ccm19891024COMMON COUNCIL CITY OF MUSKEG0 MINUTES OF MEETING HELD OCTOBER 24, 1989 were Aldermen Dumke, Hilt, Patterson, D. Sanders, H. Sanders and Called to order at 8:lO p.m. by Chairman Salentine. Also present Taube was absent. Simmons, City Attorney Molter and City Clerk Marenda. Alderman Hilt seconded, carried. Patterson moved for approval of minutes of October 10, 1989. Mayor Salentine noted a Closed Session would be held regarding re-classification of the bookkeeping position following completion of Miscellaneous Business. Mayor Salentine requested a moment of silence in memory of Ray Wallner, a former Alderman, who passed away. COMMITTEE REPORTS Hilt presented Finance Committee minutes of October 18 and 24, 1989 and moved for acceptance. H. Sanders seconded, carried. Simmons presented Public Welfare Committee minutes of October 11, 1989 and moved for acceptance. Patterson seconded, carried. Plan Commission minutes of October 3, 1989 were received and placed on file. UNFINISHED BUSINESS Reso.#232-89 - Proceeding by the Common Council of the City of Muskego to Discontinue and Vacate a Part of Darcy Court in the City of Muskego, Wisconsin (Introduced 9/12/89). D. Sanders moved for adoption. Dumke seconded, carried 6-0. Ord.#665 - An Ordinance to Amend Chapter 12.01(3)(b)2. of the Municipal Code of the City of Muskego (Gathering Permit Fee). Second reading. D. Reso.8277-89 - Resolution Indicating City's Present Intent to Approve the Concept of RSM(0PD) Zoning Proposed by Reinhold Baehring (Lutherans Inc. for Elderly L.I.F.E.) Hilt moved for adoption. H. Sanders seconded. Mayor noted this property would have tax-exempt status and asked for the Council's intent regarding payment for services in lieu of taxes. He stated it was his philosophy that since a present retirement facility in the City does not pay, a similar facility should not be required to pay. He added there is a bill in the Legislature now which would require payment for services from tax-exempt facilities. Simmons requested petitioners be permitted to speak. No objection was heard. A L.I.F.E. representative stated they would be prepared to accept the possibility of paying costs of services if the law is passed, but have not discussed if the City would require a voluntary payment now. The L.I.F.E. representative be dissolved, it possibly would be turned over to the Evangelical indicated that their by-laws state that should their organization Wisconsin Lutheran Synod for operation. Mayor noted the parkway through this parcel had been recommended for removal by the Plan Commission, and the Plan Commission recommended rezoning. Simmons called for the question. No objection was heard. Motion carried 6-0. By unanimous consent the Council agreed to add thought all retirement homes in the City should be treated alike "with consent of developer" to Resolution. Hilt added that he with regard to payment for services. No other views were presented. Ord.fI666 - An Ordinance to Amend the Zoning Map of the City of Muskego (Vangaard Builders - RS-1 to RS-2(0PD). First reading. Hilt noted Plan Commission recommended denial of this zoning change. - .- . Laurie Edmundson, Kenneth Shramek, Judith Grenz, Steven Jacomet and Shirley Wittenburg subject to favorable police reports. Patterson seconded, carried. VOUCHER APPROVAL Hilt moved for aDDroval of Davment of General Vouchers in the amount of $162,633:33. Dumke seconded, carried 6-0. H. Sanders moved for approval of payment of Utility Vouchers in the amount of $102,912.26. D. Sanders seconded, carried 6-0. COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW Clerk noted a special Common Council meeting would be held at 6:30 p.m. on November 1, 1989 to review proposed methods of charging sewer usage for multi-family. Clerk acknowledged receipt of petition from Alois Stefaniak to Hearing to be held on November 14, 1989 at 7:25 p.m. Petition rezone property on College Avenue from RSE to R-3 with Public referred to Plan Commission for review and recommendation. Patterson requested the Department of Public Works be asked to recent storm. Dumke asked to contact the Department of Public Works. H. Sanders moved to convene into Closed Session pursuant to performance evaluation data of any public employe over which the §19.85(l)(c), considering employment, promotion, compensation or governmental body has jurisdiction or exercises responsibility, more specifically as to consideration of the re-classification of the bookkeeping position. Patterson seconded, carried 6-0. Meeting reconvened into Open Session. H.
