MINUTES OF MEETING HELD OCTOBER 25, 1988
Called to order by Chairman Salentine at 7:50 p.m. Also present
were Aldermen Dumke, Hilt, Patterson, Penovich, Sanders, Taube
and Repischak, City Attorney Molter and City Clerk Marenda.
Penovich moved, Dumke seconded, to approve minutes of meeting
held October 11, 1988.
PERSONAL APPEARANCE
Sprague & Co. presented the 1987 TIF report.
Don Vilione of the City's auditing firm of Conley, McDonald,
COMMUNICATIONS FROM THE MAYOR'S OFFICE
Alderman Hilt announced that all citizens are invited by the Park
on Wednesday, October 26, 1988 at 3:30 p.m at Pioneer Drive and
& Recreation Board to attend the grand opening of the bike trail
the Horn Park entrance.
COMMITTEE REPORTS
Penovich presented Finance Committee Minutes of October 12, 19
and 25, 1988 and moved for acceptance. Hilt seconded, carried.
Sanders presented Safety Committee Minutes of October 13, 1988
and moved for acceptance. Taube seconded, carried.
Taube presented Public Welfare Minutes of October 13, 1988 and
moved for acceptance. Patterson seconded, carried.
Repischak presented Public Utilities Minutes of October 20, 1988
and moved for acceptance. Sanders seconded, carried.
UNFINISHED BUSINESS
Reso.#223-88 - Approval of Method of Financing - Smart Money
Program (on floor - deferred 10/11/88). Penovich moved to amend
to insert Option 2 as the Council's choice for financing. Hilt
seconded, carried. Resolution il223-88, as amended, carried 7-0.

Penovich moved for adoption. Hilt seconded, carried 7-0.
Reso.A234-88 - Support of HAWS Location. Patterson moved for
adoption. Taube seconded, carried 7-0.
Reso.#235-88 - Approval of Extension of Agreement Between
DeBack/Lekfield and City of Muskego. Penovich moved for
adoption. Dumke seconded. Penovich moved to amend the eighth
paragraph to delete "and other similar" in the first sentence and
to add "$3,000" and change the word "said" to "other" in the
second sentence. Dumke seconded, carried 7-0. It was agreed to
request G. P. Lee to mark the map shown as Exhibit A-1 to more
clearly define the phases of operation. Taube reviewed many
items he felt were missing from the documents. Atty. Steimel
City Engineer and G. P. Lee has only been changed to indicate the

areas to be completed in phases. Taube felt the City should
receive a benefit from this operation since the removal of
valuable clay will occur, and asked about a voluntary tippage
fee. Atty. Molter stated that the State of Wisconsin does not
permit cities to impose taxes which are not authorized by the
State. The City does not have the right to charge tax for
mutual agreement to delete the words "on Phase 2" and insert at
removal of clay. The Council agreed to amend Exhibit A-1 by
the end "of entire premises subject to this agreement not
previously restored." Resolution A235-88, as amended, adopted 6-
1 with Taube voting "no".
Reso.8236-88 - Proceeding by the Common Council to Discontinue

Reso.#237-88 - Approval of Concept of Amending Deferred Sewer
Assessment Policy. Sanders moved for adoption. Dumke
change in policy. After much discussion Hilt called for the

CITY OFFICIALS' REPORTS
The Clerk noted public hearings will be held on November 8, 1988 to
consider the rezoning requests of Lawrence Stefaniak and Robert
Hoormann.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW
Patterson noted that Halloween will be celebrated on Sunday, October
30, 1988 from 1:OO-4:00 p.m. and asked everyone to have a fun and safe
Trick-or-Treat.
The following provisions for the transfer of the cable franchise to
Star Cablevision were determined:

Have Star accept current ordinance as is, including responsibility
for existing lease, cable rules, etc.
Ingersoll bond will not be released until all existing unburied
cable is buried.
New drops must be buried within 14 working days.
Request Star to appear before the Welfare Committee prior to any
rate and/or service changes.
All City expenses relating to transfer to be responsibility of
Star.
Require entire City of Muskego to be wired by February 28, 1989.
Atty. Molter to present to Council for approval: Consent
Ordinance and other responsibilifies, and clarification of when
Resolution; Agreement between Ingersoll and Star; Acceptance of
franchise ends.
Patterson moved to adjourn at 10:20 p.m. Repischak seconded, carried.
