ccm19901211COMMON COUNCIL CITY OF MUSKEG0 MINUTES OF MEETING HELD ON DECEMBER 11, 1990. The meeting was called to order at 8:25 p.m. by Mayor Salentine. Also present were Aldermen Dumke, Hilt, Patterson, D. Sanders, H. Sanders, Simmons and Taube, City Attorney Molter and City Clerk Marenda. Hilt moved for approval of the Common Council minutes of November 27 and November 28, 1990. Patterson seconded, carried. Mayor read Notice of Closed Sessions as noted on the agenda. PERSONAL APPEARANCE Karen Reith, president of the Muskego Woman's Club, presented decorating ideas for the Muskego Room, including installation of an accordian divider, a series of cupboards, four file cabinets, chair dollies, and storage, a large media center with corkboard, magazine rack and trophy case, and wainscoating and wall covering, with a proposed budget of $15,000. No changes are being requested in the agreement between the Muskego Woman's Club hiring a contractor, they will be submitted to the Finance and the City currently in place. Once the plans are drawn for Committee for approval. CLOSED SESSION Hilt moved to go into Closed Session pursuant to §19.85(1)(c), Considering employment, promotion, compensation, or performance evaluation data of any public employee over which the governmental body has jurisdiction or exercises responsibility, more specifically as to discussion of the hiring of a Director of Information Systems. Dumke second. It was noted the Common Council would reconvene into Open Session for the purpose of continuing other business. Motion carried 7-0. Council reconvened into Open Session. COMMITTEE REPORTS H. Sanders presented Finance Committee minutes of December 5, 1990 and December 11, 1990 and moved for acceptance. Hilt seconded, carried. The Computer Committee was requested to present proposals for 1991 purchases to Finance Committee due to cost savings discounts. Plan Commission minutes of December 4, 1990 were received and placed on file. UNFINISHED BUSINESS Ord.#700 - An Ordinance to Amend Chapter 9, Section 9.26(2) of the Municipal Code of the City of Muskego - Loitering Near School Prohibited. On the floor, deferred 11/27/90. Attorney Molter advised changes are necessary and the ordinance is to be redrafted. Patterson moved to table. Simmons seconded, carried. Reso. f1287-90 - A Resolution Authorizing the City of Muskego to Borrow the Sum of $2,340,000 by issuing General Obligation and Authorizing the Sale of the Notes. Hilt moved for Promissory Notes pursuant to 67.12(12) of the Wisconsin Statutes adoption. H. Sanders seconded. Seegar Swanson presented bid information and noted Moody's continued A rating. Carried 7-0. Reso. #288-90 - A Resolution as to the City Water Assessment Sanders seconded, carried 7-0. (Racine/Gemini Water Projects). Hilt moved for adoption. D. Reso. 11290-90 - Approval of Subdivider's Agreement and Letter of Credit (Terra Development). Hilt moved for adoption. D. Sanders seconded. Hilt moved to include $341,296 financial guarantee on Page 10 of the Agreement. H. Sanders seconded, carried. It was noted this Agreement covers the apartments only and the storm drainage easement to be resolved by time of single family subdivider agreement approval. Simmons seconded, carried. Resolution #291-90 as amended adopted 7-0. Ord. #702 - An Ordinance to amend the Zoning Map of the City of Muskego from RS-2 to KS-2/0D (Vilah Davis). First Reading. Ord. #703 - An Ordinance to amend the Zoning Map of the City of Muskego from RS-2 to RS-2/0D (Craig Lawdanski). First Keading. Simmons moved to suspend the rules to allow Second Reading. Patterson seconded, carried 7-0. Second Reading. Simmons moved for adoption. D. Sanders seconded. Simmons recommended the violation of Code and that use should be discontinued; this use rezoning be denied due to the residence being used as a duplex in does not fit in with the surrounding area single family homes; this property is adjacent to a subdivision with strict deed sewered. Sanders presented the Plan Commission's unanimous recommendation to approve. H. Sanders moved to withdraw motion to allow action at the January 8, 1991 stated he would support the petitioners' request to deny. Taube meeting. LICENSE APPROVAL Hilt moved for approval of Operator's Licenses for Susan Krantz, Linda Laack, Dean LeRoy and Veronica Lavey. Dumke seconded, carried. Hilt moved for approval of Class B Fermented Malt Beverage and Intoxicating Liquor License for Club 24 (TPC Corp.). H. Sanders seconded, carried 7-0. VOUCHER APPROVAL Hilt moved for approval of payment of General Vouchers in the amount of $740,762.75. Dumke seconded, carried 7-0. Hilt moved for approval of Utility Vouchers in the amount of $1,174,436.06. Simmons seconded, carried 7-0. COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW Discussion followed on clarification of Safety Committee's policy on street lights. Taube explained where street lights are required at entrances to subdivisions, wood poles would be used. If other than wood poles are requested by the subdivider or required by the Plan Commission, they may be installed with all costs incurred for either pole to be the responsibility of the developer. CLOSED SESSION D. Sanders moved to go into Closed Session pursuant to §19.85(1) (e), Deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting bargaining reasons require a Closed Session, more specifically other specified public business, whenever competitive or concerning MMSD negotiations.
