ccm19870428COMMON COUNCIL CITY OF MUSKEG0 MINUTES OF MEETING HELD APRIL 28, 1987 Called to order by Chairman Salentine at 8:54 P.M. Also present were Aldermen DeAngelis, Dumke, Hilt, Patterson, Penovich, Sanders and Taube, City Clerk Stewart and City Atty. Molter. Patterson moved, Penovich seconded, to approve minutes of meeting held 4/14/87 and 4/21 187. Carried. COMMUNICATIONS FROM MAYOR'S OFFICE Proclamation - "Green Up Muskego Week'' May 10-17, 1987 accepted be Chamber of Commerce representative Steve Kwiatkowski. Proclamation - "Recycling Week" - May 3-9, 1987. Mayor announced his committee appointments for 1987-88. COMMITTEE REPORTS 0 Penovich presented minutes of Finance Committee meetings held 4/22/87 and 4/28/87 and moved for acceptance. Dumke seconded, carried. Sanders presented minutes of Public Sewer Committee meeting held 4/16/87 and moved for acceptance. Penovich seconded, carried. 4/23/87 and moved for acceptance. Patterson seconded. Hilt Dumke presented minutes of Public Water Committee meeting held moved for individual consideration of third paragraph, Penovich seconded, carried. Motion to adopt minutes with exception of third paragraph carried, with Taube voting "no". Patterson moved to defer action on third paragraph to obtain a report to the Council from the City's engineers on the possible difference in impact to the surrounding wells with a community well or individual wells. Penovich seconded, carried. Plan Commission minutes of meeting held 4/21/87 were received and placed on file. UNFINISHED BUSINESS Ord.11566 - An Ordinance to Amend Chapter 1, Section 1.05(4) of the Municipal Code (Board of Housing Appeals). Second Reading. Dumke moved for adoption. Taube seconded, carried 7-0. Muskego (Eiche - RS-2 to B-2/RSM). Second Reading. DeAngelis Ord.11567 - An Ordinance to Amend the Zoning Map of the City of moved for adoption. Penovich seconded. Concensus of aldermen was that B-2 on Hy. 24 was appropriate, but 40 acres for RSM was too large due to objections of citizens. Taube requested e 4/28/87 - Page 2 Common Council Minutes permission for Mark Budnik, Lannon Dr. to speak. Budnik restated opposition to RSM given at Public Hearing, stating that 8-10 benefits to City for RS-2 vs. RSM, and expressed concern about acres would be acceptable for senior housing. Taube compared tax traffic patterns and obtaining enough right-of-way, and requested that the Plan Commission work with Mr. Eiche regarding upgrading the road. Mayor exhibited a map showing RSM zoning ending at the top of the hill. Eiche stated he would accept RSM zoning in the be appropriate after another public hearing, and City would have area shown on the map. He felt a planned unit development would time to get traffic studies done. He stated request for RSM was not based on 202 housing. Hilt moved to amend Ord. 567 to amend north of a line extending from Lannon Dr. along the northern legal description of area to be rezoned to RSM to be that area boundary of the property line of the existing home on the east side of Lannon, east to the city-owned property line. DeAngelis permission for Mark Smith, Allied Council of Sr. Citizens to seconded. Eiche expressed agreement. DeAngelis requested speak. Smith stated site control and proper zoning must be in Motion to amend carried 6-1 with Taube voting "no". Ord. 567 As the works by June 1st to allow application for 202 housing. Taube moved to amend to add to Section 1 and Section 2: "...but only if the following condition is met:" and, "Both the rezoning referred to in Section 1 and Section 2 shall occur only if the following condition is met on or before the 5th day of May, 1987: That all persons having an interest in the undeveloped part of the Planned Unit Development will execute have no objection to the 15 acres of the Planned Unit Development a written agreement acceptable to the City of Muskego that they not being used as park and that the undeveloped land, prior to disposing of the park land, will be rezoned and the Planned Unit Development amended in such a manner that development of said lands could occur with proper space requirements without the park adopted 7-0. land." Reso.//69-87 - Acceptance of Quote for Forced Sewer Hook-Up (Sweeney and Pope Properties). Penovich moved for adoption. Sanders seconded. Penovich moved to amend to delete from n4: property at W156 57890 Ladwig Dr.", and to add: "Be it further "...and $1,660.00 for the forced sewer hook-up of the Terry Pope S7890 Ladwig Dr. shall not be implemented until 5/28/87. If resolved that the hook-up of the Terry Pope property at W156 connection to the sewer has not been made by that date, the quote of C & H Plumbing & Htg. Co. in the amount of $1,660.00 shall then be accepted and the forced sewer hook-up shall proceed." Patterson seconded, carried. Reso. 1/69-87 As Amended adopted 7-0. Council determined proposed sketch should be referred to Plan Commission for further review. Shape and size of the zoning was discussed. Ord.#570 - An Ordinance to Amend Chapter 11, Section 11.03(2) of the Municipal Code (Landfills). First Reading. Ord.#571 - An Ordinance to Amend Chapter 9, Section 9.29(3)A of the Municipal Code (Off-the-Road Vehicles) First Reading. .. VOUCHER APPROVAL - Penovich moved for approval of payment of General Vouchers in amount of $183.480.27. Hilt seconded. carried 7-0. Penovich moved for approval of Sewer Utility Vouchers in amount of $11,718.86. Sanders seconded, carried 7-0.
