MINUTES OF MEETING HELD MAY 28, 1985
Called to order by Chairman Salentine at 7:44 P.M. Also present
were Aldermen DeAngelis, Dumke, Hilt, Nilsson, Penovich, Taube
and Tomczyk, Clerk Stewart and Atty. Molter.
Penovich moved, Tomczyk seconded, to approve minutes of meeting
held 5/14/85. Carried.

COMMUNICATIONS FROM MAYOR'S OFFICE
John Johnson was introduced as Chief of Police and Clerk Stewart
administered the Oath of Office to Chief Johnson.
Police Officer Thomas Schilling was introduced and Oath of Office
administered by Clerk.
COMMITTEE REPORTS
Penovich presented minutes of Finance Committee meetings held
5/22/85 and 5/28/85 and moved for approval. Tomczyk seconded,
carried.
Taube presented minutes of Public Safety Committee meeting held
5/16/85 and moved for approval. Nilsson seconded, carried.
Tomczyk presented minutes of Public Works Committee meeting held
5/23/85 and moved for approval. DeAngelis seconded, carried.
Minutes of Plan Commission meeting held 5/21/85 received and
placed on file.
UNFINISHED BUSINESS
Reso.#100-85 - Granting Placement of Water Ski Jump on Bed of
Little Muskego Lake and Placement of Pier at Idle Isle (Water
Bugs). On floor, deferred 5/14/85. Carried 7-0.
Ord.11524 - An Ordinance to Create Chapter 27 of the Municipal
Code of the City of Muskego (Administrative Review). 2nd
Reading. Dumke moved for adoption. Penovich seconded, carried
7-0.
Ord.8531 - An Ordinance to Create Cha ter 28 of the Municipal
Code of the City of Muskego Entitled 'Water Utility". 2nd
reading. Tomczyk moved for adoption. DeAngelis seconded,
carried 7-0.
Ord.#532 - An Ordinance to Amend Chapter 2, Section 2.09 (1) of
the Municipal Code (Committee on Public Water). 2nd reading. Hilt moved for adoption. Tomczyk seconded, carried 7-0.

Ord.#533 - An Ordinance to Amend Chapter 17:8.16(7)C of the
Municipal Code (Solid Landfill Use) 2nd reading. Tomczyk moved
for adoption. Hilt seconded. DeAngelis and Dumke spoke in
opposition. Carried 5-2, with Hilt, Nilsson, Penovich, Taube and
Tomczyk voting "yes" and DeAngelis and Dumke voting "no".
Ords.8534A and #534B - An Ordinance to Amend the Zoning Map of
the City of Muskego (A to 1-2 [Future Parkland Development
Landfill-Hwy. 451). 2nd Readings. Atty. Molter advised that
"other City approvals" in #534A refers to those approvals
pertaining to the landfill only, and not building permits, etc.
With the permission of the Council, Atty. Jim Baxter on behalf of
Parkland Development, requested reference to "other City
approvals" deleted. Nilsson moved to adopt 115348. Tomczyk
seconded. Nilsson moved to amend the 5th paragraph of #534A
to: "That the rezoning is conditional zoning based on the
approval of the DNR of the feasibility report and approval of the
need and environmental aspects and approval of the City of
Muskego of a conditional use and of all other City approvals
within 1-112 years after the enactment of the rezoning
ordinance." Tomczyk seconded, carried 7-0. Ord. #534A (As
Amended) adopted 5-2, with Hilt, Nilsson, Penovich, Taube and
Tomczyk voting "yes" and DeAngelis and Dumke voting "no".
Nilsson moved to Table Ord. #534B. Tomczyk seconded, carried 7-0.

Reso.#105-85 - Awarding Bids (City Hall/Library Expansion).
Penovich moved for adoption. Taube seconded. With permission of
Council, Architect Mike Dvorak explained bids received. He
advised categories where bids were not awarded would be rebid and
plans and specs would be revised in an attempt to reduce the
costs. Motion carried 7-0.
Reso.#106-85 - Rejecting Bids and Authorizing Rebid (City
Hall/Library Expansion). Tomczyk moved for adoption. Hilt
seconded, carried 7-0.
Reso.#107-85 - A Resolution Adopting First Amended Relocation
Order of the City of Muskego, Waukesha County, Wisconsin,
Pertaining to the Acquisition of a Drainage Easement from Henry
A. Herdeman and Patricia H. Herdeman, his Wife. Tomczyk moved

Tomczyk moved for adoption. Nilsson seconded, carried 7-0.
DeAngelis requested permission to change vote. As there were no
objections, a "no" vote was recorded for DeAngelis. Carried 6-1.
Reso.Wl09-85 - Authorizing Acquisition of Easement (Boszhardt
Lane Sewer Project). Tomczyk moved for adoption. DeAngelis
seconded, carried 7-0.
Reso.#110-85 - Petitioning for Amendment to Zoning Text (Multi-
seconded, carried 7-0. family in OLR). DeAngelis moved for adoption. Penovich
Reso.#lll-85 - Acceptance of Low Bid for 1985 Road Improvement
Program. Tomczyk moved for adoption. DeAngelis seconded,
carried 7-0.

amend date of lease to July 1-October 1, 1985. Taube seconded,

LICENSE APPROVAL - Penovich moved for approval of Operator's
licenses for Nicholas Thomas, Denise Hummer. Diane Embrick,
Richard Lass and Michael Akerman. Tomczyk seconded, carried.
VOUCHER APPROVAL - Penovich moved for approval of payment of
General Vouchers in amount of $493.262.18. Tomczvk seconded,
carried 7-0.
Penovich moved for approval of payment of Sewer Utility Vouchers
in amount of $11,228.15. Dumke seconded, carried 7-0.
ADJOURNMENT - Tomczyk moved to adjourn at 9:33 P.M. Nilsson
seconded, carried.
