Also present were Aldermen Dumke, Hilt, Patterson, Penovich (excused at 7:40 P.M.), Repischak, Sanders and Taube, City Clerk Marenda and City Attorney Molter. Penovich moved to approve minutes of meeting held March 14, 1989. Dumke seconded, carried. COMMITTEE REPORTS Hilt presented minutes of Finance Committee meeting of March 22, 1989 and moved for acceptance. Dumke seconded, carried. Repischak presented minutes of Public Utilities Committee of March 16, 1989 and moved for acceptance. Sanders seconded, carried. The Clerk presented minutes of Finance Committee meeting of March 28, 1989. Hilt moved for acceptance. Dumke seconded, carried. Sanders presented minutes of Public Works Committee meeting of March 23, 1989 and moved for acceptance. Taube seconded, carried. UNFINISHED BUSINESS Reso.ft63-89 - Approval of Certified Survey Map (Narlock). Hilt moved for reconsideration. Taube seconded, carried 6-0. Taube moved to amend to approve map submitted with revision date of 3/23/89. Patterson seconded, carried. Sanders moved to amend to add to 7th paragraph, "and receipt of the deed restriction agreement as to parcel one, and all related costs of said agreement acceptable to the City whereby the Developer agrees to Hillendale Drive, in front of this parcel". Repischak seconded, pay the front foot sewer assessment if sewer is ever installed in carried 6-0. Resolution #63-89, as amended, adopted 6-0. Ord.#635 - An Ordinance to Amend the Zoning Map of the City of Muskego (Miech - R-2 to R-2(00S) Second reading. Durnke moved for adoption. Hilt seconded. Mayor noted the Zoning Officer has assured the City it has control over the use of this property through Building, Site and Operation Plan approval by the Plan Commission. Motion carried 6-0. Ord.W636 - An Ordinance to Amend Chapter 18, Section 10.2, 10.3, T0.6 & 10.8 of the Municipal Code of the City of Muskego (Fees) Second reading. Sanders moved for adoption. Hilt seconded. Patterson expressed concern that Muskego's charges are at the low Common Council Minutes 3/28/89 - Page 2 end compared to other communities. Motion carried 5-1, with Patterson casting the only dissenting vote. Ord.8637 - An Ordinance to Amend Chapter 17, Section 3.06, 3.07, Muskego (Fees) Second reading. Patterson moved for adoption. 3.08, 6.02, 6.07 & 6.12 of the Municipal Code of the City of Hilt seconded, carried 6-0. Ord.#638 - An Ordinance to Amend Chapter 20, Section 20.07 of the Municipal Code of the City of Muskego (All Terrain Vehicles) Second reading. Hilt moved for adoption. Sanders seconded. Taube expressed concern about the differences in the safety characteristics between 3 & 4 wheel ATVs, and noted this ordinance does not differentiate between them. Patterson moved to defer for one month. Taube seconded. Hilt reviewed the State Statutes governing ATVs noting they do not differentiate between 3 h 4 wheel ATVs and requested action to conform with State Repischak and Sanders voting "no"; Patterson and Taube voting law. The motion to defer was defeated 4-2 with Dumke, Hilt, Vehicles the words "with 4 or more wheels". Taube seconded. "yes". Repischak moved to amend to add after All Terrain Motion to amend was defeated 4-3 with Mayor casting the tie- breaking vote. Voting "no" were Dumke, Hilt, Sanders and Mayor Salentine. Voting "yes" were Patterson, Repischak and Taube. Ord.f/638 was adopted 4-2, with Dumke, Hilt, Repischak and Sanders voting "yes"; Patterson and Taube voting "no". Ord.#639 - An Ordinance to Amend Chapter 12, Section 12.18 of the Municipal Code of the City of Muskego (Alarm Permits) Second reading. Dumke moved for adoption. Hilt seconded, carried 6-0. NEW BUSINESS Reso.t67-89 - Proceeding by the Common Council of the City of Muskego to Discontinue and Vacate a Part of McShane Drive in the City of Muskego, Wisconsin was introduced and the Public Hearing scheduled for May 9, 1989 at 7:20 P.M. Reso.A68-89 - Resolution Amending Assessment Policy for Construction of Water Mains Sanders moved for adoption. Repischak seconded. Unanimous consent to defer until passage of Final Resolution #69-89. Reso.#69-89 - Final Resolution Authorizing Installation of Water Property (Valley/Ann Drive Water Main Assessment Area - Assmt. Improvements and Levying Special Assessments Against Benefited District WF, Project MW-7-89) Sanders moved for adoption. Repischak seconded. It was noted that upon the Utilities Committee's recommendation, the new development would pay the average for their lateral cost and the existing development would pay the average for their cost. Motion carried 6-0. Reso.872-89 - Authorizing Expenditure of Funds - Defibrillation Program. Hilt moved for adoption. Dumke seconded. Taube questioned financing by borrowed money rather than Contingency. Repischak questioned the need for 8 units. Taube suggested all police officers be trained to use equipment. Resolution set aside to review Borrowing Resolution #80-89. LICENSE APPROVAL - Hilt moved for approval of operator's licenses for Joann Karklus, Suzanne Hudziak, Ronald Booher, Lynn Theys, Amber Wetzel and Christine Shaver. Dumke seconded, carried. Hilt moved for approval of "Class A" Fermented Malt Beverage h Intoxicating Liquor License for Evangelos Skodras (Crossroads Food h Beverage) contingent upon existing license for that premise being relinquished.
