simmons moved to amend Section 26.02(1)(d) to add new second sentence "No fermented malt beverage or wine with not more than 6% alcohol content may be consumed on any athletic field or playground apparatus area at any time," and to add "park, parkway," before "or recreational Ordinance #747 as amended adopted 5-0. facility" in new third sentence. Taube seconded, carried. NEW BUSINESS Reso. #85-92 - Approval of Final Plat, Subdivider's Agreement and Letter of Credit -- Creekside Meadows. Dumke moved for adoption, Sanders seconded. Carried 5-0. Reso. #86-92 - Removed from agenda. Reso. #87-92 - Authorization to Appeal the Final Audit Report of the DNR advised essentially City's methods of charging sewer usage the DNR, WI Fund Step 3 -- Manhole Rehabilitation Program. Noted comply with regulations. Molter asked Council to reserve right to file appeal by adopting resolution. Simmons moved for adoption, inserting "to file," Sanders seconded. Carried 5-0. Taube moved for adoption, Patterson seconded. Carried 5-0. Reso. #89-92 - Resolution Establishing Minimum Wage Scale. Dumke moved for adoption, Patterson seconded. Carried 5-0. Reso. #90-92 - Acceptance of Improvements -- Durhamswood, Durhamswood Addn. #1 and Durhamswood Addn. #2 Subdivisions. Dumke moved for adoption, Simmons seconded. Carried 5-0. Reso. #91-92 - Delegate the Jurisdiction of Luther Parker Cemetery. Dumke moved for adoption to designate Parks & Recreation Board, Simmons seconded. Carried 5-0. Reso. #92-92 - Designating 1991 Unexpended Capital Project Funds to be Carried Over into 1992. Dumke moved for adoption, Patterson seconded. Noted for road work on Hillendale north Hwy L. Carried 5-0. Reso. #93-92 - Approval of Certified Survey Map -- Siegmund/ Squires. Sanders moved for adoption, Simmons seconded. Taube questioned validity of Note on Map. Simmons moved to amend to add "Be it further resolved that the Note in the upper left-hand corner of the Certified Survey Map shall be changed to read "Note: At such time that Pasadena Drive would extend through this property, the property owner would have to obtain City approval of legal status of Parcels 2 and 3 east of Pasadena."" Patterson seconded. Carried 4-1, with Sanders voting "no." Resolution #93-92 as amended adopted 5-0. Reso. #94-92 - Approval of Legal Lot Status -- Wickert. Sanders moved for adoption, Simmons seconded. Carried 5-0. Reso. #95-92 - Approval of Revised Preliminary Plat -- Nordic Ridge (Town of Norway). Sanders moved for adoption, Dumke seconded. Simmons asked City Attorney how to start annexing procedures or get other suggestions to control growth. Mayor announced he intended to appoint a committee to study methods to control growth. Taube felt best people to study the growth issue are the elected officials. Carried 3-2, with Dumke, Patterson and Sanders voting "yes," and Simmons and Taube voting "no." Reso. #96-92 - Approval of Certified Survey Map -- Peterson. Sanders moved for adoption, Dumke seconded. Taube moved to defer to further review with City Attorney. Patterson seconded, carried. Reso. #97-92 - Re-Approval of Certified Survey Map -- Spitzner. Sanders moved for adoption, Dumke seconded. Carried 5-0. Municipal Code of the City of Muskego (Street Excavations). First Ord. #748 - An Ordinance to Amend Chapter 8, Section 8.04, of the Simmons seconded. Carried 5-0. Second Reading. Simmons moved for Reading. Taube moved to suspend rules to allow second reading, adoption, Taube seconded. Carried 5-0. Reso. #99-92 - Creating Position of Public Works/Utilities Secretary. Dumke moved for adoption, Taube seconded. Carried 5-0. Ord. #749 - An Ordinance to Amend the Zoning Map of the City of Muskego (RSA (conditional use) to 8-2 -- Kurer/Bushy's Pub). First Reading. Simmons moved to suspend rules to allow second reading. Patterson seconded. Carried 4-1, with Taube voting "no." Second Reading. Simmons moved for adoption, Patterson seconded. Simmons reported Atonement Lutheran Church representative expressed concern about use of the property in the future but has no objections to existing use of the tavern. Carried 5-0. Ord. #750- An Ordinance to Amend the Zoning Map of the City of Muskego (RS-3 to RS-3/0IP -- Kurth Park). First Reading. Ord. #751- An Ordinance to Amend the Zoning Map of the City of Muskego (RS-3/0PD to RS-3/0IP -- Muskego County Park). First Reading. Taube requested a letter be obtained from Waukesha County to assure Lake Forest people they are allowed access to the County Park by walking or biking. Mayor stated he will have the Parks Director clarify the right of City of Muskego residents to access Muskego County Park from the Lake Forest Subdivision. LICENSE APPROVAL Dumke moved for approval of Operator's License subject to favorable police reports for Janet Miech, John Rizzo, and Mark Grossmeier. Sanders seconded, carried. Dumke moved for approval of a Class "B" Fermented Malt Beverage & Memories). Simmons seconded. Carried 5-0. Intoxicating Liquor License -- Linda M. Karras (formerly Muskego Dumke moved for approval of Class "B" Gathering Licenses for Muskego Athletic Association -- Adult Baseball Tournament June 27-28, 1992. Taube seconded. Carried 5-0. VOUCHER APPROVAL Dumke moved for approval of payment of General Vouchers in the amount of $656,747.74. Taube seconded. Carried 5-0. Simmons moved for approval of payment of Utility Vouchers in the amount of $119,069.99. Sanders seconded. Carried 5-0. COMMUNICATIONS Mayor announced Common Council Organizational Meeting would be held on Tuesday, April 21, 1992 at 7:OO PM. Mayor reported on the progress of school impact fees.
