ccm19901009COMMON COUNCIL CITY OF MUSKEG0 MINUTES OF MEETING HELD OCTOBER 9, 1990 were Aldermen Dumke, Hilt, Patterson, D. Sanders, H. Sanders and Called to order at 7:44 p.m. by Mayor Salentine. Also present Taube, City Attorney Molter and City Clerk Marenda. Ald. Simmons was absent. Dumke moved for approval of minutes of meeting held September 25, 1990. Hilt seconded, carried. COMMITTEE REPORTS Hilt presented Finance Committee minutes of September 26, 1990 and moved for acceptance. Dumke seconded, carried. H. Sanders presented Finance Committee minutes of October 3 and 9, 1990 and moved for acceptance. Hilt seconded. Taube requested individual consideration of paragraph regarding the Lekfield release of funds in the October 3rd minutes. Minutes of October 3, without said paragraph, and of October 9, 1990 approved. Taube moved to refer Lekfield paragraph back to Committee. Patterson seconded. After discussion, Taube was excused from meeting at 7:58 p.m. to obtain information regarding Lekfield. Action on motion delayed until his return. Dumke presented Public Works Committee minutes of September 27, 1990 and moved for acceptance. Hilt seconded, carried. October 9, 1990 and moved for acceptance. Hilt seconded, D. Sanders presented Public Utilities Committee minutes of carried. Plan Commission minutes of October 2, 1990 were received and placed on file. UNFINISHED BUSINESS Muskego (S-W - RS-3/0LS) Second reading. On floor, deferred Ord.#694 - An Ordinance to Amend the Zoning Map of the City of 9/25/90. D. Sanders moved to defer until further information obtained from DNR. Patterson seconded, carried. NEW BUSINESS Reso.#227-90 - Setting Public Hearing Date - 1991 Budget. Hilt moved for adoption. Dumke seconded, carried 5-0, with Taube absent . Reso.#228-90 - First Amended Relocation Order of the City of Muskego, Waukesha County, Wisconsin (Lake Denoon Sediment Removal Project). D. "L" Sewer Project - Assm. District "X"). Hilt moved for adoption. D. Sanders seconded, carried 6-0. Reso.#229-90 - Approval of Road and Drainage Plans - Meadow Green moved to amend to add "subject to approval of the Highway West Addn. #'2. Dumke moved for adoption. Taube seconded. Dumke Resolution #229-90, as amended, adopted 6-0. Superintendent and City Engineer". Taube seconded, carried. Reso.tZ30-90 - Rejection of Bid - Schultz Lane. Dumke moved for adoption. Patterson seconded. Property owners who are contributing to project will be contacted to determine their continued interest. Carried 6-0. Reso.#231-90 - Disallowance of Claim - Kevin Boehm. H. Taube seconded, carried 6-0. Reso.#235-90 - Approval of Preliminary Plat (Day Break Dumke seconded, carried 6-0. Subdivision - Town of Norway). D. Sanders moved for adoption. Reso.fl236-90 - Approval of Certified Survey Map (Dukleth - Town of Norway). D. Sanders moved for adoption. Hilt seconded, carried 6-0. Reso.#237-90 - Approval of Agreement Between City of Muskego and West Lake Development (Sewers). Hilt moved for adoption. Patterson seconded. Atty. Molter objected to the concept of Common Council Minutes October 9, 1990 - Page 3 entering into an agreement with a contractor when a Developer's Agreement is in place, and the developer is responsible for all the Agreement could be retained in the Letter of Credit, and not improvements. Atty. Molter stated the $10,000.00 referred to in released or a separate agreement could be negotiated. Patterson moved to amend to state "that the Council hereby states its intent to enter into an agreement with West Lake Development providing for a $10,000.00 Certificate of Deposit for a term of five years with interest payable during the term of the Certificate to be paid to the developer, with language to protect the City in the event the sewer fails within the five year period, and at the end of the five years to request an engineer conduct an inspection for that portion of the sewer line in issue to state its findings and any problems discovered in the operation of the system. BE IT FURTHER RESOLVED that the Mayor and Clerk are hereby authorized to sign the necessary document in the name of the City as prepared by the City Attorney." Taube seconded, carried 4-2, with Patterson, D. Sanders, H. Sanders and Taube voting "yes", and Hilt and Dumke voting "no". Resolution #237-90, as amended, adopted 6-0. LICENSE APPROVAL Hilt moved for approval of operator's licenses for Thomas Falesnik, Laura Schultz and Pablo Guardiola subject to favorable police reports. Dumke seconded, carried. VOUCHER APPROVAL Hilt moved for approval of payment of General Vouchers in the amount of $214,124.39. Dumke seconded, carried 6-0. Hilt moved for approval of payment of Utility Vouchers in the amount of $188,385.91. D. Sanders seconded, carried 6-0. CITY OFFICIALS' REPORTS With reference to West Lake Development, Atty. Molter stated that in his opinion it should be the philosophy of the City to deal with developers and not contractors, and that he did not want to be involved with requests for release of funds. If the City agreement using a Certificate of Deposit can be negotiated as doesn't want to hold the Letter of Credit open, a separate long as it is with the developer and not the contractor.
