MINUTES OF MEETING HELD MAY 26, 1987
Called to order by Chairman Salentine at 7:30 P.M. Also present
were Aldermen DeAngelis, Dumke, Hilt Patterson (arrived at 7:40
Attorney Molter.
P.M.), Penovich, Sanders and Taube, City Clerk Stewart and City
Hilt moved, Dumke seconded, to approve minutes of meeting held
May 12, 1987. Carried.
Mayor read the Notice of Closed Session to follow Communications
and Miscellaneous Business.
COMMUNICATIONS FROM MAYOR'S OFFICE
Resolution.#ll6-87 - Honoring City of Muskego Eagle Scout Steven
Krieser. Dumke moved for adoption. Sanders seconded, carried 7- 0.
Personal Appearance - Don Vilione of the City's auditing firm,
Conley, McDonald, Sprague and Co., presented the TIF (Tax
Incremental Financing) Audit.
Mayor clarified procedure if someone wishes to be heard on an
issue at the Council Meeting. If there is no objection, the
person may speak; if there is an objection, a vote is taken.
Mayor clarified that a person who seconds a motion for
reconsideration of a resolution must not have voted previously in
the majority; only the person making the motion for
reconsideration must have voted previously in the majority.
COMMITTEE REPORTS
Penovich presented minutes of Finance Commitee meeting held
5120187 and 5/26/87 and moved for acceptance. Dumke seconded, carried.
Patterson presented minutes of Public Water Committee held
5/14/87 and moved for acceptance. Hilt seconded, carried.
Dumke presented minutes of Public Sewer Committee held 5/20/87
and moved for acceptance. Sanders seconded, carried.
Plan Commission minutes of 5/19/87 were received and placed on
file.
UNFINISHED BUSINESS
Reso.#22-87 (As Amended) - Denial of Rezoning Request - Emerald
Park, Inc. (deferred from 2110187 meeting). Motion carried 7-0.

Reso.186-87 - Resolution as to Park Land Requirements for
Taube seconded. Jeff Gottfried presented the Council with a
resolution adopted by the Little Muskego Lake Association
recommending that the Council retain for future public use a
portion of Dandilion Park for use as a swimming beach and picnic
area. The Clerk acknowledged receipt of petitions for above
received from Robert Rasmussen and Jeff Gottfried. Motion
defeated 5 to 2 with Dumke, Hilt, Penovich and Sanders and
DeAngelis voting no" and Patterson and Taube voting ''yes". II
Reso.#101-87 - Approval of Final Plat and Subdivider's Agreement
seconded. Penovich moved to amend to add 'WHEREAS, the Finance
- Crimson Meadows. Penovich moved for ado tion. DeAngelis
Lot 119 to connect to the proposed sanitary sewer". Sanders
Committee has determined that this approval requires the house on

Reso.#102-87 - Approval of Certified Survey Map - G. Pellmann.
Penovich moved for adoption. DeAngelis seconded, carried 7-0.
Reso.#103-87 - Approval of Certified Survey Map - R. Rice (Town
of Norway). Penovich moved for adoption. Hilt seconded, carried 7-0.
0 Reso.#104-87 - Resolution Providing for the Continued Support of
FLOW. Sanders moved for adoption. Dumke seconded, carried 7-0.
Reso.tl05-87 - Acceptance of Bid for 1987 Bituminous Concrete
Paving Road Improvement Program. Hilt moved for adoption. Taube
seconded, carried 7-0.
Reso.#106-87 - Acceptance of Bid for 1987 Sealcoating Road
Improvement Program. Penovich moved for adoption. Dumke
seconded, carried 7-0.
Reso.#107-87 - Rejection of Offer to Purchase and Authorization
to Counter Offer (D. DeAngelis-Wentland City Owned Lot).
Patterson moved for adoption. Taube seconded. Patterson moved
to amend to add the following: 3. "and lines 25 & 26 of Offer
are deleted"; 4. Buyer is aware that property is being sold as
is"; 5. "Sewer Assessment of $5,928.05 for front footage and
lateral is the responsibility of the Buyer, and any and all
special assessments"; 6. "Buyer understands that it is likely
that he may have to install a culvert at an estimated cost of at
least $3,5001 7.5 It That part of line 104 which reads as follows is deleted, Special Assessments, if any, for work on site

VOUCHER APPROVAL - Penovich moved for approval of General
Vouchers In amount of $899,310.86. Hilt seconded, carried 7-0.
Penovich moved for approval of Sewer Utility vouchers in amount
of $10,957.98. SandgFs seconded, carried 7-0.
CLOSED SESSION - Penovich moved that the Council convene into
Closed Session pursuant to State Statutes, Section 19.85(1)(g)
for the purpose of conferring with legal counsel for the
governing body who is rendering oral or written advice concerning
strategy to be adopted by the body with respect to litigation
which it is or is likely to become involved, with reference to
Party by the EPA regarding the Muskego Landfill. Dumke seconded,
the City of Muskego being named as a Potentially Responsible
carried 7-0.
Mayor announced the Council will then reconvene into Open Session
for the purpose of Adjournment.
ADJOURNMENT - Penovich moved to adjourn at 11:15 P.M. Dumke
seconded, carried.
