MINUTES OF MEETING HELD MAY 8, 1984
Called to order by Chairman Salentine at 7:40 P.M. Also present
were Aldermen Tomczyk. DeAngelis, Dumke, Gaetzke, Hilt, Nilsson
and Penovich, Atty. Molter and Clerk Stewart.
Tomczyk moved, Penovich seconded, to approve minutes of meeting
held April 24, 1984. Carried.
Gaetzke moved, Tomczyk seconded, to convene into Closed Session
pursuant to State Statutes, Section 19.85(1)(g) to confer with
Wisconsin vs. the City of Muskego regarding effluent limitation
legal counsel with respect to litigation, namely the State of
violations. Carried unanimously.
Council reconvened into Open Session at 8:07 P.M.
COMMITTEE REPORTS
Tomczyk presented minutes of Finance Committee meetings of 5/2/84
and 5/8/84 and moved same be accepted. Dumke seconded, carried.
Penovich presented minutes of Public Sewer Committee meeting held
4/26/84 and moved same be accepted. Gaetzke seconded, carried.
Hilt presented minutes of Public Safety Committee meeting held
5/3/84 and moved same be accepted. Nilsson seconded, carried.
Tomczyk presented minutes of Cable TV Citizens Committee meeting
held 4/4/84. Tomczyk advised that those with Cable complaints
should submit them as follows: 1st - Ingersoll Cable Corp.;
2nd - Charles Damaske, chairman of cable committee; 3rd - Their
alderman; and 4th - Ald. Tomczyk, Chairman of Welfare Committee
The Plan Commission minutes of their 5/1/84 meeting were
received.
UNFINISHED BUSINESS
Ord.W490 and Ord.8491 - Amendments to Zoning Ordinance and Zoning
District Map regarding Exclusive Agriculture. Tomczyk moved to
defer until June 26, 1984 to obtain approval from State
Agriculture Board. DeAngelis seconded, carried.
COMMUNICATIONS FROM MAYOR'S OFFICE
by Veterans of Foreign Wars (VFW - May 19th thru Memorial Day).
Clerk read Proclamation recognizing Annual Sale of Buddy Poppies
Legion Poppy Month.
Clerk read Proclamation proclaiming the month of May as American
Business Week.
Clerk read Proclamation declaring May 6-12, 1984 as Small

Newspapers of the City of Muskego. DeAngelis moved for adoption.
Reso.#99-84 - Accepting Community Newspapers, Inc. as Official
Penovich seconded, carried unanimously.
Reso.Bl00-84 - Approval of Practice/Show Dates of Water Bugs Ski
seconded. Gaetzke moved to amend resolution in the fourth
Club on Little Muskego Lake. Tomczyk moved for adoption. Hilt
paragraph to read after "as follows": "...subject to a
certificate of insurance for $1,000,000 coverage naming the City
of Muskego as co-insured, to be submitted to the City for review
prior to the first date of operation of May 16, 1984." Seconded
by Nilsson, carried unanimously. Reso.#100-84 As Amended adopted
unanimously.
Little Muskego Lake (Water Bugs). Nilsson moved for adoption.
Reso.#101-84 - Granting Placement of Water Ski Jump on Bed of
Penovich seconded. Tomczyk moved to amend to add: "Be it
further resolved that this approval is subject to a certificate
of insurance for $1,000,000 coverage naming the City of Muskego
as co-insured, to be submitted to the City for review prior to
the first date of operation of May 16. 1984." Nilsson seconded,
carried unanimously. Reso. #101-84 As Amended adopted
unanimously.
Reso.#102-84 - Authorizing Settlement of Litigation Between State
of Wisconsin vs. City of Muskego. ($14,000) Gaetzke moved for
adoption. DeAngelis seconded, carried unanimously.
Reso.#103-84 - Approval of Certified Survey Map - Irene
Preston. Nilsson moved for adoption. Penovich seconded. The
moved to amend last paragraph to delete "$800" and include
Council questioned the number of lots being created, and Nilsson
Tomczyk seconded, carried. Reso. #103-84 As Amended adopted
"required fee" for further review by the Building Inspector.

Eroellch (Lembezeder Dr.). Nilsson moved for adoption. Hilt
moved to defer and refer to Plan Commission for further review.

Reso.Wl04-84 - Approval of CSM - Froelich (Gold Dr.). Nilsson
moved to reconsider. DeAngelis seconded, carried unanimously.
In order to clarify location of driveways, Nilsson moved to defer
and refer to Plan Commission for further review. DeAngelis
seconded, carried unanimously.
Reso.#106-84 - Approval of Certified Survey Map - Julius
Caesar. Nilsson moved for adoption. Tomczyk seconded.
DeAngelis moved to amend resolution to add: Be it further
resolved that this approval is subject to the execution of an
easement to gain ingress and egress to the dam on Big Muskego
Lake. Nilsson seconded, carried unanimously. Reso. #106-84 As
Amended adopted unanimously.
Reso.#107-84 - Authorizing Execution of Attached Document
Relating to Kurtze Lane Drainage Project (Pellmann Easement).
Tomczyk moved for adoption. Penovich seconded. Atty. Molter
reviewed document and recommended the use of the easement format
normally used by the City with provisions requested by Pellmann's
amend the resolution in the first paragraph after "does hereby"
if Council agreed, which he would prepare. Gaetzke moved to
document provided by Glenn and Ruth Pellmann, with the exception
to read: "...agree with the concept stated in the attached
of the statement in No. 5 which reads "In addition, there shall
be no special assessment to Pellmann as a result of this easement
or any other construction in regard thereto."; and to amend
second paragraph after "name of the City" to read: "...based on
said concept to obtain such an easement from the Pellmann's for
the Kurtze Lane Drainage Project, subject to notification by the
City Engineer that DNR approval has been obtained." DeAngelis
seconded, carried unanimously. Reso. 8107-84 As Amended adopted
unanimously.
Reso.Wl08-84 - Authorizing Execution of Maintenance Agreement -
City Hall Complex Telephones. ($138.87/mo.) Penovich moved for
adoption. Tomczyk seconded, carried unanimously.
Reso.Bl09-84 - Resolution for Outdoor Recreation Aids for
Development of the Denoon Park Project. Tomczyk moved for
adoption. Nilsson seconded, carried unanimously.
Reso.#110-84 - Establishing Traffic Regulations. (Designating
Hilt seconded, carried unanimously.
Sherwood Circle as Through Street). Nilsson moved for adoption
Reso.tll1-84 - Approval of Waterway Placement Markers at Idle
Isle Beach. Tomczyk moved for adoption. Penovich seconded,
carried unanimously.
Ord.R492 - An Ordinance to Amend Chapter 1, Section 1.06 of the
Municipal Code (Mun.Judge). 1st reading by title only.

Ord.#494 - An Ordinance to Amend the Zoning Map of the City of
Muskego (B-1 to RSH - Richter)
LICENSE APPROVAL - Tomczyk moved for approval of Operator’s
Licenses tor Thomas Amann, Shelley ilathsack, Edward Gorecki, Jill
Garbe, Shirley Smith, Wade Hummer and Rodney Colburn. Nilsson
seconded, carried.
Tomczyk moved for approval of Class B Fermented Malt Beverage and
Intoxicating Liquor License for R.L.C., Inc., Hathew Amann,
Agent, SllO W20874 South Denoon Road (formerly licensed to Dan
Amann) . Penovich seconded, carried.
VOUCHER APPROVAL - Tomczyk moved for approval of General Vouchers
in the amount of $86,663.84. Hilt seconded, carried unanimously.
Gaetzke moved for approval of Daymezt of Sewer Utilitv Vouchers
unanimously. in the amount of $45;925.49. Dekngslis seconded, car;ied

Mayor noted RCA hearing would be May 9, 1984 at 7:OO P.M. at High
School.
