ccm19850924~ COMMON COUNCIL CITY OF MUSKEGO MINUTES OF MEETING HELD SEPTEMBER 24, 1985 Called to order by Chairman Salentine at 7:40 P.M. Also present were Aldermen DeAngelis, Dumke, Hilt, Penovich, Taube and Tomczyk, Clerk Stewart and Atty. Molter. Penovich moved, Tomczyk seconded, to approve minutes of meeting held 9/10/85. Carried. COMMITTEE REPORTS Penovich presented minutes of Finance Committee meetings of 9/18/85 and 9/24/85 and moved for approval. Tomczyk seconded, carried. ~ Dumke presented minutes of Public Sewer Committee meeting of 9/12/85 and moved for approval. Penovich seconded. DeAngelis submitted a letter dated 9/12/85 from 7 property owners regarding lift station fumes and requested same be attached to minutes. He also stated Mr. Dawes requested that the City contact the State Department of Transportation to check the carbon dioxide level of the fumes. Motion carried. DeAngelis presented minutes of Public Welfare Committee meeting of 9/19/85 and moved for approval. Tomczyk seconded, carried. Tomczyk presented minutes of Public Water Committee meeting of 9/19/85 and moved for approval. DeAngelis seconded, carried. Tomczyk presented minutes of Public Works Committee meeting of 9/19/85 and moved for approval. DeAngelis seconded, carried. Minutes of Plan Commission meeting of 9/17/85 received and placed on file. COMMUNICATIONS FROM MAYOR'S OFFICE Mayor appointed Ald. Taube as Chairman of the Public Safety Committee to replace former alderman Nilsson. UNFINISHED BUSINESS Reso.#208-85 - Final Resolution Authorizing Installation of Sanitary Sewer Improvements and Levying Special Assessments Against Benefited Property (Boszhardt Lane Sewer Project). On floor, deferred 9/10/85. Tomczyk moved to defer to obtain cost of gravel backfill from the City Engineers. Penovich seconded, carried. Common Council Minutes 9/24/85 - Page 2 Reso.#2l8-85 - Acceptance of Quote for Cleaning Service - City Hall/Library and Police Department. On floor, deferred 9/10/85. Dumke moved to amend last paragraph to read as follows: Now, therefore, be it resolved, that the Common Council of the City of Muskego, after further review, does hereby accept the second low quote of Squeaky Cleaning Service in the amount of $1,120.00 for the cleaning of the City Hall/Library (including the addition) and the Police Department effective October 1, 1985, with the low quote not considered due to dissatisfaction with the quality of work previously performed by that service. DeAngelis seconded, carried. Reso. #218-85 As Amended adopted 6-0. NEW BUSINESS Reso.#224-85 - Honoring Muskego's AFS Student - Vicki Wynn. Penovich moved for adoption. Tomczyk seconded, carried 6-0. Reso.#225-85 - Expressing Appreciation to Richard Nilsson. Penovich moved for adoption. Taube seconded, carried 6-0. Reso. #226-85 - Denial of Rezoning Request - T. Kastello. moved for adoption. Dumke seconded, carried 6-0. Reso. #227-85 - Establishing Permit Fee for Waterway Markers. Penovich moved for adoption. Hilt seconded, carried 6-0. Hilt Reso.#228-85 - Authorizing Expenditure of TIF Funds (Muskego Historical Society - TID #7). Penovich moved for adoption. Hilt seconded. Hilt moved to amend to add: '~hereas, the Council has determined that replacement of the alarm system for the Wollman House in the amount of $650.00 is not TIF eligible." and, to change dollar amount in last paragraph to $2,907.95. Dumke seconded, carried. Hilt moved to defer for further review. Taube seconded, carried 6-0. Reso.#229-85 - Approval of Lease Agreement Between City of Muskego and Muskego Historical Society, Inc. Hilt moved for adoption. Penovich seconded. With the permission of Council, Ms. Erdmann of the Historical Society spoke to request the addition of a paragraph to protect against the sale of artifacts. Atty. Molter recommended against the addition. Hilt moved to amend the Lease to add: "21. The City recognizes that the artifacts at the Old Town Hall and Old Settlement Centre became a reality because of the efforts and funds of the Muskego Historical Society and its members and perpetually agrees that the artifacts shall not be sold or otherwise altered in any way without first obtaining the approval of the Muskego Historical Society. Further, the Muskego Historical Society agrees not to sell or otherwise alter the artifacts without the City's approval." Dumke seconded. Motion carried 4-3 with the Mayor ( ,,-- Common Council Minutes 9/24/85 - Page 3 Reso.#229-85 (continued) casting the tie-breaking vote, with DeAngelis, Dumke, Hilt and Mayor voting "yes" and Tomczyk, Penovich and Taube voting "no". Reso. #229-85 As Amended adopted 4-3 as above. Reso.#230-85 - Establishing Salaries for Certain Non-Represented Employees for 1985/86. Tomczyk moved for adoption. Penovich seconded, carried 6-0. Reso.#23l-85 - Resolution Providing for the Continued Support of FLOW. (~21,000-TID 2-7). Penovich moved for adoption to "approve". Taube seconded, carried 6-0. Reso.#232-85 - Final Resolution Authorizing Roadway Reconstruction and Levying Special Assessments Against Benefited Property (Bay Lane and Bay Court - MR-1-85). DeAngelis moved for adoption. Hilt seconded, carried 6-0. Reso.#233-85 - Amended Final Resolution Authorizing Installation of Sanitary Sewer Improvements and Levying Special Assessments Against Benefited Property (Ladwig Drive Sewer Project - MSS-2- 84). DeAngelis moved for adoption. Penovich seconded, carried 6-0. ,,-- Reso.#234-85 - Transfer of Funds. Dumke seconded, carried 6-0. Penovich moved for adoption. Reso.#235-85 - Approving City's Offer to Purchase Parcel of Land for Tess Corners Drainage Project (Kelsenberg). Penovich moved for adoption. Dumke seconded. Taube moved to amend to add: Be it further resolved that the City Attorney is directed to make a counter offer as to this property if the Public Works Committee so directs including provisions which they direct. Penovich seconded. With permission of second, Taube withdrew his motion. Motion to adopt #235-85 was defeated 0-6. Penovich moved to direct the City Attorney as per the above motion. Taube seconded, carried 6-0. LICENSE APPROVAL - Penovich moved for approval of Operator's licenses for Lawrence Swisher, Al Gerth, Ray Gerth, Joseph Macisak, George Malecki and Diana Ziebell. Tomczyk seconded, carried. Penovich moved to defer request for Operator's License for Robert Wohlleben and refer to Finance Committee for review. Tomczyk seconded, carried 6-0. Penovich moved for approval of Gathering Permit for Muskego Icetronauts for 10/13185. Tomczyk seconded, carried 6-0. Penovich moved for approval of payment of Sewer Utility Vouchers in amount of $50,805.52. Dumke seconded, carried 6-0. CITY OFFICIAL'S REPORTS - Molter advised receipt of cross complaint in the Marino case for approx. $125,000. Mayor announced Special Council meeting to be held 9/26/85.
