MINUTES OF MEETING HELD SEPTEMBER 10, 1985
Called to order by Chairman Salentine at 7:40 P.M. Also present
were Aldermen DeAngelis, Dumke, Hilt, Nilsson, Penovich and
Tomczyk, Clerk Stewart and City Attorney Molter. Alderman Taube
was absent.
Penovich moved, Tomczyk seconded, to approve minutes of meeting
held 8/27/85. Carried.
COMMITTEE REPORTS
Penovich presented minutes of Finance Committee meetings held
9/4/85 and 9/10/85 and moved for approval. Tomczyk seconded,
carried.
Tomczyk presented minutes of Public Works Committee meeting held
9/5/85 and moved for approval. DeAngelis seconded, carried.
Plan Commission minutes of meeting held 9/3/85 were received and
placed on file.
UNFINISHED BUSINESS
Reso.#197-85 - Approval of Alteration of Planned Unit Development
(Freedom Square IV-Klenz). On the floor, deferred 8/27 185.
Nilsson recommended plan submitted by Mr. Larson be reviewed by
the Planning Consultant and the Plan Commission, and moved to

Ord. 538 - An Ordinance to Amend Chapter 12, Section 12.04(4)(d)
of the Municipal Code ("Special Permit" License). Second
Reading. Dumke moved for adoption. Tomczyk seconded. Molter
expressed concern about unlimited number of events per
application, and recommended a limit be specified as to the
number of events listed on a application for which the Clerk can
grant the license. Dumke moved to defer and refer to Rules, Laws
and Ordinance Committee for review. Nilsson seconded, carried.
NEW BUSINESS
Reso.#206-85 - Final Resolution Authorizing Installation of
Against Benefited Property (Ladwig Dr. Sewer Project). Penovich
Sanitary Sewer Improvements and Levying Special Assessments
moved for adoption. Dumke seconded. After much discussion,
motion carried 6-0.
Reso.#207-85 - Awarding of Bid (Ladwig Dr. Sewer Project-
$993 ,312.50 plus Alt.$1,875). Dumke moved for adoption to
Ruekert & Mielke dated 9/10/85. Hilt moved to amend to add: Be
approve". Penovich seconded. Clerk read recommendation from
it further resolved that the Mayor, in consultation with the City
Engineer, shall meet to award the contract for Alternate Al, A2
with this portion of the project. Tomczyk seconded. Molter
and A3 for a total of $6,240, if the City is going to proceed
written acceptance of bid price be obtained from Klenz. Carried
recommended payment be received prior to start of project and
6-0. Hilt moved to further amend: Be it further resolved that
7,500 sq. yd. is approved. Tomczyk seconded, carried 6-0.

Reso.11216-85 - Authorizing Expenditure of TIF Funds for Parking
Lot Improvements - Tess Corners Volunteer Fire Dept. (TID 112).
Nilsson moved for adoption. Hilt seconded. Molter advised bids
must be obtained for this project. Nilsson moved to defer to
obtain legal opinion on behalf of Fire Department. Tomczyk
seconded. Possible amendments to resolution discussed. With
Fire Department intends to make certain parking lot
amend to read as follows: "Whereas, the Tess Corners Volunteer
improvements. Now, therefore, be it resolved that the Common
Council of the City of Muskego, upon the recommendation of the
Finance Committee, does hereby agree in concept to funding the
paving of the parking lot, providing the project is publicly
bid. Be it further resolved that the Common Council does hereby
authorize the payment of $4,000 from TID #2 to the Tess Corners
Volunteer Fire Department for the moving of the electric company
utility poles in connection with this project." Tomczyk

Reso.11217-85 - Establishing Salaries for Certain City of Muskego
EmDlovees for 1985/86. Penovich moved for adootion. Dumke

resolved that the Assessor and Clerk shall be provided with
$1,000 annually in lieu of pension benefits". Tomczyk seconded
carried 6-0. Nilsson moved to amend salaries for the Mayor and
Aldermen to $30,000 and $3,600 respectively. Dude seconded.
Mayor recommended this be discussed during the budget process,
along with the consideration of making the Mayor's position ful
time. With the permission of his second, Nilsson withdrew his

referendum vote indicated the people were in favor of the
purchase and felt that shouldn t be ignored. Tomczyk stated only

asked for consideration of legal fees due to the magnitude of
this project. Carried 6-0.
LICENSE APPROVAL - Penovich moved for approval of Operator's
Licenses for Madeleine Kienast, Deborah Carlson, Donald Mittag
and Melinda Mittag. Tomczyk seconded, carried.
Penovich moved for approval of Gathering Permit for Muskego
Icetronauts for September 22, 1985. Tomczyk seconded, carried.

CITY OFFICIAL'S REPORTS - Molter advised Writ of Certiorrai had
been received regarding Januszewski vs. City of Muskego
pertaining to action of the Board of Appeals and appropriate
response entered.
