MINUTES OF MEETING HELD FEBRUARY 26, 1985
Called to order by Chairman Salentine at 739 P.M. Also present
were Aldermen DeAngelis, Dumke, Gaetzke, Hilt, Nilsson and
Penovich, Clerk Stewart and City Atty. Molter. Ald. Tomczyk was
absent.
Mayor read the Notice of Closed Session, and noted Council would
reconvene into Open Session.
Penovich moved, Hilt seconded, to approve minutes of meetings
held 2/12/85 and 2/18/85. Carried.
Penovich moved to go into Closed Session at 8:Ol P.M. pursuant to
State Statutes, Section 19.85(1)(g) to confer with legal counsel
who is rendering oral or written advice concerning strategy to be
adopted by the Council with respect to litigation in which it is
or is likely to become involved, namely a dismissed public
employe. Nilsson seconded, carried unanimously.
The Council reconvened into Open Session at 8:18 P.M.

Penovich presented minutes of Public Sewer Committee meeting held
2/14/85 and moved for approval. Gaetzke seconded, carried.
Hilt presented minutes of Public Welfare Committee meeting held
2/21/85 and moved for approval. DeAngelis seconded, carried.

COMMUNICATIONS FROM MAYOR'S OFFICE
Mayor reported all Offers to Purchase for the Industrial Park
expansion had been signed and the closing set for 3/14/85.

Reso.#225-84 - Approval of Transition Plan (Federal Revenue
Sharing-Handicapped Regulations). On the floor, deferred
2/12/85. To allow Finance Committee to review those items
requiring an expenditure, Penovich moved to defer. Gaetzke
seconded, carried.
Reso.128-85 - Establishing Deferred Assessment Policies (on
floor,deferred 2/12/85). Gaetzke mved to defer for further
review. Penovich seconded, carried.
Ord.#516 - An Ordinance to Amend Chapter 8, Section 8.02 (3) and
(5) of the Municipal Code @itch Bond & Street Bond Inspection
Fee). 2nd Reading. Dumke moved for adoption. Penovich
seconded, carried unanimously.
Ord.11517 - An Ordinance to Amend Chapter 8, Section 8.04(2) of
the Municipal Code (Street Opening Permit). 2nd Reading. Dumke
moved for adoption. Gaetzke seconded, carried unanimously.
Municipal Code (Transient Merchants). 2nd Reading. Dumke moved

New Berlin Business Machines ($100). Penovich moved for
adoption. Hilt seconded, carried unanimously.
Reso.#35-85 - Authorizing Execution of Maintenance Agreement -
City Hall A. B. Dick Offset(Robertson,Inc.-$505). Nilsson moved
for adoption. Gaetzke seconded, carried unanimously.
Reso.#36-85 - Establishing Fee for Ditch Bond Release and Street
Bond Release Inspections. DeAngelis moved for adoption. Gaetzke
seconded, carried unanimously.
Reso.//37-85 - Authorizing Execution of Agreement to Retain Law
Firm to Defend City Regarding Claim Filed by Marino Construction
(approx.$35,000-Arenz,Macy,Molter & Riffle). DeAngelis moved for
adoption. Gaetzke seconded, carried unanimously.

Reso.1138-85 - Approval of Holding Tank Agreement (R.Leichtfuss)
Penovich moved for adoption. Hilt seconded. Penovich moved to
amend to change the address to "Lot 2 on HiView Drive in HiView
Acres". Dumke seconded, carried. Gaetzke moved to amend to add:
approval by the Waukesha County Health Department". Hilt
"Be it further resolved that this approval is contingent upon
seconded, carried. Resolution F38-85 As Amended was adopted
unanimously.
Reso.1139-85 - Authorizing Execution of Lease Agreement Between L.
Klauser and the City of Muskego. Dumke moved for adoption.
DeAngelis seconded. Nilsson moved to amend the agreement after
ordinances of the City", and to add No. 3: "That each 5 years
this agreement is in effect, Klauser shall pay to the City the
sum of $50.00 on the commencement of each 5 year period.
Penovich seconded, carried. Resolution 1/39-85 As Amended was
adopted unanimously.
Reso.#40-85 - Authorizing Execution of Support Services Agreement
(Gordon Flesch Co.) Penovich moved for adoption. Nilsson
seconded, carried unanimously.

Ord.11520 - An Ordinance to Repeal and Recreate Section 7.01 of
the Traffic Code in the City of Muskego. 1st Reading. In order
to assist in the prosecution of traffic cases, Atty. Molter
moved to suspend the rules which would interfere with the second
requested suspension of rules to permit second reading. Nilsson
given by title only. Gaetzke moved for adoption. DeAngelis
reading. Dumke seconded, carried unanimously. Second reading
seconded, carried unanimously.
Ord.11521 - An Ordinance to Amend Chapter 12, Section 12.17(5) of
the Municipal Code (Parade Fees). 1st Reading.
LICENSE APPROVAL - Penovich moved for approval of Operator's
Licenses for Larry Warner. Kathleen Luther. Charles Janz. Susan
Hodach, Pamela Payne and Timothy Lassa. Dumke seconded,.carried.
VOUCHER APPROVAL - Penovich moved for approval of payment of
General Vouchers in the amount of $99,041.36. Gaetzke seconded, carried unanimously.
