ccm198606240 COMMON COUNCIL CITY OF MUSKEG0 MINUTES OF MEETING HELD JUNE 24, 1986 Called to order by Chairman Salentine at 8:08 P.M. Also present were Aldermen DeAngelis, Dumke, Hilt, Patterson, Penovich, Sanders and Taube, Deputy Clerk Marenda and City Atty. Molter. The Mayor opened the meeting by announcing that this was an open meeting of the Common Council. Notice of this meeting was given to the public at least 24 hours prior to the meeting by forwarding the complete agenda to the official City newspapers, the Muskego Sun, and to all news media who have requested the same as well as posting. Copies of the complete agenda were available for inspection at the City Clerk's office. Anyone desiring information as to forthcoming meetings should contact the City clerk's office. held 6/10/86. Penovich moved, Dumke seconded, to approve minutes of meeting COMMITTEE REPORTS Penovich presented minutes of the Finance Committee meetings held 6/18/86 and 6/24/86 and moved for acceptance. Hilt seconded. Patterson moved for separate consideration of (14 on Page 3 of being spent away from City for sergeant to participate in social 6/18 minutes, Hilt seconded, carried. Patterson questioned time services program. Penovich spoke in favor due to knowledge and moved to approve 114. Hilt seconded, carried 5-2 with Dumke, experienced to be gained for the benefit of Muskego. Penovich DeAngelis, Hilt, Penovich and Sanders voting "yes" and Patterson and Taube voting "no". Motion to adopt minutes carried. Sanders presented minutes of Public Safety Committee meeting held 6/11/86 and moved for acceptance. Taube seconded, carried. Patterson presented minutes Committee meeting held 6/11 seconded, carried. /86 and moved for acceptance. Sanders of Rules, Laws and Ordinance Patterson presented minutes of Public Water Committee meeting held 6/19/86 and moved for acceptance. Hilt seconded. The Clerk was directed to notify affected property owners on Hillendale on Tues., July 8th at 6:15 P.M. at City Hall. Common Council Minutes 6/24/86 - Page Two 0 COMMUNICATIONS FROM MAYOR'S OFFICE A letter to Richard Arrowood expressing appreciation for his years of service on the Parks and Recreation Board and the Plan Commission was read by Deputy Clerk. Proclamations to recognize Eagle Scouts Jeffrey Weidner, Richard Gilpatrick, Aaron Harding, Daniel Olewniczak and Michael LaGrow were presented. UNFINISHED BUSINESS Ord.#553 - An Ordinance to Amend Chapter 12, 12.19 of the Municipal Code (Cable TV Ordinance). 2nd Reading. Dumke moved for adoption. Hilt seconded, carried 7-0. Ord.#554 - An Ordinance to Amend Chapter 9 of the Municipal Code of the City of Muskego (Disposal of Abandoned Property). 2nd moved to amend to add to F. after "organization": "and the Reading. Dumke moved for adoption. Patterson seconded. Dumke payment to said organization"; and to add: "G. Return to the person(s) who turned the item in to the Police Department if requested and no rightful owner can be located." Patterson seconded, carried. Ord. #554 As Amended adopted 7-0. NEW BUSINESS Reso.#122-86 - Removed from agenda. Reso.#135-86 - Resolution Awarding Notes (The Northern Trust Company-7.14882%). Penovich moved for adoption. Dumke seconded. Seegar Swanson presented seven bids received and recommended adoption of awarding notes to Northern Trust. Carried 7-0. Insurance made available to City to guarantee AAA rating. Reso.tl35a-86 - A Resolution Authorizing the City of Muskego to Borrow the Sum of $2,225,000 Pursuant to Section 67.12(12) of the Wisconsin Statutes. Penovich moved for adoption. Hilt seconded; Seegar Swanson explained the projects involved. Carried 7-0. Reso.tl36-86 - Directing the City Attorney to Draft the Ordinance to Amend the District Zoning Map (Kreuzer - RS-3 OLS to RS-3 OLS- Molter expressed concern about zoning with deed restrictions and 00s). DeAngelis moved for adoption. Taube seconded. Atty. felt Plan Commission approval of building, site and operational plans would be sufficient. Dumke questioned opening up residential areas for commercial use. Taube and Patterson felt requirement for deed restriction should remain. Reso.#139-86 - Approval of Certified Survey Map (R.Zach). DeAngelis moved for adoption. Sanders seconded. Atty. Molter recommended all approvals of CSM's state "subject to receipt of all other fees required by Section 10 of the Land Division Ordinance". Dumke moved to amend #139-86 to include statement. Patterson seconded, carried 6-1 with Taube voting "no". Reso. #139-86 adopted 7-0. Reso.Bl40-86 - Approval of Preliminary Plat - Crimson Meadows. DeAngelis moved for adoption. Hilt seconded, carried 7-0. Reso.#141-86 - Offer to Purchase - Industrial Park Expansion. Penovich moved for adoption with insertion of "that a counter offer be prepared in the amount of $40,800 with an acceptance date by buyer of July 2, 1986 and a reduced frontage of 285 ft." in 113 and 114. Dumke seconded, carried 7-0. Reso.#142-86 - Amendment to Uniform Local Bail Bond Schedule ($125 for Issuing of Worthless Checks). Penovich moved for adoption. Patterson seconded, carried 7-0. Patterson seconded, carried 7-0. Reso.Fl45-86 - Collection of Liquidated Damages - Industrial Park Expansion Sewer and Water Main Project (Globe Contractors). Penovich moved for adoption. Hilt seconded. Mayor suggested Globe be invited to appear before the Finance Committee for discussion. Hilt moved to defer. Penovich seconded, carried. County, Wisconsin (Oak Hill Estates Sewer Project). Penovich Reso.#146-86 - Relocation Order of the City of Muskego, Waukesha moved for adoption. Sanders seconded, carried 7-0. Reso.Hl47-86 - Approval of Various License Applications for the City of Muskego for the Licensing Period July 1, 1986 to June 30, 1987. Penovich moved for adoption. Taube seconded. The Council determined that Richard Schaumberg would be allowed to remain open until closing on August 9, 1986, in a tent located on his property: that the license for Michael R. and Linda Laack Common Council Minutes 6/24/86 - Page 4 inspection orders gained, revocation proceedings would start 9/1/86; that license for Schultz Rod and Gun Club would be issued, but if compliance with building inspection orders not gained by July 1st a citation would be issued and revocation proceedings would begin; and the following condition be added to Klauser Rifle Range license: No shooting permitted until inspected by a responsible party of the City of Muskego from a safety standpoint. Rifle Range may not go into use until that inspection made and approval given. Motion to adopt Reso. 11147- 86 adopted 7-0. Licenses for Laurie Thompson, Donald Zuehlke, Robert Bunzel, LICENSE APPROVAL - Penovich moved for approval of Operator's Jacqueline Jablonowski, Theodore Lepak, Jeffrey Lasczewski, Gawlik, John Kuse, Shelly Anderson and Debra Kutcher. Patterson Gerald Jablonowski, Deborah Grober, Alvin Schramm, Laurene seconded, carried. Penovich moved for approval of Gathering Permit for Sully's Tuggers at Horn Park on 7/19/86. Hilt seconded, carried. Penovich moved for approval of Gathering Permit for Little Muskego Lake Assn. at Idle Isle - 7125-27186. Taube seconded, carried. 0 Penovich moved for approval of Special Permit (Dance Hall) - Lynn Kurer (Bushy's) with time limit of 11:30 PM on 7/12/86 and 10:30 PM on 7/13/86. Hilt seconded, carried. Penovich moved for approval of Refuse Haulers Permits for 1986187 for Town & Country Waste Service, Inc., Best Disposal Systems, United Waste Systems, City of Waukesha Incinerator, Sanitary Disposal Service, Inc., Waste Management of Milwaukee and Cotton Disposal, Inc. Dumke seconded, carried. VOUCHER APPROVAL - Penovich moved for approval of payment of General Vouchers in amount of $196.257.01. Hilt seconded. carried. Penovich moved for approval of payment of Sewer Utility Vouchers in amount of $10,472.64. Sanders seconded, carried. CITY OFFICIAL'S REPORTS - Deputy Clerk acknowledged receipt of petition from Boehm for rezoning at Lannon and Woods from RS-2 to RS-3. Public Hearing to be held on 7/8/86 at 7:20 P.M. Letter from J.
