ccm19840724V CITY OF MUSKEG0 COMMON COUNCIL MINUTES OF MEETING HELD JULY 24, 1984 were Aldermen Tomczyk, DeAngelis, Dude, Gaetzke, Hilt and Called to order by Chairman Salentine at 7:32 P.M. Also present Nilsson, City Atty. Molter and City Clerk Stewart. Ala. Penovich arrived at 8:OO P.M. July 10, 1984. Carried. Tomczyk moved, Hilt seconded, to approve minutes of meeting held COMMITTEE REPORTS Tomczyk presented minutes of Finance Committee meetings held 7/18/84 and 7/24/84 and moved same be accepted. DeAngelis seconded, carried. Hilt presented minutes of Public Safety Committee meeting held 7/11/84 and moved same be accepted. Nilsson seconded, carried. held 7/19/84 and moved same be accepted. Tomczyk seconded, Gaetzke presented minutes of Public Welfare Committee meeting carried. 0 Nilsson presented minutes of Rules, Laws and Ordinance Committee I meeting held 7/23/84 and moved same be accepted. Gaetzke seconded, carried. DeAngelis presented minutes of Public Sewer Committee meeting held 7/19/84 and moved same be accepted. Gaetzke seconded, carried. Council agreed with the recommendation of the Plan Commission Plan Commission minutes of 7/17/84 meeting were reviewed. The to notify the county that the City of Muskego recommends the regarding the proposed extension of Moorland Road. Gaetzke moved extension of Moorland Road by use of the most-westerly proposed route. Tomczyk seconded, carried unanimously. UNFINISHED BUSINESS Ord.#498 - An Ordinance to Amend Chapter 1, Section 1.02 of the Municipal Code (Police Powers). Read by Clerk. On the floor, deferred from 7/10/84. Discussion concerning liability involved against police powers for aldermen. Penovich moved to defer to and authority to carry guns followed. Atty. Molter advised obtain response from insurance company regarding liability coverage. Gaetzke seconded. Motion carried 4-3 with DeAngelis, 0 Dumke, -Gaetzke and Penovich voting "yes" and Tomczyk, Hilt-and Nilsson voting "no". b 7/24/84 - Page Two Common Council Minutes NEW BUSINESS Reso.#149-84 - Approval of Certified Survey Map (H. Bennett). Nilsson moved for adoption. Hilt seconded, carried unanimously. Reso.#150-84 - Denial of Legal Lot Status (F. Switala). Nilsson moved for adoption. Hilt seconded. Mayor felt Land Division Ord. restriction on legal lot status because of ownership of adjoining property by parents and children is unfair. Mayor stated there should be no lateral if legal status denied and the assessment on this property could be questioned. Motion carried 6-1 with DeAngelis voting "no". Tomczyk moved for adoption. Hilt seconded. Noted home with business quarters would be constructed on site. Carried unanimously. Reso.#157-84 - Approval of Increase in City's Contribution to Non-Represented Employees Pension Fund (plus .02 to .57/hr.). Tomczyk moved for adoption. Dumke seconded, carried unanimously. Reso.#158-84 - Directing City Attorney to Obtain Necessary Easement for the St. Paul East Drainage Project. Penovich moved for adoption. Nilsson seconded, carried unanimously. Reso.#159-84 - Establishing Traffic Regulations (Temporary 25 mph Woods Rd.-sewer constr. area). DeAngelis moved for adoption. Clerk gave first reading. LICENSE APPROVAL - Tomceyk moved for approval of Operator's Licenses for Diane Drewitz. Kurt Arnold. Therese Bowen. Jean Repischak, Ethel Soliwoda and Leah Robertson. Dumke seconded, carried. Tomczyk moved for approval of Operator's License for Todd Helm subject to payment of outstanding fines and favorable police report. Nilsson seconded, carried unanimously. Tomczyk moved for approval of Gathering Permits for Muskego 8/5/84; and, Muskego V.P.W. Post #a171 - 8123-26184. Nilsson Icetronauts - 9/9/84 and 10/14/84; St. Paul Ev. Lutheran Church - seconded, carried. Tomczyk moved for approval of rifle range permit for Klauser's. Hilt seconded. After discussion, Gaeteke moved to amend motion to approve with following Terms of Use to be placed on License: 1. No shooting permitted until inspected by a responsible party not go into use until that inspection made and approval given. of the City of Muskego from a safety standpoint. Rifle Range may 2.
