ccm19900925COMMON COUNCIL CITY OF MUSKEG0 MINUTES OF MEETING HELD SEPTEMBER 25, 1990 were Aldermen Dumke, Hilt, Patterson, D. Sanders, Simmons and Called to order at 7:35 p.m. by Mayor Salentine. Also present Taube, City Attorney Molter and City Clerk Marenda. Alderman H. Sanders was absent. Hilt moved for approval of minutes of meeting held September 11, 1990. Dumke seconded, carried. Mayor read Notices of Closed Session as noted on the agenda. Clerk read the Mayor's veto message of Resolution #20Y-Y0. COMMITTEE KEPORTS Hilt presented Finance Committee minutes of September 20 and 25, 1990 and moved for acceptance. Dumke seconded, carried. Patterson presented Public Safety minutes of September 13, 1Y90 and moved for acceptance. Taube seconded, carried. D. Sanders presented Public Welfare minutes of September 13, 1990 and moved for acceptance. Patterson seconded, carried. Plan Commission minutes of September 18, 1990 were received and placed on file. UNFINISHED BUSINESS Ord.#694 - An Ordinance to Amend the Zoning Map of the City of Muskego (S/W - KS/3/0LS) On floor, deferred 9/11/90. D. Sanders moved to defer. Patterson seconded, carried. Muskego (EA/Kl to EA/K1 /OOS) Second reading. D. Sanders moved Ord.#695 - An Ordinance to Amend the Zoning Map of the City of for adoption. Simmons seconded. D. Sanders presented the position of the Plan Commission. Letter from R. Schaefer dated 9/25/90 read by Clerk presenting a summary of his position. Simmons spoke in favor. Dumke advised that residents are concerned about non-agricultural operation on the property. D. Sanders stated all calls he received expressed opposition to the rezoning. Hilt felt only way to control the operation is through the zoning change. Taube felt this use was a misapplication of 00s zoning, with this operation being more appropriate under business zoning in a different location. D. Sanders stated this was not setting the right precedent for this area. Mayor advised with the 00s overlay the Plan Commision has control of building. objections. Motion to adopt carried 4-2, site and operation plans. Simmons called for the question. No . Reso.#215-90 - Approval of Sewer Plans - JC Development. Simmons moved for adoption. D. Sanders seconded. Simmons moved to amend to add "subject to approval of City Engineer". Patterson seconded, carried. Resolution 11215-90, as amended, carried 6-0. Reso.#216-90 - Approval of Water Plans - JC Development. Hilt moved for adoption. Simmons seconded. Taube moved to amend to add "subject to approval of City Engineer". Patterson seconded, carried. Resolution t1216-90, as amended, carried 6-0. Reso.#217-90 - Authorize Additional Funding Delta Group - State Bank of Hales Corners. Hilt moved for adoption. Dumke seconded. Dumke moved to amend to add "anb, WHEREAS the Wisconsin Department of Development has recommended approval". Hilt seconded, carried. Resolution 11217-90, as amended, carried 6-0. Upon mutual consent, Resolution was placed back on the floor. Simmons moved to add "BE IT FURTHER RESOLVED that the Mayor and Clerk are hereby authorized to sign the necessary documents in the name of the City." Patterson seconded, carried. Keso.B221-90 - Approval of Amendment to Contract of Sale (Seitz Equipment & Rentals or Assigns - Industrial Park Addn.). Hilt moved for adoption. Dumke seconded, carried 6-0. Patterson advised after conferring with citizens, he wished to move to amend to establish SUNDAY, OCTOBER 28, 1990 1:00 - 3:3U P.M. for Halloween Trick-or- Treat hours. Simmons seconded, carried 6-0. Resolution #222-90, as amended, adopted 6-0. Reso.t223-90 - Approval of Sewer Plans - Meadow Green West Addn. moved to amend to add "subject to changes incorporated to be #2. Simmons moved for adoption. D. Sanders seconded. Simmons approved by Utility Superintendent and City Engineer." Patterson seconded, carried. Kesolution #223-90, as amended, adopted 6-0. Reso.AZ25-90 - Approval of Certified Survey Map (Nicholas - Town of Norway. D. Sanders moved for adoption. Hilt seconded, carried 6-0. LICENSE APPKOVAL Hilt moved for approval of operator's licenses for Craig Sayer, Christian Ward, Cheryl Mueller, Barbara Platek, Julie Faken, Paul Kiedrowski, Theresa Hey, Rodney Colburn, Diane Spencer and Gary Steinhart, subject to receipt of favorable police reports. Dumke seconded, carried. Hilt moved for approval of payment of General Fund vouchers in the amount of $2,680,281.88. Dumke seconded, carried 6-0. Simmons moved for approval of payment of Utility vouchers in the amount of $26,580.13. D. Sanders seconded, carried 6-0. COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHOKZZED BY LAW Dumke assured people on Schultz Lane that the City still intended to proceed with the road project, but that additional delays would occur due to the high bid received for the project. Hilt moved to convene into Closed Session pursuant to §19.85(1) (e), Deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a Closed Session, more specifically as §19.8591)(g), Confering with legal counsel for the governmental to contract negotiations with MMSD, and further pursuant to body who is rendering oral or written advice concerning strategy Common Council Minutes September 25, 1990 - Page 4 to be adopted by the body with respect to litigation in which it is or is likely to become involved, more specifically as to the MMSD and FLOW litigation. Hilt moved to convene into Closed Session pursuant to §19.85(l)(c), Considering employment, promotion, compensation or performance evaluation data of any public employe over which the more specifically as to labor negotiations. As to these matters, governmental body has jurisdiction or exercises responsibility, formal action may be taken in Closed Session. Patterson seconded, carried 6-0.
