Also present Taube, City Clerk Stewart and City Atty. Molter. Aid. Dumke was absent. Penovich moved, Hilt seconded, to approve minutes of meeting held 9/22/87. Carried. Mayor read the Notice of Closed Session as listed on the Agenda. COMMUNICATIONS FROM MAYOR'S OFFICE PROCLAMATION - Clerk read Proclamation on Mental Health Week. Mayor's Veto of Resolution F196-87, Petition to Amend Zoning Text by Clerk. and Rezone Property to Transitional Agriculture Zoning, was read COMMITTEE REPORTS Penovich presented minutes of Finance Committee meetings held 9/23/87, 9/30/87, 10/7/87 and 10/13/87 and moved for acceptance. Hilt seconded, carried. Sanders presented minutes of Public Works Committee meeting held 9/24/87 and moved for acceptance. Hilt seconded, carried. Taube presented minutes of Public Welfare Committee meeting held 9/24/87 and moved for acceptance. Patterson seconded, carried. Sanders presented minutes of Public Safety Committee meeting held 10/1/87 and moved for acceptance. Taube seconded, carried. Taube seconded, carried 6-0. Reso.8206-87 - Setting Public Hearing Date - 1988 Budget (11/9/87-7:00 P.M.). Hilt moved for adoption. Penovich seconded, carried 6-0. Reso.8207-87 - Approval of Amendment to Offer to Purchase (Hamm- Industrial Park Addn. No. 1). Penovich moved for adoption. Hilt seconded, carried 6-0. Reso.8208-87 - Approval of Extension of Agreement Between adoption. Taube seconded. Penovich moved to amend to add: "Be DeBack/Lekfield and City of Muskego. Penovich moved for shall be changed from September 15, 1987 to September 15, it further resolved that the date in paragraph 8 of the agreement 1988". Sanders seconded, carried. Penovich moved to amend to add: "Be it further resolved that the owners and petitioners shall be responsible for payment of any and all attorney, engineering, inspection fees, and other similar fees incurred by the City concerning this agreement. Be it further resolved that agreement beyond November 1, 1988". Sanders seconded, carried. it is unlikely that the City would be in favor of extending this Patterson moved to amend to add: "Be it further resolved that this resolution shall only be effective in amending the agreement after being executed by all the parties within 30 days of today's null and void". Sanders seconded, carried. Reso. 8208-87 As date. If not executed by all parties within 30 days it shall be Amended adopted 6-0. i- Common Council Minutes 10/13/87 - Page 3 Reso.#209-87 - Proceedings by the Common Council of the City of Muskego to Discontinue and Vacate a Part of Meadow Drive in the City of Muskego. Penovich moved to introduce the resolution and defer until after the public hearing (11/24/87). Hilt seconded, carried 6-0. Reso.#210-87 - Declaring Certain Delinquent Personal Property Taxes to be Uncollectible. Penovich moved for adoption. Hilt seconded. List will be rechecked to assure uncollectibility. Carried 5-1 with Taube voting "no". Reso.A211-87 - Resolution Providing for Sale of Not to Exceed moved for adoption. Hilt seconded. Financial Consultant Seegar General Obligation Corporate Purpose Bonds. Penovich Swanson presented the background on refunding and explained the bond market. Motion carried 6-0. LICENSE APPROVAL - Penovich moved for approval of Operator's Licenses for Frank Kania, Christine Whiting, Camille Trapp, Harriet Hudy, Carol Mellonig, Kris Addis and Michael Ewert, with seconded, carried. Ewert's approval subject to confirmation from employer. Hilt Penovich moved for approval of Alarm System Permit for Peter Novak. Sanders seconded, carried. VOUCHER APPROVAL - Penovich moved for approval of General Vouchers in amount of $198,011.20. Hilt seconded, carried 6-0. Penovich moved for approval of Sewer Utility Vouchers in amount of $17,855.55. Sanders seconded, carried 6-0. pursuant to §19.85(1)(g), Conferring with legal counsel for the CLOSED SESSION - Penovich moved to convene in Closed Session governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to specifically regarding the Marino and Super Excavators cases. As litigation in which it is or is likely to become involved, Session. The Common Council will then reconvene into Open to the matter of Marino, formal action may be taken in Closed Session for purpose of Adjournment. Hilt seconded, carried 6-0.
