ccm19850709COMMON COUNCIL CITY OF MUSKEG0 e MINUTES OF MEETING HELD JULY 9, 1985 Called to order by Chairman Salentine at 8:36 P.M. Also present were Aldermen DeAngelis, Dumke, Hilt, Nilsson, Taube and Tomczyk, Clerk Stewart and Atty. Macy. Ald. Penovich was absent. Mayor read the Notice of Closed Session and noted Council would reconvene into Open Session. Tomczyk moved, Hilt seconded, to approve minutes of meeting held 6/25/85. Carried. Ald. Tomczyk moved at 8:40 P.M. to convene into Closed Session pursuant to Section 19.85(1)(c) of the State Statutes to discuss union contract ne otiations, collective bargaining and grievances for the City Hall 7 Library Unit, Telecornmunicators Unit & Police Officer's Unit and Section 19.85(l)(g) to confer with legal counsel with respect to litigation, union contract negotiations, Unit, Telecommunicators Unit and Police Officer's Unit. Seconded collective bargaining and grievances for the City HallILibrary by Ald. Dumke, motion carried. B UNFINISHED BUSINESS Reso.#120-85 - Authorizing Approval of Agreement Between City of Muskego and Little Muskego Lake Association (Jewel Creek Drainage Project) (Deferred 6/11/85 & 6/25/85). Taube moved to amend No. 2 by deleting everything after "from any such costs" in the 1st sentence and adding "directly related to the cost of construction. It is mutually agreed that the CITY'S liability insurance shall cover any liability claims which shall be both ASSOCIATION shall pay any costs of defense and losses which might paid and defended by the CITY'S insurer. However, the occur after the CITY'S insurance protection has been exhausted.'' and by amending No. 3 by deleting everything after "from said account" in the 2nd sentence and adding "after review from the designated members of the Association. After advisement, the City of Muskego has sole discretion as it deems appropriate to Agreement, but never less than FIVE THOUSAND ($5,000) DOLLARS and pay any of the expenses, costs, damages, etc. stated in this that the ASSOCIATION upon written demand by the CITY shall replenish said account. That the ASSOCIATION'S responsibility for maintaining said account shall terminate after final payment to contractors and upon completion of said project". Tomczyk seconded, carried 6-0. Tomczyk moved for reconsideration. Nilsson seconded, carried 6-0. Tomczyk moved to amend 4th paragraph to read: "Be exteriors of buildings as part of their premises are amended due it further resolved that the application of the following 0 Common Council Minutes 7/9/85 - Page 2 to mutual agreement of the applicant and the City of Muskego and a restriction shall be placed on the license of those establishments listing exteriors of buildings as part of their premises which states "No Outside Sales After 11:OO P.M.: Jeff's Black Duck, Amann's Beach, Schaumberg's Suburban House and Sobek Resort.'' Taube seconded, carried 6-0. Reso. #126-85 (As Amended) adopted 6-0.
