ccm19910212COMMON COUNCIL CITY OF MUSKEG0 MINUTES OF MEETING HELD FEBRUARY 12, 1991 The meeting was called to order at 7:40 P.M. by Acting Chairman Hilt. Also present were Aldermen Dumke, Patterson, D. Sanders, Marenda. Mayor Salentine arrived at 9:00 P.M. Alderman Taube H. Sanders, and Simmons, City Attorney Trindle and City Clerk was absent. H. Sanders moved for approval of the Common Council minutes of January 22, 1991. Patterson seconded, carried. A Proclamation was presented 16, 1991. COMMITTEE REPORTS H. Sanders presented Finance February 6 and February 12, Dumke seconded, carried. for DECA week February 10 - February 1991, and moved for acceptance. Committee minutes of meetings held Simmons presented Public Works Committee minutes of meetings held January 24, 1991 and moved for acceptance. Dumke seconded, carried. held February 6, 1991 and moved for acceptance. Patterson D. Sanders presented Public Welfare Committee minutes of meeting seconded, carried. Patterson noted Peltz will not wave past due paper bills but will agree to split 50/50. Consensus of Council newspaper balance, with payments made from the State Recycling agreed. Clerk directed to contact Peltz to work out the Fund. Motion carried. Simmons presented Rules, Laws and Ordinance Committee minutes of meeting held February 7, 1991, and moved for acceptance. Patterson seconded, carried. Simmons presented Public Safety Committee minutes of meeting held February 7, 1991 and moved for acceptance. Patterson seconded, carried. NEW BUSINESS Reso. 1/21-91 - Resolution Authorizing the Sale of $4,875,000 General Obligation Sewerage Bonds. Simmons moved for adoption. D. Sanders seconded. Financial Consultant Seegar Swanson presented background. All bidders were listed, with Bank One the successful bidder. Chair resumed by Reso. #22-91 - Establishing Salaries for Certain City of Muskego Employees for 1991. H. Sanders moved for adoption, Dumke seconded. Patterson moved to amend to add new starting salary of $32,000 for Director/Land Use Administrator effective upon retirement of current director. Carried 5-0. Resolution #22-91 as amended, carried 5-0. Reso. 823-91 - Approval of Counter-Offer to Purchase (R.J. Mueller Enterprises, Inc. - Muskego Industrial Park Addition). Patterson moved for adoption, D. Sanders seconded. Carried 5-0. Against Benefitted Property and Waiver of Special Assessment Reso. #24-91 - Final Resolution Levying Special Assessments Wood Road East of Bay Lane). D. Sanders moved for adoption, H. Notices and Hearing Under §66.60(18) (Water/Lake Point Estates - Sanders seconded. Carried 5-0. Reso. #25-91 - Approval of Temporary Habitation of a Trailer (Frank Kesserling). Patterson moved for adoption, D. Sanders seconded. Carried 5-0. Muskego Lake Dam Grant Application. Dumke moved for adoption, Reso. #26-91 - Authorizing City Engineer to Execute Little Patterson seconded. Carried 5-0. Reso. 827-91 - Commitment for Cost Sharing Little Muskego Lake Dam Project. Simmons moved for adoption, D. Sanders seconded. Carried 5-0. Reso. #28-91 - Directing City Attorney to Prepare Counter Offer to Purchase For Sale of City-Owned Land (Adjacent to Parks Garage). Simmons moved for adoption, H. Sanders. Dumke moved to amend paragraph 3 to fill in the blank with "$10,000" and add enclosure area and moving them to new property line with new "including removal of existing fences on property line and of conditional use, and providing survey if cornerstones cannot enclosure area, obtaining Plan Commission approval for expansion be located, with all expenses to be the responsibility of the purchaser." Carried 5-0. Resolution #28-91 as amended adopted 4-1 with Patterson voting "no". Mayor Salentine arrived and assumed the chair. Waukesha County. Hilt moved for adoption to "disapprove" due to Reso. #29-91 - Resolution as to Land Offered to the City by the property having a large WEPCO right-of-way through the property, sewer not available, property does not perc, it is Common Council Minutes February 12, 1991 - Page 3 triangular in shape, and has low soils. Dumke seconded. Carried 6-0. Reso. #30-91 - Authorizing Execution of Department of the Resources Investigation (Lake Denoon). D. Sanders moved for Interior Geological Survey Joint Funding Agreement for Water adoption, Simmons seconded. Carried 6-0. Reso. #31-91 - Directing the City Engineer to Prepare Plans and Specs and Bid Out the City Garage Addition Project. Dumke moved for adoption, Hilt seconded. Carried 6-0. Reso. #32-91 - Establishing Traffic Regulations. Patterson moved for adoption, Simmons seconded. Carried 6-0. Municipal Code of the City of Muskego Regarding the Adoption of Ord. /I706 - An Ordinance to Amend Chapter 9, Section 9.001 of the State Laws. First Reading. Ord. #707 - An Ordinance to Amend Chapter 9, Sections 9.11(1) and 9.26(2) of the Municipal Code of the City of Muskego Regarding the Prohibition of Loitering. First Reading. Simmons moved to Carried 6-0. Second Reading. Patterson moved for adoption, suspend rules to allow Second Reading. H. Sanders seconded. Simmons seconded. Carried 6-0. LICENSE APPROVAL Hilt moved for approval of Operator's Licenses for Reno Wichgers subject to receipt of favorable police reports. H. Deschaine, Ronald Erickson, Stephanie Kenney, and Charles Sanders seconded. Carried. Hilt moved for approval of "Class B" Fermented Malt Beverage & Intoxicating Liquor License for Giles E. Svehlek (Stufs). Dumke seconded. Carried 6-0. VOUCHER APPROVAL H. Sanders moved for approval of payment of general vouchers for $245,780.61. Hilt seconded. Carried 6-0. 1990 in the amount of $26,050.51 and for 1991 in the amount of Simmons moved for approval of payment of utility vouchers for 1990 in the amount of $7,306.58 and for 1991 in the amount of $57,434.90. D. Sanders seconded. Carried 6-0. CITY OFFICIALS' REPORTS Clerk acknowledged petition from Barker Homes for rezoning of I. Common Council Minutes February 12, 1991 - Page 4 property on Lannon Drive from RSM to RSM/OPD to allow planned February 26, 1991. Clerk also noted the Emerald Park negotiated agreement has been received and will be reviewed at the Council meeting on February 26, 1991. D.
