ccm19880412COMMON COUNCIL CITY OF MUSKEG0 MINUTES OF MEETING HELD APRIL 12, 1988 Called to order by Chairman Salentine at 7:45 P.M. Also present were Aldermen DeAngelis, Dumke, Hilt, Patterson, Penovich, Sanders and Taube, City Clerk Stewart and City Atty. Molter. Patterson moved, Hilt seconded, to approve minutes of meeting held 3/22/88. Carried. COMMUNICATIONS FROM MAYOR'S OFFICE Reso.#67-88 - Recognition of E. J. Salentine for his Services to the Tess Corners Volunteer Fire Department. Patterson moved for adoption. Dumke seconded, carried 7-0. E. J. Salentine was present to accept resolution. Mayor noted that the Green-Up, Clean-up event sponsored by the Chamber of Commerce on May 21 and 22 would also include Recycling. He encouraged everyone to help promote this event. Resolutions 1\72-88 and 1\75-88 were removed from the agenda. COMMITTEE REPORTS Penovich presented minutes of Finance Committee meetings held 4/6/88 and 4/12/88 and moved for acceptance. Hilt seconded, carried. Dumke presented minutes of Public Sewer Committee meeting held 3/24/88 and moved for acceptance. Sanders seconded, carried. and moved for acceptance. Patterson seconded. Patterson advised Sanders presented minutes of Public Safety Committee dated 4/7/88 Isle to attend their next meeting to voice their opinions. the Park Board invited those interested in boat parking at Idle Minutes of Plan Commission meeting held 4/5/88 were received and placed on file. UNFINISHED BUSINESS Reso.#13-88 -Modifying the Engineer's Report on Reserve Capacity Assessments Adopted by Resolution W169-84 As To Certain Future Multiple Family Units (On floor-deferred 1/26/88). Taube objected to the reduction of REC's for multi-family units, and submitted calculations and comparisons in support of his objection. Hilt felt reduction called for. Dumke moved that the Rules, Laws and Ordinance Committee submit recommendations to the Council on how to give assistance to those Common Council Minutes 4/12/88 - Page 2 Reso.#13-88 (cont'd.) who must pump their septics/holding tanks because they can't have sewers; and to review the REC charnes to determine if there is an excess-of funds which would permit-a reduction of sewer usage charges to all sewer users. Taube seconded. Mayor Salentine turned to chair over to Ald. DeAngelis. Mayor felt usage charge able to stay at $375 due to the RCA fees being collected. Also felt the sewer users should pay all costs for sewer and not subsidize non-sewer users. Patterson suggested this matter be motion. Motion defeated 6-1 with Dumke casting only "yes" vote. reviewed by Utilities Committee, and Dumke agreed to correct Sanders spoke in favor of the reduction to encourage multi-family Dumke, Hilt, Penovich and Sanders voting "yes" and DeAngelis, construction. Motion to adopt Reso. #13-88 carried 4-3 with Patterson and Taube voting ''no''. Ord.#603 - An Ordinance to Amend Chapter 16 of the Municipal Code Patterson moved for adoption. Penovich seconded, carried 7-0. of the City of Muskego (Plumbing Code). Second Reading. Ord.11604 - An Ordinance to Amend Chapter 12.16 of the Municipal Code of the City of Muskego (Swimming Pool Fees). Second Reading. DeAngelis moved for adoption. Sanders seconded, carried 7-0. Ord.11605 - An Ordinance to Amend Chapter 25, Section 25.04 of the Municipal Code of the City of Muskego. Second reading. DeAngelis moved for adoption. Hilt seconded. Patterson moved to add: "25.04(1) (a) and (b) remain the same". DeAngelis seconded, carried. Ord. 11605 As Amended adopted 7-0. Ord.11606 - An Ordinance to Amend Chapter 12, Sections 12.01(5) and (6) for adoption. Hilt seconded, carried 7-0. (Alcoholic Beverages). Second Reading. DeAngelis moved 0 NEW BUSINESS Reso.1168-88 - Resolution Indicating City's Present Intent to Approve the Concept of RS-Z/L/SW/W (OPD) Zoning Proposed by Gregory Boehm (Meadow Green West). Penovich moved for adoption. Hilt seconded. Dumke moved to defer to review the concerns expressed at the public hearing. DeAngelis seconded. Taube asked that the issues be addressed of the quality of subcontractors plus what is the City's policy of filling of wetlands under their control and what can be done to assure drainage problems are not created by .disturbing the subsoils. Mayor advised that we're now reacting to a concept of rezoning and we don't have the information requested. Atty. Molter stated there are protections built into our ordinances and Subdividers Agreements that should prevent problems with any subdividers in Common Council Minutes 4/12/88 - Page 3 Reso.#68-88 (cont’d) properly completing their project. The motion to defer carried 7-0. Reso./69-88 - Approval of Amendment to Offer to Purchase adoption. Sanders seconded, carried 7-0. (Johnson-Industrial Park Addn. No. 1). Hilt moved for Reso.#70-88 - Approval of Certified Survey Map (E.Huckstorf-Town of Norway). Penovich moved for adoption. DeAngelis seconded, carried 7-0. Ord.#607 - An Ordinance-to Amend the Zoning Ma of the City of Muskego (Kosobucki - RS-Z/RSA/B-4 to RS-2 (OPDP. First Reading. Reso.#71-88 - Approval of Final Plat and Subdividers Agreement seconded. Penovich moved to defer for two weeks at request of (Golden Country Estates). Penovich moved for adoption. Hilt developer. Patterson seconded, carried. Reso.#73-88 - Acceptance of Quote for Forced Sewer Hook-Up (Irish Spring House). Sanders moved for adoption. Dumke seconded, carried 7-0. Reso.174-88 - Disallowance of Claim (Robert Schumann). Dumke moved for adoption. Penovich seconded, carried 7-0. LICENSE APPROVAL - Penovich moved for approval of Operator‘s Licenses for Kelly Shawhan, Patricia Doucelle, William Pratt, Judith Sharrow, Jeffery Klernp, Robin Karrick and Laura Schulty. Dumke seconded, carried. 0 Penovich moved for approval of Class B Fermented Malt Bevera e and Intoxicating Liquor License for Marilyn Hansen, W125 S97 8 6 North Cape Rd. Dumke seconded, carried 7-0. Penovich moved for approval of Class B Fermented Malt Beverage License for Checker’s Pizza and Subs, Inc., S76 W17969 Janesville Rd. with restriction “No Home Delivery”. Taube seconded, carried 7-0. Penovich moved for approval of Alarm System Permit for Accurate Tool & Die. Dumke seconded, carried. VOUCHER APPROVAL - Penovich moved for approval of payment of General Vouchers in amount of $174,928.86. Hilt seconded, carried 7-0. Sanders moved for approval of payment of Sewer Utility Vouchers in amount of $30,934.52. Hilt seconded, carried 7-0. CITY OFFICIAL'S REPORTS - Taube requested that all future public hearing notices include the name of the property owner, coordiGate location and map. DeAngelis submitted his resignation as 6th District Alderman effective upon selection of his replacement. Council determined selection would be made by them throu h the interview process. Taube moved to advertise in The Sun 4 7 21/88 and 4/28/88 with interviews to be held at a Special Council meeting on May 4, 1988 at 7:OO P.M. Patterson seconded, carried 7-0.
