MINUTES OF MEETING HELD DECEMBER 12, 1989
were Aldermen Dumke, Hilt, Patterson, D. Sanders, H. Sanders,
Called to order at 8:41 p.m. by Chairman Salentine. Also present
Simmons and Taube, City Attorney Molter and City Clerk Marenda.
H. Sanders moved for approval of minutes of November 28, 1989.
Dumke seconded, carried.
Mayor read the Notice of Closed Session noting the reference to
Open Session with Resolution #298-89 to be acted on in Open
the dispute with MMSD over sewer charges would be discussed in
Session, if necessary.
Mr. Ron Peters, on behalf of the Muskego Historical Society,
presented a memorial plaque honoring those individuals
responsible for the City's historical flags, with the plaque to
be displayed at City Hall.
COMMITTEE REPORTS
Hilt presented Finance Committee minutes of December 6 and 12,
1989 and moved for acceptance. Dumke seconded, carried.
D. Sanders presented Public Safety minutes of November 29, 1989
and moved for acceptance. Patterson seconded, carried.
Taube presented Rules, Laws & Ordinance Committee minutes of
November 29, 1989 and moved for acceptance. Patterson seconded,
carried.
Taube presented Public Works Committee minutes of November 30,
1989 and moved for acceptance. Dumke seconded. Taube moved for
individual consideration of paragraph 1, page 2 regarding oil
tank that is located in the state right-of-way on the Muskego
Volunteer Fire Company's property. Simmons seconded, carried.
Minutes unanimously approved without said paragraph. Letter from
John Ingersoll dated December 7th was presented by the Clerk, and I
since the issue of the oil tank was deferred back to Committee,
the letter was given to Ald. Taube for review at the next Public
Works Committee meeting.

Plan Commission minutes of December 5, 1989 were received and

Muskego to Discontinue and Vacate a Road Reservation Southwest of
Tess Corners Drive in the City of Muskego, Wisconsin (Deferred

Corners Volunteer Fire Department for the Year 1990. Dumke moved
for adoption. Patterson seconded, carried 7-0.
Reso.fl313-89 - Approval of Fire Protection Contract with Muskego
Volunteer Fire Company for the Year 1990. Patterson moved for
adoption. Taube seconded, carried 7-0.
Reso.t314-89 - Approval of 1990 Sewer Utility Budget. H. Sanders
moved for adoption. Simmons seconded. H. Sanders moved to amend
the budget with proposed amendments as submitted by the Clerk.
D. Sanders seconded, carried. Resolution #314-89, as amended,

Reso.#315-89 - Authorizing Execution of Health h Dental Contracts
for 1990. H. Sanders moved for adoption. Hilt seconded, carried

Reso.t316-89 - Approval of Contract Between Waukesha County
Department of Aging and City of Muskego for the Year 1990. Hilt
moved for adoption. H. Sanders seconded, carried 7-0.
Agreement (Hwy. 'L' Sewer Project). H. Sanders moved for

Reso.#318-89 - Amendment to 1989 Budget. Dumke moved for
adoption. Hilt seconded, carried 7-0.
Reso.fl319-89 - Authorizing Execution of the 1989-90 Labor
Agreement Between Local 2414, AFSCME (City Hall/Library Unit and
Telecommunicators) and the City of Muskego. Hilt moved for
adoption deleting the words "WHEREAS, the Finance Committee has
recommended approval." Simmons seconded, carried 7-0.
Reso.t320-89 - Resolution As to Offer to Purchase (Filocha -
Industrial Park Addn.) Patterson moved for adoption. Simmons
seconded. Hilt moved to amend to state that "buyer" be changed
to "seller" as to the party responsible for culvert
installation. D. Sanders seconded, carried. Resolution #320-89,
as amended, adopted 7-0.
Reso. #321-89 - Authorizing Execution of Easement Documents
(WEPCo. Parcel - Hwy. 'L' Sewer Project). H. Sanders moved for
adoption. D. Sanders seconded, cariied. 7-0.
Reso.U322-89 - Approval of Certified Survey Map (Feest). Hilt
moved for adoption. Dumke seconded, carried 7-0.
Reso.fl323-89 - Approval of Final Plat - Lake Brittany Estates Addn. #Z. gilt moved for adoption. Dumke seconded, carried 7-0.

Reso.11324-89 - Approval of Final Plat - Waubeesee Lake Park
Estates (Liberty Development - Town of Norway). Hilt moved for
adoption. D. Sanders seconded. Taube asked that the Clerk's
Office determine how the Muskego-Norway School District is kept
abreast of new developments in their district. Resolution
adopted 7-0.
Reso.#325-89 - Resolution Indicating City's Present Intent to
Approve the Concept of RSM/OPD Zoning Proposed by John Groh (NE
1 /4 of Section 5). Hilt moved for adoption. D. Sanders
seconded. H. Sanders stated he would keep neighboring property
owners informed of pending Plan Commission action. Dumke stated
Hilt stated that Mr. Groh has re-done his original plan for this
that he felt 8 eight-families were too large for this parcel.

density. Resolution #325-89 adopted 6-1 with Dumke voting "no".

of the City of Muskego (Elected Officials) First reading.
Ord.#670 - An Ordinance to Amend Chapter 1 of the Municipal Code
of the City of Muskego (Location of Polling Place - District 3)
First reading. Taube moved to suspend the rules to allow for
second reading. Patterson seconded, carried . Second reading.
Taube moved for adoption. Patterson seconded. Clerk clarified
Ordinance 11670 adopted 7-0.

Ord./1672 - An Ordinance to Amend the Zoning Map of the City of
Muskego (DeBack - EA to R-1) First reading. D. Sanders moved to
suspend the rules to allow for second reading. Taube seconded.
Second reading. D. Sanders moved for adoption. Taube seconded,
carried 7-0.
LICENSE APPROVAL
Hilt moved for approval of operator's licenses for Andrew
Volanski. Lawrence Unz. Gene Massaro, Dianna Bergrnann, Richard
Powers, Karen Vanselow, James Lange and Susan Neal subject to
favorable police reports. H. Sanders seconded, carried.
VOUCHER APPROVAL
Hilt moved for aoDroval of General Vouchers in the amount of
$259,002.93. Du%e seconded, carried 7-0.
H. Sanders moved for approval of Utility Vouchers in the amount
of $4,334.63. Simmons seconded, carried 7-0.

COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW
Simmons moved to convene into Closed Session pursuant to to
519.85 (l)(g), Confering with legal counsel for the governmental
body who is rendering oral or written advice concerning strategy
to be adopted by the body with respect to litigation in which it
