ccm19860909COMMON COUNCIL CITY OF MUSKEG0 MINUTES OF MEETING HELD SEPTEMBER 9, 1986 were Aldermen DeAngelis, Dumke, Hilt, Patterson, Penovich, Called to order by Chairman Salentine at 7:35 P.M. Also present Sanders and Taube, City Atty. Molter and Deputy Clerk Marenda. Penovich moved, Dumke seconded, to approve minutes of meeting held 8/26/86. Carried. COMMUNICATIONS FROM MAYOR'S OFFICE Selection of Council representative to Muskego Historical Society. Ald. Sanders stated he would be willing to serve on that committee. COMMITTEE REPORTS Penovich presented minutes of Finance Committee meetings held 9/3/86 and 9/9/86 and moved for acceptance. Hilt seconded, carried. held 9/4/86 and moved for acceptance. Hilt seconded, carried. Patterson presented minutes of Public Water Committee meeting Plan Commission minutes of 9/2/86 were received and placed on file. UNFINISHED BUSINESS Reso.#175-86 - Resolution Adopting Assessment Policy for Construction of Water Mains. On floor, reconsidered 8/26/86 and presented. Patterson seconded, carried. Reso. ffl75-86 As deferred. Hilt moved to amend to include the amendments as Amended was adopted 7-0. NEW BUSINESS Allied Council of Senior Citizens (Housing for the Elderly in Reso.#201-86 - Resolution Expressing Intent to Cooperate with the Muskego). DeAngelis moved for adoption. Penovich seconded. Dorothy Seeley, President of the Allied Council of Senior Citizens presented a letter from the NCSC Housing Management Corp. dated 9/5/86. She stated they were looking for a "good faith" commitment from the City to assist them in obtaining a minimum of 4 acres to construct a 202 housing facility for the elderly and handicapped, along with utilities, roads, sewers, etc. DeAngelis felt the City should be receptive to donating 8- 10 acres and offering the help of the City Attorney, etc. to accomplish this project. The resolution on the floor does not make a commitment to any land, but does state the City would cooperate with the Senior Citizens in locating land. Motion to adopt #201-86 carried 7-0. Patterson moved to establish the hours of 1:00 - 5:OO P.M. on Reso.fi202-86 - Designating Halloween Trick or Treat Hours. Sunday, October 26th. Hilt seconded. Penovich moved to amend the times to 2:OO - 4:OO P.M. Motion failed for lack of a second. Motion to adopt #202-86 carried 6-1 with Penovich voting "no" . Reso.#203-86 - Authorizing Expenditure of Funds - Platting of Industrial Park Addn. No. 1 ($2,000). Dumke moved for .. . adoption. Hilt seconded, carried 7-0. Reso.#204-86 - Approval of Developer's Agreement (Kurer/Bushberner). Hilt moved for adoption. Taube seconded. Hilt moved to amend 4th ll to add "subject to approval by the City Attorney and City Engineer and payment of all costs required by Section 10 of the Land Division Ordinance", and to add "Be it further resolved that this approval is subject to the condition 8, 1986 are included in the re-draft of the Developer's that the City Attorney's suggestions in his letter of September Agreement.'' Penovich seconded, carried 7-0. Reso. 11204-86 As Amended adopted 7-0. Reso.#205-86 - Resolution Expressing Intent to be Receptive to Penovich moved for adoption. DeAngelis seconded. DeAngelis "No Parking" Restrictions on Hwy. 24 from Lannon to Bay Lane. moved to amend to add: "Be it further resolved that the Common Council also recognizes the need for an 8' shoulder on each side of Hwy. 24 from Racine Avenue to the eastern boundary of the City for the safety of the bicycle traffic, and that the Police Department has documented that on September 6, 1986, 29 bicycles travelled this area in a 24 hour period. In addition, the Common Council feels that the bicycle count would increase once the hazardous conditions have been eliminated." Sanders seconded, carried. Patterson requested that the letter to the DOT also request that the 8' paved area be extended to the County Park on the west and to the Milwaukee County Line on the east. Reso. #205-86 As Amended adopted 7-0. Reso.#206-86 - Authorize Execution of Non-Waiver Agreement Between City and Wausau Insurance Company (Muskego Sanitary Landfill). Penovich moved for adoption. Dumke seconded. Patterson moved to amend the agreement to change the first before the second "claims". Hilt seconded, carried. Reso. #206- "claims" to "inquiries", remove "against it", and add "possible" 86 As Amended was adopted 7-0. Reso.#208-86 - Appointment to Capital Budgeting Committee. Patterson moved for adoption. Hilt seconded, carried 7-0. Reso.#209-86 - Resolution Pursuant to §74.135 Cancelling Personal Property Tax (Ingersoll). Hilt moved for adoption. Taube seconded, carried. LICENSE APPROVAL - Penovich moved for approval of Operator's Licenses subject to favorable police reports for Steven Walters, Diane Lucht, Lisa Klunder, Jenny Fitzgerald, Karen Gordon and Deborah Klann. Dumke seconded, carried. Leonard's Parish for various dates for Bingo. Sanders seconded, Penovich moved for approval of Gathering Permits for St. carried. VOUCHER APPROVAL - Penovich moved for approval of payment of General Vouchers in amount of $301,444.40. Taube seconded, carried 7-0. Penovich moved for approval of payment of Sewer Utility Vouchers in amount of $1,941.58. Taube seconded, carried 7-0. 0 CITY OFFICIAL'S REPORTS - Atty. Molter advised that a claim filed concerning a police officer had been tendered to the insurance regarding the Muskego Landfill, the Vesbach Lagoon agreement and company. He also reported on a possible claim from the EPA the proposed Soil Erosion Ordinance. The proposed WCA letter was reviewed, with comments to be submitted to the Clerk by 9/10/86.
