Also present Sanders and Taube, Deputy Clerk Marenda and City Atty. Molter. Penovich moved, Dumke seconded, to approve minutes of meeting held 12/8/87. Carried. COMMUNICATIONS FROM MAYOR'S OFFICE Reso.#255a-87 - Recognition of Public Works Superintendent Willard Bertram upon his Retirement after 36 years of service. Dumke moved for adoption. Taube seconded, carried. Supt. presentation of the framed resolution. Bertram was thanked for his services and accepted the COMMITTEE REPORTS Penovich presented minutes of Finance Committee meetings held 12/16/87 and 12/22/87 and moved for acceptance. Hilt seconded, carried. 0 Committee meeting held 12/7/87 and moved for acceptance. Patterson presented minutes of Rules, Laws and Ordinance DeAngelis seconded. Patterson spoke in opposition to increasing the delinquent personal property tax penalty to 1.5%. Carried. Dumke presented minutes of Public Sewer Committee meeting held 12/10/87 and moved for acceptance. Sanders seconded. Taube expressed concern about the change in REC chart for multi-family. Carried. UNFINISHED BUSINESS Reso.#250-87 - Approval of Certified Survey Map (H.Hampe). Penovich moved for reconsideration due to change in CSM. Hilt before CSM in 113. Patterson seconded, carried. Reso. #250-87 As seconded, carried. Penovich moved to amend to insert "amended" Amended adopted 7-0. Ord.#590 - An Ordinance to Amend Chapter 28, Section 28.05 of the Municipal Code of the City of Muskego (Water Utility). Second Reading. Hilt moved for adoption. Sanders seconded. Atty. Molter recommended that the current language remain in (4)(f) except for No. 2. Hilt moved to amend Ord. 590 to amend 28.05(4)(f)2. to read as follows: 2. Owner or applicant applies to the City and/or other applicable governmental entity and seconded, carried. Ord. #590 As Amended adopted 7-0. receives a permit for the construction of the new well. DeAngelis moved for adoption. Taube seconded. DeAngelis moved to amend to add to Section 1: "If a property has storm sewer, if available." Hilt seconded, carried. Atty. curb and gutters, the property shall hook up directly to the Molter interpreted ordinance to exclude existing connections at this time, unless there is a public nuisance involved. Reso.#263-87 - Resolution Withdrawing Approval of the Stormwater Drainage and Flood Control Policy Plan for the Milwaukee Metropolitan Sewerage District. -Sanders moved for adoption. DeAngelis seconded, carried 7-0. Reso.#264-87 - Authorizing Execution of Special Assessment Agreement Between City of Muskego and Robert Klenz. Hilt moved for adoption. Dumke seconded. Sanders seconded, carried. Ald. Patterson was requested to have the Parks and Recreation Board make a determination as to the status of the City-owned land at the end of Parkland Dr. Extended. Reso. #264-87 As Amended adopted 7-0. Reso.1265-87 - Preliminary Resolution Declaring Intent to Exercise Special Assessment Police Powers Under Sec. 66.60, Wis. Stats. As To Sanitary Sewer Assessment Area for Project MSS-1-88 (Hillendale Sewer Project). Sanders moved for adoption. Penovich seconded, carried 7-0. Reso.8266-87 - Approval of Carrier for City's General Liability seconded. Penovich moved to amend to add: "...with $1,000,000 Insurance (Wausau Ins.). Penovich moved for adoption. Hilt general liability and $500,000 underlying auto coverage." Taube seconded, carried. Reso. #266-87 As Amended adopted 7-0. Reso.#267-87 - Approval of Carrier for City's Property Insurance (State of Wisconsin). Dumke moved for adoption. Penovich seconded, carried 7-0. Reso.#268-87 - Approval of Change in Police Department's Authorized Strength. Penovich moved for adoption. Dumke seconded, carried 7-0. Reso.#269-87 - Creating the Positions of Utility Superintendent and Utility Maintenance Man. Hilt moved for adoption. Sanders seconded. Patterson moved to amend to change title of Utility Superintendent to Utility Foreman. Taube seconded. Motion defeated 4-3 with DeAngelis, Hilt, Penovich and Sanders voting "no" and Dumke, Patterson and Taube voting "yes". Reso. 8269-87 adopted 7-0. Reso.1270-87 - Authorizing Execution of the 1988 Labor Agreement Between the Employees of the Public Works Department and the City of Muskego. Dumke moved for adoption. Sanders seconded, carried 7-0. Reso.F271-87 - Removed from agenda. Reso.#272-87 - Authorizing the Expenditure of Funds - Telephone Dialer - Woodland Court Lift Station #9. Sanders moved for adoption. Patterson moved for adoption. DeAngelis seconded. Taube moved to amend to delete "on January 26, 1988". DeAngelis seconded, carried. Reso.#273-87 As Amended adopted 7-0. Reso.#274-87 - Approval of Holding Tank (A.Meinen, Jr.). Patterson moved for adoption. Penovich seconded, carried 7-0. Reso.#275-87 - Directing the City Attorney to Amend the Reserve Capacity Assessment REC Chart. Sanders moved for adoption. Hilt units. Felt if decrease to be made, should also include single seconded. Taube opposed decreasing REC charge for multi-family family residences. Mayor felt decrease in multi-family REC charge needed to encourage construction of multi-family units. Motion carried 5-2 with Dumke, DeAngelis, Hilt, Penovich and Sanders voting "yes" and Patterson and Taube voting "no". Ord.#592 - An Ordinance to Increase Penalty on Delinquent Personal Property Tax Assessments. First reading. Dumke moved to suspend rules to allow second reading. DeAngelis seconded, voting "yes" and Patterson and Taube voting "no". Second carried 5-2, with Dumke, DeAngelis, Hilt, Penovich and Sanders Motion carried 4-3 with DeAngelis, Hilt, Penovich and Sanders reading. DeAngelis moved for adoption. Sanders seconded. voting "yes" and Dumke, Patterson and Taube voting "no". LICENSE APPROVAL - Penovich moved for approval of Operator's Licenses subject to favorable police reports for Louis Majewski and Larry Wieser. Dumke seconded, carried. Penovich moved for approval of Gathering Permit and Races on Ice Permit for Icetronauts - 1/30/88, Hunter's Nest (Big Muskego Lake). Taube seconded, carried. Penovich moved for approval of Races on Ice Permit for Badger State Vettes - 1/17/88, Lakeview (Little Muskego Lake). Hilt seconded, carried. Penovich moved for approval of transfer of Neome Schaumberg Tess Corners Dr. Hilt seconded, carried 7-0. "Class A" license from S66 W14512 Janesville Rd. to W145 S6645 0 VOUCHER APPROVAL - Penovich moved for approval of payment of General Vouchers in amount of $404.753.65. Hilt seconded, carried 7-0. Sanders moved for approval of payment of Sewer Utility Vouchers in amount of $13,545.80. Hilt seconded, carried 7-0. CITY OFFICIAL'S REPORTS - Deputy Clerk noted Public Hearing would be held on 1/12/88 at 7:20 P.M. to consider rezoning certain property on Hillendale from R-1 to RS-1. Mayor noted landfill legislation has been introduced in the House and the Senate and he requested that aldermen attend the hearing in Madison. ADJOURNMENT - Hilt moved to adjourn at 10:53 P.M.
